About enhancement of the mechanism of regulation of foreign trade

For the purpose of enhancement of the mechanism of regulation of foreign trade, further liberalization of commodity export, accounting of export and import of raw materials, including on the basis of agreements on conversion (performance of works, rendering services) on basis to be provided (production cooperation) with foreign partners, the Government of the Republic of Moldova DECIDES:

1. Determine that:

since September 1, 1997 export, import, and also re-export of goods (works, services) is performed freely, by their declaring at customs, except for the goods specified in appendix N 1, for import which export and re-export the corresponding license granted by the bodies specified in the same appendix is required.

To authorized bodies to grant licenses and to register the relevant contracts according to the procedure, the established Regulations on procedure for issue of export licenses and commodity import and Regulations on accounting treatment and raw materials export import control (performance of works, rendering services) on the basis of agreements on conversion on basis to be provided, according to the appendices N 2 and 3;

in case of commodity export, made or processed by two or more business entities - residents of the Republic of Moldova, the financial responsibility for complete repatriation of currency amounts and material values is born by the legal resident person who is the exporter of the corresponding goods;

since April 30, 1998 retail trade by mass sales items, irrespective of country of source, without reduction of information on these goods made in state language on product, the label, packaging or in the accompanying documents is forbidden. Regulations on procedure for import licensing of alcoholic beverages and tobacco products according to the appendix N 4.

4. To the Ministry of Economics and reforms:

accelerate development and representation to the Government of the Republic of Moldova of the following documents:

the bill on protection of national producers and the domestic market from the disloyal competition - till October 1, 1997; concepts of promotion of export of goods - till December 1, 1997; together with the Ministry of Agriculture and Food, the Industry ministry and trade, Department of standards, metrology and technical supervision to develop package of measures for protection of the domestic market.

5. To department of customs control:

exercise control over the implementation of the barter deals and cooperation obligations providing expense recovery on production on basis to be provided material values (raw materials), providing strict accounting of deliveries of goods under each agreement separately before full implementation of its conditions and strict observance of amounts of the mutually deliveries established in the agreement. The term of accomplishment of barter agreements constitutes no more than 90 days from the date of execution of the commodity customs declaration, and agreements on conversion on basis to be provided - no more than 60 days from the date of the termination of production cycle;

provide monthly to Department of trade information on export, import and re-export of goods, to the Ministry of Agriculture and Food - information on export volumes of food products, and the Ministry of Health - information on import export of pharmaceutical products, medical equipment and products of medical appointment;

strengthen customs supervision of transportation of goods in the transit mode through the territory of the Republic of Moldova;

in a month to finish and provide to the Government of the Republic of Moldova regulations on customs regime of transit;

provide the declaration of the imported or exported goods made on the basis of agreements on conversion of the raw materials on basis to be provided imported or exported according to world practice in full of their cost;

resolve re-export of goods after representation to customs authorities of the certificate of origin and the documents confirming their import in case such re-export does not contradict conditions of international agreements which participant is the Republic of Moldova;

check monthly customs statistics of the Republic of Moldova in comparison with customs statistics of the countries with the greatest specific weight in foreign trade of the Republic of Moldova and make offers on liquidation of disagreements and shortcomings of this area.

6. To department of statistics:

perform accounting of export commodity import (works, services) by business entities and to provide monthly relevant information to National Bank of Moldova;
