About radiation safety

I. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations connected with ensuring radiation safety, protection of life, health and property of citizens, and also the environment from harmful effects of ionizing radiation.

Article 2. Basic concepts

In this Law the following basic concepts are applied:

ionizing radiation - the radiation created in case of radioactive decay, nuclear transformations, braking of charged particles in substance and which in case of interaction with environment forms ions of different signs;

source of ionizing radiation - the device and (or) radioactive material which is letting out or capable to emit ionizing radiation;

users of sources of ionizing radiation - the legal entities and physical persons extracting, making, developing, overworking, using, storing, servicing, transporting, neutralizing, utilizing and burying sources of ionizing radiation;

observation zone - the territory outside the sanitary protection zone on which radiation monitoring is carried out;

radiation accident - the loss of management of source of ionizing radiation caused by defect of the equipment, actions (failure to act) of workers (personnel), emergency situations of natural and technogenic nature which could give or led to radiation of citizens above of the established regulations or to radioactive environmental pollution;

radiation safety - condition of security of citizens and the environment from harmful effects of ionizing radiation;

radioactive waste - the substances in any aggregate state which are not intended for further use, containing radionuclides with the activity level exceeding the values established in acts of the legislation;

the sanitary protection zone - the territory around source of ionizing radiation in which the level of radiation of citizens in the conditions of normal operation of this source can exceed the set main limit of dose of radiation for the population;

natural radiation background - the radiation dose created by the space radiation and radiation of the natural radionuclides which are naturally distributed in the earth, water, air, other elements of the biosphere, foodstuff and human body;

tekhnogenno the changed radiation background - the natural radiation background changed as a result of activities of the person;

workers (personnel) - physical persons which constantly or temporarily work directly with sources of ionizing radiation or are under the terms of work in zone of their impact;

nuclear safety - complex action, providing safe handling of nuclear material.

Article 3. Legislation on radiation safety

The legislation on radiation safety consists of this Law and other acts of the legislation.

Article 4. Basic principles of ensuring radiation safety

The basic principles of ensuring radiation safety are:

the principle of regulation - not exceeding of admissible individual doses of radiation of citizens,

safe for their health, from all sources of ionizing radiation;

the principle of reasons - prohibition of all types of activity on use of sources of ionizing radiation in case of which the advantage received for the person and society does not exceed risk of the possible harm done by radiation, additional to natural radiation background;

the principle of minimization - maintenance within citizens of individual doses of radiation and number, safe for health, of the irradiated persons when using any source of ionizing radiation at perhaps lower level.

Article 5. The rights and obligations of citizens in the field of ensuring radiation safety

Citizens have the right on:

indemnification, caused to their life, health and property by radiation by sources of ionizing radiation, according to the legislation;

the complete and objective information about radiation state of environment, objects of use and consumption, the taken measures for ensuring radiation safety, and also about dose of the radiation received by them;

participation in discussion of questions of ensuring radiation safety.

Citizens shall:

observe requirements of the legislation on radiation safety;

fulfill requirements of public authorities on places, the state bodies performing regulation in the field of radiation safety.

Citizens can have other rights and perform other duties according to the legislation.

Article 6. Social protection of separate categories of citizens

The citizens living in the territories in which there is possibility of exceeding of the set main limits of doses of radiation have the right to social protection. The procedure for social protection is established by the Cabinet of Ministers of the Republic of Uzbekistan.

II. Regulation to the area of ensuring radiation safety

Article 7. State regulation in the field of ensuring radiation safety

State regulation in the field of ensuring radiation safety is performed by the Cabinet of Ministers of the Republic of Uzbekistan and state bodies authorized by it.

State regulation in the field of ensuring radiation safety includes:

state supervision and control of observance of requirements for radiation safety;

licensing of activities in the field of turnover of sources of ionizing radiation;

certification of agricultural, food products, forages, drinking and technical waters, construction materials and products from them on radiation pollution;

determination of radiation pollution in case of approval of withdrawal of the parcels of land under all types of construction.

Article 8. Control and coordination in the field of ensuring radiation safety

The state control in the field of ensuring radiation safety is exercised by the State committee of industrial safety of the Republic of Uzbekistan, the Ministry of Health of the Republic of Uzbekistan, the State committee of the Republic of Uzbekistan on ecology and environmental protection and the State Customs Committee of the Republic of Uzbekistan.

The state committee of industrial safety of the Republic of Uzbekistan coordinates activities of state control bodies in the field of ensuring radiation safety, except for coordination of activities of specially authorized state bodies in the field of the address with waste.

Production supervision in the field of ensuring radiation safety is exercised by users of sources of ionizing radiation, and also producers of raw materials, the construction materials and mineral fertilizers containing natural radioactive elements.

Public control in the field of ensuring radiation safety can be exercised by citizens of the Republic of Uzbekistan, self-government institutions of citizens, non-state non-profit organizations and mass media.

The procedure of control and coordination in the field of ensuring radiation safety is established by the legislation.
