About the tariff quotas on import of pork and fowl in 2017

According to subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of April 5, 2016 "About state regulation of foreign trade activity" and the Decision of Board of the Eurasian economic commission of August 30, 2016 No. 97 "About establishment of the tariff quotas concerning separate types of the agricultural goods imported in 2017 on customs area of the Eurasian Economic Union and also about amounts of the tariff quotas concerning these goods imported in the territory of state members of the Eurasian Economic Union" Council of Ministers of the Republic of Belarus DECIDES: No. 124

1. To the Ministry of Agriculture and Food:

1.1. determine for 2017 by areas the tariff quotas on import to the territory of the Republic of Belarus of pork fresh, cooled or refrigerated, pork trimming, classified according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union codes 0203 11 100 1, 0203 11 900 1, 0203 12 110 1, 0203 12 190 1, 0203 12 900 1, 0203 19 110 1, 0203 19 130 1, 0203 19 150 1, 0203 19 550 1, 0203 19 590 1, 0203 19 900 1, 0203 21 100 1, 0203 21 900 1, 0203 22 110 1, 0203 22 190 1, 0203 22 900 1, 0203 29 110 1, 0203 29 130 1, 0203 29 150 1, 0203 29 550 1, 0203 29 550 2, 0203 29 590 1, 0203 29 900 1 and 0203 29 900 2 (further - pork), the rolled meat of dunghill hens, fresh, cooled or refrigerated, the Eurasian Economic Union classified according to the single Commodity nomenclature of foreign economic activity by codes 0207 13 100 1 and 0207 14 100 1, the rolled meat of turkeys, the fresh, cooled or refrigerated, classified according to the single Commodity nomenclature of foreign economic activity Eurasian Economic Union codes 0207 26 100 1 and 0207 27 100 1 (further - fowl), based on the analysis of indicators of production by the legal entities and individual entrepreneurs registered at the place of residence registered in the location in the territory of areas and Minsk which is carried out by this Ministry (further - the registered legal entities and individual entrepreneurs) self-produced products, and also taking into account the production capacities and raw material resources which are available for them it is pro rata to specific weight of areas in production of these products and till December 30, 2016 to bring them to the attention of regional executive committees;

1.2. till January 10, 2017 to distribute 100 percent of the tariff quotas on import to the territory of the Republic of Belarus of pork and fowl between the registered legal entities and individual entrepreneurs who told till January 4, 2017 to regional executive committees the need for use of these tariff quotas for self-produced production received as a result of conversion (processing) of pork and (or) fowl in the territory of the Republic of Belarus according to the criterion established in paragraph four of part three of Item 6 of the Regulations on reference of products (works, services) to products (works, services) of the own production approved by the resolution of Council of Ministers of the Republic of Belarus of December 17, 2001 No. 1817 (The national register of legal acts of the Republic of Belarus, 2002, No. 1, 5/9613; 2011, No. 88, 5/34241), based on offers of the regional executive committees provided according to Item 2 of this resolution;

1.3. redistribute parts of the unused tariff quotas on import to the territory of the Republic of Belarus of pork and fowl determined according to subitem 1.1 of this Item, based on offers of regional executive committees taking into account statements of the registered legal entities and individual entrepreneurs;

1.4. distribute the tariff quotas on import to the territory of the Republic of Belarus of pork and fowl in case of decision making of Board of the Eurasian economic commission about their increase according to the procedure established in subitems 1.1 and 1.2 of this Item;

1.5. send in electronic form on agreed form to the Ministry of anti-monopoly regulation and trade and the State Customs Committee no later than the next day after distribution (redistribution) of the tariff quotas to import to the territory of the Republic of Belarus of pork and fowl information on distribution (redistribution) of these quotas between the registered legal entities and individual entrepreneurs with indication of the information about them, accounting numbers of payers, codes and names of goods according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union;

1.6. together with regional executive committees to perform the analysis of condition of the domestic market of meat products and deliveries in 2017 to the territory of the Republic of Belarus of pork and fowl and to inform the Ministry of Foreign Affairs on results of this analysis till July 28, 2017 and on January 28, 2018.

2. To provide to regional executive committees till January 5, 2017 to the Ministry of Agriculture and Food of the offer on distribution between the registered legal entities and individual entrepreneurs of the tariff quotas to import to the territory of the Republic of Belarus of pork and fowl it is pro rata to the actual amounts of self-produced production, received by them in previous year as a result of conversion (processing) of pork and (or) fowl, taking into account the production capacities and raw material resources, and also the information about the registered legal entities and individual entrepreneurs which are available for them with indication of accounting numbers of payers.

3. To the ministry of anti-monopoly regulation and trade:

3.1. perform issue of licenses for import of pork and fowl;

3.2. quarterly to the 10th following reporting to inform the Ministry of Agriculture and Food and the Ministry of Foreign Affairs on the licenses for import issued to the registered legal entities and individual entrepreneurs in 2017 of pork and fowl.

4. To the State Customs Committee:

4.1. provide in accordance with the established procedure release of pork and fowl, imported in 2017 on the territory of the Republic of Belarus within the tariff quotas on import to the territory of the Republic of Belarus of pork and fowl, according to customs procedure of release for internal consumption based on the licenses granted by the Ministry of anti-monopoly regulation and trade;

4.2. represent in electronic form on agreed form to the Ministry of Agriculture and Food and the Ministry of Foreign Affairs monthly no later than the 25th following for reporting this about release for internal consumption in 2017 of pork and fowl within the tariff quotas on import to the territory of the Republic of Belarus of pork and fowl and outside such quotas with indication of information on the registered legal entities and individual entrepreneurs and amounts of release of pork and fowl.
