About information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and information systems of the Public fiscal service of Ukraine

According to the Tax code of Ukraine, the Law of Ukraine "About collection and accounting of single fee on obligatory national social insurance", article 13 of the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" and for the purpose of ensuring information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and information systems of the Public fiscal service of Ukraine PRIKAZYVAYEM:

1. Approve the Procedure for information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and information systems of the Public fiscal service of Ukraine which is applied.

2. Determine that:

1) before introduction of information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the Register) and information systems of the Public fiscal service of Ukraine in real time such interaction is performed in working hours taking into account technical capabilities of the Register and information systems of the public fiscal service of Ukraine according to the legislation, but with interval no more than 2 hours;

2) before implementation of exchange of documents electronically between the Register and information systems of the Public fiscal service of Ukraine on representation of requests the state loggers of legal entities, physical persons entrepreneurs and public forming and transfers to the Register of data on lack (availability) of the tax arrears and charges, about lack (availability) of debt on payment of single fee on obligatory national social insurance, about approval of the plan of reorganization of the legal entity such data are transferred by the Public fiscal service of Ukraine to the Register taking into account technical capabilities of the Register and information systems of the Public fiscal service of Ukraine, namely:

about availability of the tax arrears and charges - by the direction of notifications on availability of objections against carrying out state registration of the termination of the legal entity in form No. 27-OPP or notifications on availability of tax debt and impossibility of holding the simplified procedure of state registration of the termination of the legal entity for form No. 23-OPP;

about availability of debt on payment of single fee on obligatory national social insurance - by the direction of notifications on debt availability on payment of single fee and about impossibility of carrying out state registration of the termination of the legal entity in form No. 5-ECB;

about absence of debt on tax payment and charges - by the direction of notifications on withdrawal of objections against carrying out state registration of the termination of the legal entity in form No. 28-OPP;

about absence of debt on payment of single fee on obligatory national social insurance - by the direction of notifications on withdrawal of objections against carrying out state registration of the termination of the legal entity in form No. 6-ECB;

about approval of the plan of reorganization of legal entities - by the direction of notifications on withdrawal of objections against carrying out state registration of the termination of the legal entity in form No. 28-OPP;

3) confirmation of conformity of registration number of accounting card of the taxpayer or series and passport number (for physical persons which on the religious beliefs refused acceptance of registration number of accounting card of the taxpayer and notified on it the relevant monitoring body and have mark in the passport) information from the State register of physical persons taxpayers is performed by the public fiscal service of Ukraine in day of receipt of request from the subject of state registration according to the Procedure for carrying out confirmation of conformity of registration data of physical person this the State register of physical persons taxpayers on requests of subjects of the information relations, approved by the order of the Ministry of Finance of Ukraine of November 13, 2015 No. 1007, registered in the Ministry of Justice of Ukraine on November 17, 2015 for No. 1443/27888.

3. The state logger of legal entities, physical persons entrepreneurs and public forming uses the notifications provided by the subitem 2 of Item 2 of this order, which arrived from the Public fiscal service of Ukraine before introduction of the corresponding exchange of documents electronically between the Register and information systems of the Public fiscal service of Ukraine.

4. Declare invalid the order of the Ministry of Justice of Ukraine, the Ministry of Finance of Ukraine of October 9, 2015 No. 1918/5/869 "About information exchange between the Unified State Register of Legal Entities and physical persons entrepreneurs and information systems of the Public fiscal service of Ukraine, exchange of documents electronically", registered in the Ministry of Justice of Ukraine on October 12, 2015 for No. 1228/27673.

5. To the technical administrator Reestra and the Public fiscal service of Ukraine to take the adequate measures necessary for implementation of this order.

6. To department of the civil, financial legislation and legislation concerning land relations of the Ministry of Justice of Ukraine () submit A.N. Ferens this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

7. This order becomes effective from the date of, its official publication following behind day.
