In pursuance of regulations of the Customs convention on international delivery of loads using TIR cornet (The convention TIR, 1975) which the Republic of Moldova joined on November 26, 1993. (The resolution of Parliament of the Republic of Moldova N 1318-XII of March 2, 1993 - the Monitor of Parliament, 1993, N 3, of the Art. 62), the Government of the Republic of Moldova DECIDES:

1. Approve Regulations on procedure for application of the Customs convention on international delivery of loads using TIR cornet (the Convention TIR, 1975) (is attached).

2. To department of customs control to take necessary measures for functioning of this provision in the territory of the Republic of Moldova.

Regulations on procedure for application of the Customs convention on international delivery of loads using TIR cornet (The convention TIR, 1975)

I. General provisions

1. The convention TIR concerns the transportation of goods performed without their intermediate overload, road vehicles, structures of vehicles or containers through one or several borders, from customs of departure of one of Contracting Parties to customs of appointment of other Contracting Party provided that certain part of transaction of TIR between its beginning and the end is made by road transport.

2. The loads transported with observance of the TIR procedure are exempted from payment or the deposit of import or export duties and charges in intermediate customs. In this customs charges for customs clearance of cornets of TIR are not levied.

3. The loads transported with observance of the TIR procedure in the sealed-up road vehicles, the sealed-up structures of vehicles or in the sealed-up containers, as a rule, are not subject to customs examination in intermediate customs.

Customs examination in this customs can be made in exceptional cases if good reasons to believe are had that in the sealed-up departments of vehicles or in the sealed-up containers there are objects which are not specified in the manifesto of cornet of TIR.

Provisions of the Convention TIR do not interfere with application of the restrictions following from the point of view of public order and morals, health protection or hygiene, and also veterinary or phytosanitary control.

4. In this Provision the terms determined by the Convention TIR are used. In addition in this Provision the following terms are used:

customs of import - the intermediate customs of the Republic of Moldova located at the check point on border and through which loads are imported into the Republic of Moldova;

customs of export - the intermediate customs of the Republic of Moldova located at the check point on border through which loads are exported from the Republic of Moldova;

goods - the loads transported according to the Convention TIR.

II. Conditions of application of the TIR procedure

1. The TIR procedure is applied provided that goods:

are followed by the TIR cornet filled and which is drawn up according to the Convention TIR and this Provision;

are provided with guarantee of the guaranteeing consolidation;

are transported in road vehicles, structures of the vehicles or containers which are previously connected for transportation under customs seals and seals (except for transportations of heavy or bulky goods), and vehicles in case of stage under the own steam are considered as loads if they are specifically specified in the freight manifest of cornet of TIR.

2. On vehicles rectangular plates with text of "TIR" shall be attached. One is attached in front, and another - behind the road vehicle or structure of vehicles so that they were well visible. These plates shall be removable or established so that they could be turned, covered, put, etc. to show that this transportation has no relation to the TIR procedure.

3. Operation of TIR can be performed through several customs of the place of departure in one or several countries provided that total number of customs of the place of departure and customs of the destination shall not exceed four. In case of availability of several customs of the place of departure the cornet of TIR shall be filled so that the goods afterwards shipped at different customs were in addition brought in the freight manifest and that customs of the place of departure specified data on the new put-down seals in heading 16 and brought marks about confirmation of the loads shipped further.

4. Customs of import and customs of departure of the Republic of Moldova can establish delivery date of goods to the customs of appointment or customs of export which are in the territory of the Republic of Moldova and to determine traffic route of vehicles.
