1. Approve the Evaluation procedure of activities of certification bodies for individual approval of wheel vehicles, batches of parts and the equipment which is applied.

2. To department to ensure safety on transport submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. To impose control of execution of this order on the deputy minister Lavrenyuk Yu. F.

Evaluation procedure of activities of certification bodies for individual approval of wheel vehicles, batches of parts and the equipment

I. General provisions

1. This Procedure determines assessment procedures of activities of the appointed certification bodies for individual approval of the wheel vehicles new and former in the use (further - wheel vehicles), batches of parts and the equipment (further - the appointed bodies).

2. The bases for evaluating activities of the appointed body are:

submission of the written application by authorized body about evaluating its activities for his desire;

the motivated written complaint on actions of the appointed body provided by the physical person or the subject of managing who addressed the appointed body for performance of works for certification of wheel vehicles, batches of parts and the equipment or on failure to act of the appointed body;

representation by state bodies, People's Deputies of Ukraine, public associations, other legal entities and physical persons of the motivated address based on the revealed information on the possible facts which are the basis for decision making about cancellation of appointment of certification body for individual approval of wheel vehicles, batches of parts and the equipment according to Procedure for appointment, refusal in appointment and cancellations of appointment of certification body for individual approval of vehicles, batches of parts and the equipment approved by the resolution of the Cabinet of Ministers of Ukraine of July 1, 2016 No. 419 (further - the Procedure for appointment).

3. The provided claims and addresses about availability of the facts which are the basis for decision making about cancellation of appointment of certification body for individual approval of wheel vehicles, batches of parts and the equipment, without provision of the actual data allowing to determine availability or lack of the specified facts are left without consideration what the Ministry of Infrastructure notifies the author of such claim (address) within 10 working days on.

4. Assessment of activities of the appointed body is carried out for the purpose of identification:

shortcomings of activities of the appointed body for his desire;

facts of doubtful results of certification of wheel vehicles, batches of parts and equipment;

the false information provided to them in the documents enclosed to the application for appointment;

discrepancies of the appointed body to the requirements determined by item 4 of the Procedure for appointment.

5. Assessment of activities of the appointed body is carried out by the Commission of the Ministry of infrastructure of Ukraine concerning ensuring accomplishment of the Geneva accord of 1958 which performs the activities according to the Provision approved by the order of the Ministry of Infrastructure (further - the Commission), and is advisory advisory body, with involvement in case of need of representatives of the central executive bodies (in coordination).

The structure of the Commission affirms the order of the Ministry of Infrastructure.

II. The organization of evaluating activities of the appointed body

1. Assessment of activities of the appointed body is carried out by the analysis:

notifications from the appointed bodies of the Ministry of Infrastructure on any changes in the relation of data which were noted in the documents provided by them for receipt of appointment;

certificates of conformity of wheel vehicles, batches of parts and the equipment and documents based on which the specified certificates of conformity were issued (further - cases on certification);

the information obtained from state bodies and the third parties on requests of the Ministry of Infrastructure about confirmation of conformity of the appointed body to the requirements determined by item 4 of the Procedure for appointment, and also published on the official sites of state bodies;

information concerning the activities of the appointed body which arrived to the Ministry of Infrastructure from the third parties (state bodies, public associations, People's Deputies of Ukraine, other legal entities or physical persons).

2. Assessment of activities of the appointed body is carried out by the Ministry of Infrastructure within no more than 60 working days from the date of receipt of the Ministry of Infrastructure of the claim, the address or the statement, stipulated in Item 2 Sections I of this Procedure.

3. If information of rather doubtful results of certification of wheel vehicles, batches of parts and the equipment is provided in the claim or the address, only those certificates and business on certification which it is talked in the claim or the address are subject to the analysis.

For the purpose of carrying out the analysis of the cases on certification specified in paragraph one of this Item, the Ministry of Infrastructure sends inquiry to the relevant appointed organ. The appointed body shall provide to the Ministry of Infrastructure such cases on certification within 10 working days from the date of receipt of request of the Ministry of Infrastructure.
