About approval of the Regulations on procedure for acquisition and loss of nationality of the Republic of Moldova

In pursuance of the Law on nationality of the Republic of Moldova No. 1024-XIV of June 2, 2000. (The official monitor, 2000, Art. No. 98-101, 709) DECIDES: the Government of the Republic of Moldova

1. Approve the enclosed Regulations on procedure for acquisition and loss of nationality of the Republic of Moldova (appendices to it are given only in state language).

2. Confer responsibility for check of level of knowledge of provisions of the Constitution of the Republic of Moldova and state language, and also for issue of the certificates confirming examination by the persons who are wishing to receive or recover nationality of the Republic of Moldova and living legally and constantly in the territory of the republic, on the Ministry of Public Education, and persons, legally and constantly living abroad, - on the Ministry of Foreign Affairs and European Integration, diplomatic representations and consular establishments.

3. To the Ministry of Education together with Department of the national relations and functioning of languages to develop and submit to the Government for review regulations on procedure for determination of knowledge of provisions of the Constitution of the Republic of Moldova and ownership of state language in a month.

Regulations on procedure for acquisition and loss of nationality of the Republic of Moldova

1. This provision establishes procedure for execution of necessary documents for acquisition, recovery, refusal from or deprivations of nationality of the Republic of Moldova.

Issues of nationality of the Republic of Moldova are resolved based on the Constitution and the Law on nationality of the Republic of Moldova No. 1024-XIV of June 2, 2000. I. Procedure for filing of applications about acquisition of nationality or recovery in nationality of the Republic of Moldova

Person having the right to recognition by his citizen of the Republic of Moldova according to part provisions (2) article 12 of the Law on nationality of the Republic of Moldova, the statement represents to competent division of the Agency of the state services in the residence - the questionnaire (appendix No. 1) to which in each separate case the following documents are attached:

a) copy of the identity document, as necessary:

- the passport of the foreign citizen and the residence permit – for foreign citizens;

- the identity certificate for stateless persons, the identity certificate for refugees or the identity certificate for beneficiaries of humanitarian protection;

- the Soviet passport (sample of 1974) if its authenticity can be established;

- the document issued by competent authority for foreigners in the Republic of Moldova which identifies person and confirms its accommodation in the territory of the Republic of Moldova – for the applicant on provision of the status of the stateless person;

b) the certificate of lack of criminal record from the country (countries) which citizen is person, from the country in which the applicant lived legally, and also if he lived in the Republic of Moldova earlier, and from the Republic of Moldova;

c) receipt on payment of the state fee;

d) 4, 5 x 3,5 of cm two photos in size;

e) copies of documents: certificates about the births, including minor children, about scrap, about divorce, about change of surname and/or name;

f) the copy of the certificate of birth of one of parents or ancestors if the applicant was not born in the territory of the Republic of Moldova, but is descendant of person who was born in its territory;

g) the copy of the certificate of birth of one of parents or ancestors and the reference from the residence which confirms accommodation of the applicant or parents, or ancestors in the territory of Bessarabia, the North of Bukovina, the district Hertsa and MASSR till June 28, 1940 if the applicant has these reasons for receipt of nationality of the Republic of Moldova;

h) the reference from the residence which confirms accommodation of the applicant till June 23, 1990 in the territory of the Republic of Moldova and so far if the applicant has these reasons for receipt of nationality of the Republic of Moldova;

i) the reference issued by authorized body which confirms the fact of deportation or eviction of the applicant or parents or ancestors from the territory of the Republic of Moldova, since June 28, 1940 if the applicant has these reasons for receipt of nationality of the Republic of Moldova

2-1. In departure from subitem b provisions) Item 2 persons using international protection are exempted from need to provide the certificate of criminal record from country of source.

3. Statements and necessary documents go to the Agency of the state services for consideration and decision making. After their consideration the conclusion based on which the identity certificate of the citizen of the Republic of Moldova is issued to the applicant is constituted. The term of consideration of the application shall not exceed one month.

4. Applications can be submitted personally or through the attorney having the notarized power of attorney.
