About approval of Rules of issue of veterinary documents and requirements to their forms

1. Approve the enclosed Rules of issue of veterinary documents and requirements to their forms.

2. To provide to department of veterinary and food safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of issue of veterinary documents and requirements to their forms

Chapter 1. General provisions

1. These rules of issue of veterinary documents and requirements to their forms (further – Rules) are developed according to subitem 46-4) of article 8 of the Law of the Republic of Kazakhstan "About veterinary science" (further – the Law), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services), the subitem 4) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" and determine procedure for issue of veterinary documents and requirements to their forms, and also procedure for rendering the state services "Issue of the Veterinary Certificate on the Moved (Transported) Objects When Exporting", "Issue of the Veterinary and Sanitary Conclusion on Subjects to the State Veterinary Health Control and Supervision" and "Issue of the Veterinary Reference".

2. In these rules the following concepts are used:

1) the breeding certificate – the document confirming family tree, productive and other qualities of breeding products (material), issued by republican chamber according to the order of the Minister of Agriculture of the Republic of Kazakhstan of December 11, 2015 to No. 3-2/1079 "About approval of forms of breeding certificates on all types of breeding products (material) and Rules of their issue (cancellation)" (it is registered in the Register of state registration of regulatory legal acts No. 13035);

2) territorial subdivisions of department (further – territorial subdivisions) – the territorial subdivisions located on the corresponding administrative and territorial units (the area, the city of republican value, the capital, the area, the city of regional value);

3) department of authorized body in the field of veterinary science (further – department) – Committee of veterinary control and supervision of the Ministry of Agriculture of the Republic of Kazakhstan;

4) divisions of production supervision – the divisions created by administration of the objects of production performing slaughter of animals, conversion and sales of products and raw materials of animal origin by determination of compliance of animals, products and raw materials of animal origin to veterinary standard rates;

5) the web portal of "the electronic government" (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically.

Chapter 2. Procedure for issue of the veterinary certificate on the moved (transported) objects when exporting

The veterinary certificate on the moved (transported) objects when exporting (further – the veterinary certificate) is issued by the Chief state veterinary health inspector of the cities of republican value, the capital, area, city of regional value and its deputies, the state veterinary health inspectors based on the list approved by the Chief state veterinary health inspector of the cities of republican value, the capital, area, the cities of regional value and its deputy according to the subitem 3) of Item 3 and the subitem 2) of item 4 of article 16 of the Law (further – the state veterinary health inspector).

4. The list of the main requirements to rendering the state service "Issue of the Veterinary Certificate on the Moved (Transported) Objects when Exporting" is specified in appendix 1 to these rules (further – the List No. 1).

Physical persons and legal entities (further – uslugopoluchatel) for receipt of the veterinary certificate beforehand (at least 2 (two) working days, except for case, stipulated in Item 9 these rules) prior to transportation submit to the service provider through office of the relevant territorial subdivision, or by means of the portal the statement on issue of the veterinary certificate on the moved (transported) objects when exporting in form according to appendix 2 to these rules and the documents specified in Item 8 of the List No. 1.

5. The clerk of territorial subdivision performs registration of a statement and the documents specified in Item 8 of the List No. 1, within 30 (thirty) minutes from the moment of receipt and sends to the head of territorial subdivision for determination of the responsible state veterinary health inspector.

Confirmation of adoption of the statement on paper in office of territorial subdivision is the mark in its copy about registration with indication of date, time (hours, minutes).

In case of the address of uslugopoluchatel for receipt of the veterinary certificate through the portal, in "private office" of uslugopoluchatel the status about acceptance of request for rendering the state service, and also the notification with indication of date and time of receipt of result of the state service is displayed.

6. The veterinary certificate or motivated refusal in rendering the state service is issued within 2 (two) working days from the moment of receipt of the statement, except for case, stipulated in Item 9 these rules.

On products specified in Item 9 of these rules, the veterinary certificate or motivated refusal in rendering the state service it is drawn up in day of receipt of the statement.

7. In case of representation by uslugopoluchatel of incomplete document package and (or) documents with the expired effective period, the state veterinary health inspector within 1 (one) working day prepares motivated refusal in further review of the statement with use of single automated control system for industries of agro-industrial complex "e-Agriculture" (further – IS EASU) and sends it to uslugopoluchatel through office of the service provider (in case of the appeal to office of the service provider), or by means of the portal to "private office" of the uslugopoluchatel (in case of the address by means of the portal) in electronic form signed by the digital signature (further – the EDS) the state veterinary health inspector.

8. In case of representation uslugopoluchately complete document package, the state veterinary health inspector within 1 (one) working day:
