According to article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the sphere of economic activity" the Cabinet of Ministers of Ukraine decides:
the resolution of the Cabinet of Ministers of Ukraine of January 6, 2010 "About approval of criteria by which the risk degree from implementation of economic activity in the sphere of metrology is estimated and is determined No. 9 frequency of holding planned actions of the state metrological supervision" (The Official Bulletin of Ukraine, 2010, Art. No. 1 27);
the resolution of the Cabinet of Ministers of Ukraine of January 29, 2014 No. 38 "About modification of appendix to the resolution of the Cabinet of Ministers of Ukraine of January 6, 2010 No. 9" (The Official Bulletin of Ukraine, 2014, No. 14, the Art. 428).
3. This resolution becomes effective along with the Law of Ukraine of June 5, 2014 No. 1314-VII "About metrology and metrological activities".

1. Criteria by which the risk degree from implementation of economic activity in the sphere of metrology and metrological activities is estimated and determine frequency of implementation of planned actions of metrological supervision of legislatively regulated means of the measuring equipment (further means of the measuring equipment) which are in operation, and behind quantity of the packed-up goods in packagings (further - metrological supervision), are:
type of activity in the sphere of legislatively regulated metrology;
type of metrological supervision;
quantity of the means of the measuring equipment which are in operation at subjects of managing;
availability of violations of requirements of the legislation in the sphere of metrology and metrological activities.
2. According to criteria and taking into account value of acceptable risk from implementation of economic activity subjects of managing treat one of three risk degrees: high, average and insignificant.
3. With high risk concern subjects which to subjects of managing:
1) is operated by more than 10 means of the measuring equipment when implementing the following types of activity:
ensuring protection of life and protection of public health;
control of quality and safety of foodstuff and medicines;
control of condition of the surrounding environment;
control of safety of working conditions;
2) is operated by more than 100 means of the measuring equipment when implementing the types of activity specified in the subitem 2 of item 4 of these criteria;
3) within the last two years previous planned, the allowed violations of requirements of the legislation in the sphere of metrology and metrological activities.
4. With average risk degree concern subjects which to subjects of managing:
1) are operated to 10 (inclusive) of means of the measuring equipment when implementing the types of activity specified in the subitem of 1 Item of 3 these criteria;
2) are operated from 10 to 100 (inclusive) of means of the measuring equipment when implementing the following types of activity:
control of traffic safety and technical condition of vehicles;
accomplishment of land, cartographical and hydrometeorological works, works on land management;
carrying out trade and commercial transactions and implementation of calculations between the buyer (consumer) and the seller (the supplier, the producer, the contractor), including by provision of transport, household, municipal, telecommunication services, services of mail service, delivery and/or consumption of energy and material resources (electrical and heat energy, gas, water, oil products, etc.);
3) perform packing of goods in packagings;
4) is operated by more than 100 means of the measuring equipment when implementing the types of activity specified in the subitem 2 Items of 5 these criteria;
5) within the last four years previous planned, the allowed violations of requirements of the legislation in the sphere of metrology and metrological activities.
5. With insignificant risk degree concern subjects which to subjects of managing:
1) are operated to nine (inclusive) means of the measuring equipment when implementing the types of activity specified in the subitem 2 of item 4 of these criteria;
2) is operated by means of the measuring equipment when implementing the following types of activity:
calculation of the amounts of taxes and fees, tax and customs control;
performance of works, the parameters of buildings, constructions connected with determination and the territory of building;
performance of works on ensuring technical information security according to the legislation;
performance of works at the request of bodies of preliminary inquiry, bodies and courts;
implementation of registration of national and international sports records;
performance of works with use of the equipment of global navigation satellite systems;
