About regulations and rules of rational use and protection of subsoil

Based on subitem 1.5 of Item 1 of article 10 of the Code of the Republic of Belarus about subsoil the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for development, approval, approval, registration, enforcement and publication of regulations and rules of rational use and protection of subsoil, modification and amendments of them it (is applied).

2. This resolution becomes effective since January 23, 2017.

Regulations on procedure for development, approval, approval, registration, enforcement and publication of regulations and rules of rational use and protection of subsoil, modification and amendments in them

Chapter 1. General provisions

1. This Provision determines procedure for development, approval, approval, registration, enforcement and publication of regulations and rules of rational use and protection of subsoil, modification and amendments in them.

2. Are determined by regulations and rules of rational use and protection of subsoil:

2.1. requirements, rules, procedure of the activities connected with geological studying of subsoil which treat:

work on geological studying of subsoil on stages and stages;

calculation, recalculation and (or) revaluation, write-off of inventories of minerals and (or) geothermal resources of subsoil (except for petrogeotermalny resources) and the passing components containing in them;

creation of reports by results of works on geological studying of subsoil;

creation of the project documentation on geological studying of subsoil, including subsoil plots for the purposes which are not connected with mining in the part concerning structure, content and procedure for execution of the project documentation;

creation (updating) of technical and economic reports on feasibility of carrying out detailed investigation of minerals and (or) geothermal resources of subsoil, feasibility statements on development of mineral deposits and (or) geothermal resources of subsoil;

establishment of forms of passports, catalogs, registration cards of fields (their parts) and shows of minerals, geothermal resources of subsoil, single water intakes, the separate boreholes intended for hydrocarbon production and also underground spaces which are used or can be used for the purposes which are not connected with mining, procedure for their filling and accounting;

studying and forecasting of exogenous and endogenous geological processes (landslides, mudflows, bogging, earthquakes and another), and also technogenic ecological processes;

observation of the mode of underground waters;

other activities connected with geological studying of subsoil;

2.2. requirements, rules, procedure of the activities connected with mining, use of geothermal resources of subsoil, subsoil plots for construction and (or) operation of the underground constructions which are not connected with mining and underground spaces which treat:

accounting of amount of minerals and overburden breeds when mining;

carrying out surveying works in case of development of mineral deposits;

forecasting of condition of subsoil in case of development of mineral deposits (their parts), uses of geothermal resources of subsoil, construction and operation of the objects which are not connected with mining;

creation of the project documentation on development of mineral deposits, use of geothermal resources of subsoil, carrying out mining operations in case of construction and (or) operation of the underground constructions which are not connected with mining in the part concerning structure, content and procedure for execution of the project documentation;

other activities for rational, complex use and protection of subsoil in case of development of mineral deposits (their parts) and to use of geothermal resources of subsoil;

2.3. requirements, rules, procedure of the activities connected with project development of preservation, degreasing, liquidation of the mountain companies, excavations, and also the underground constructions which are not connected with mining, works on preservation, degreasing and liquidation of the mountain companies, excavations, and also the underground constructions which are not connected with mining;

2.4. classifications:

inventories of minerals and (or) geothermal resources of subsoil (except for petrogeotermalny resources);

forecast resources of minerals;

operational losses of minerals;

the quantitative and (or) qualitative indexes determining objects of geological studying of subsoil;

2.5. other requirements in the field of rational use and protection of subsoil.

Chapter 2. Procedure for development, approval and approval of regulations and rules of rational use and protection of subsoil, modification and amendments in them

3. Preparation of projects of regulations and rules of rational use and protection of subsoil is performed based on annual plans of preparation of the technical regulatory legal acts approved by the Ministry of Natural Resources and Environmental Protection (further - Ministry for Protection of the Environment and Natural Resources).

4. Projects of regulations and rules of rational use and protection of subsoil are developed by Ministry for Protection of the Environment and Natural Resources or the organization authorized by it (further - authorized organization).

5. Ministry for Protection of the Environment and Natural Resources or authorized organization can involve specialists of the interested state bodies (organizations), scientific institutions, specialists of other organizations having necessary professional skills in the field of the regulated relations to project development of regulations and rules of rational use and protection of subsoil.

6. Regulations and rules of rational use and protection of subsoil, as a rule, consist of the following Sections:

"General provisions";

"Requirements to objects to which action of regulations and rules of rational use and protection of subsoil extends";

"Geological studying of subsoil and (or) use of resources of subsoil".

The Section "General provisions" includes general information about objects for which regulations and rules of rational use and protection of subsoil, scope of regulations and rules of rational use and protection of subsoil and their Date of Introduction in action are established.

The Section "Requirements to Objects to Which Action of Regulations and Rules of Rational Use and Protection of Subsoil Extends" includes requirements imposed to objects to which extends the action of regulations and rules of rational use and protection of subsoil provided in the form of the text description, the list of indicators (characteristics) with specific numerical values.
