About approval of the Procedure for information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and the automated system of enforcement proceeding

According to Article part two 5, and the eighth article 13 of the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" and to Item 10 of the Regulations on the Ministry of Justice of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 2, 2014 No. 228, I order to parts one:

1. Approve the Procedure for information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and the automated system of enforcement proceeding which is applied.

2. To provide to the technical administrator of the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and the automated system of enforcement proceeding the automated information exchange according to the Procedure for information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and the automated system of enforcement proceeding approved by this order within the I quarter 2017.

3. Before introduction of the automated information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and the automated system of enforcement proceeding interaction between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and the Unified state register of enforcement proceedings according to the procedure, approved by this order, using the digital signature with use of the strengthened certificate of key is performed.

Transfer of data software of the Unified state register of enforcement proceedings is performed no later than 10:00 the next working day from the date of their entering into the Unified state register of enforcement proceedings (the automated system of enforcement proceeding).

4. Declare invalid the order of the Ministry of Justice of Ukraine of August 26, 2015 No. 1594/5 "About approval of the Procedure for information exchange between the Unified State Register of Legal Entities and physical persons entrepreneurs and the Unified state register of enforcement proceedings", registered in the Ministry of Justice of Ukraine on August 27, 2015 at No. 1032/27477.

5. To department of private law of the Ministry of Justice of Ukraine () submit A.N. Ferens this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

6. This order becomes effective from the date of, its official publication following behind day.

Procedure for information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and the automated system of enforcement proceeding

I. General provisions

1. This Procedure determines the procedure of transfer of data on opening and completion of enforcement proceedings (further - data) from the automated system of enforcement proceeding in the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the Unified state register).

2. In this Procedure terms are used in the values given in the Laws of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming", "About enforcement proceeding" and other regulatory legal acts adopted according to the specified Law.

3. Transfer of data from the automated system of enforcement proceeding in the Unified state register is performed at the central level electronically on telecommunication channels.

4. Technical support of transfer of data is provided with the technical administrator of the automated system of enforcement proceeding and the Unified state register.

5. Transfer of data according to this Procedure is performed free of charge.

6. The procedure of the automated information exchange according to this Procedure is determined by technical documentation, affirms the technical administrator of the automated system of enforcement proceeding and the Unified state register.

7. The technical administrator of the automated system of enforcement proceeding and the Unified state register provides timely transfer and acceptance of the data determined by this Procedure.

II. Procedure for transfer of data

1. From the automated system of enforcement proceeding the following data are transferred to the Unified state register:

1) for legal person debtor - full name, identification code of the legal entity in the Unified state register of the companies and organizations of Ukraine and its location;

for physical person entrepreneur-debtor - surname, name, middle name, registration number of accounting card of the taxpayer or series and passport number (for physical persons which on the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and notified on it the relevant monitoring body and have mark in the passport about the right to make payments on series and passport number), birth date and its residence;

2) data on enforcement proceedings:

number in the automated system of enforcement proceeding (The unified state register of enforcement proceedings);

date of opening of enforcement proceeding, completion of enforcement proceeding, cancellation of the resolution on opening of enforcement proceeding, cancellation of the resolution on the termination of enforcement proceeding, recovery of enforcement proceeding;

replacement of the debtor in enforcement proceeding;

body of the public executive service, the private contractor by which are entered into the automated system of enforcement proceeding of the data on enforcement proceeding;

3) date and time of forming of data from the automated system of enforcement proceeding.
