About measures for radical enhancement of activities of legal service

Lately in the country the package of measures for ensuring rule of law and legality in activities of state bodies, bodies of economic board, the state companies, organizations and organizations is realized (further - state bodies and the organizations).

There are no procedure for creation of legal services, standard rates and criteria of determination of their number of staff which do not allow to provide rational determination of organizational and regular structure of legal services in various state bodies and the organizations.

Legal services do not adjust effective work on studying and generalization of law-enforcement practice, preparation of suggestions for improvement of the legislation. Work in this sphere comes down to taking measures to remedial action and the violations revealed by law enforcement and monitoring bodies.

Level of material security of employees of legal service does not promote attraction to this sphere of qualified specialists with the higher legal education and practical experience that affects quality of work of legal services.

For the purpose of further strengthening of legality in activities of state bodies and organizations, consecutive strengthening of role and responsibility of legal service in carrying out democratic and legal reforms:

1. Determine the most important activities of legal services of state bodies and organizations:

the organization of ensuring rule of law and legality in law-enforcement activities of state bodies and organizations;

control of compliance to the legislation of drafts of the regulatory legal acts and other documents developed (accepted) by state bodies and the organizations;

participation in rule-making activities of state bodies and organizations, coordination of work of their divisions in questions of preparation of suggestions for improvement of the legislation;

participation in increase in legal culture and legal literacy of employees of state bodies and the organizations, finishing to them essence and value of the adopted regulatory legal acts, including with use of modern information and communication technologies;

conducting contractual and legal and claim and claim work, ensuring reliable protection of valuable and other interests of state bodies and organizations.

2. Determine that:

in state bodies and the organizations, including their territorial subdivisions, legal services according to the minimum standard rates and criteria approved by the Cabinet of Ministers of the Republic of Uzbekistan are without fail formed. At the same time reducing the available established posts of legal service is not allowed;

the procedure for assignment of class ranks, payments of the length-of-service allowances established for employees of judicial authorities extends to employees of legal services of state bodies and organizations. At the same time if on place of employment of the employee of legal service higher sizes on payment of allowances than established by the legislation are established, then payment of these allowances is performed by the high sizes and the covering of expenses is performed at the expense of means of state bodies and the organizations;
