About measures for providing social guarantees to separate categories of citizens of the Russian Federation

For the purpose of providing social guarantees to the citizens of the Russian Federation who were constantly living as of March 18, 2014 in the territory of the Republic of Crimea or in the territory of Sevastopol, appointed (appointed) to positions of Federal public civil service or dismissed from Federal public civil service, being guided by article 80 of the Constitution of the Russian Federation, I decide:

1. Determine that in case of determination of compliance of the citizens of the Russian Federation who were constantly living as of March 18, 2014 in the territory of the Republic of Crimea or in the territory of Sevastopol and applying for replacement of positions of Federal public civil service, to the qualification requirements to years of service of the public civil service established by regulatory legal acts of the Russian Federation in the specified years of service are set off:

a) the replacement periods from January 1, 1994 to March 17, 2014 the following positions replaced according to the legislation existing in the territories of the Republic of Crimea and Sevastopol till February 21, 2014:

positions of deputies which were replaced on permanent (regular) basis;

positions on which ranks of government employees were assigned;

positions of judges;

positions on which diplomatic ranks were assigned;

positions on which class ranks of prosecutors were appropriated;

positions on which the military and special ranks were given;

positions in local government bodies on which ranks were assigned;

b) the periods of replacement of the positions provided by the subitem "an" of this Item which were replaced during the period from March 18 to December 31, 2014 in the state bodies and local government bodies which were located in the territories of the Republic of Crimea and (or) Sevastopol.

2. Include in the list of the periods of public service and other periods of replacement of the positions included (set off) in years of service of the public civil service of the Russian Federation for establishment by the government civil servant of the Russian Federation of the monthly allowance to official pay rate for long service on the public civil service of the Russian Federation, determination of duration of annual additional paid leave for long service and the amount of encouragement for faultless and effective public civil service of the Russian Federation, No. 1532 approved by the Presidential decree of the Russian Federation of November 19, 2007 "About calculation of years of service of the public civil service of the Russian Federation for establishment by the government civil servant of the Russian Federation of the monthly allowance to official pay rate for long service on the public civil service of the Russian Federation determinations of duration of annual additional paid leave for long service and the amount of encouragement for faultless and effective public civil service of the Russian Federation" (The Russian Federation Code, 2007, No. 48, Art. 5949; 2011, No. 4, Art. 572; No. 21, Art. 2928), changes, having added with its Items 15.1 - 15.3 following of content:

"15.1. The periods of replacement with the citizens of the Russian Federation who were constantly living as of March 18, 2014 in the territory of the Republic of Crimea or in the territory of Sevastopol, positions of heads, specialists and also on permanent (regular) basis of elective offices in the state bodies and local government bodies formed according to the Constitution of the Ukrainian SSR and (or) the Constitution of the Republic of Crimea, from January 1, 1992 to December 31, 1993.

15.2. The periods of replacement with the citizens of the Russian Federation specified in Item 15.1 of this list, from January 1, 1994 to March 17, 2014 the following positions replaced according to the legislation existing in the territories of the Republic of Crimea and Sevastopol till February 21, 2014:

a) positions of deputies which were replaced on permanent (regular) basis;

b) positions on which ranks of government employees were appropriated;

c) positions of judges;

d) positions on which diplomatic ranks were appropriated;

e) positions on which class ranks of prosecutors were appropriated;

e) positions on which the military and special ranks were given;

g) positions in local government bodies on which ranks were appropriated.

15.3. The periods of replacement with the citizens of the Russian Federation specified in Item 15.1 of this list, from March 18 to December 31, 2014 positions, stipulated in Item 15 these lists in the state bodies and local government bodies which were located in the territories of the Republic of Crimea and (or) Sevastopol.".

3. Include in the list of positions, where the periods of service (work) are included in the years of service of the public civil service for award of pension for long service federal government civil servants approved by the Presidential decree of the Russian Federation of September 20, 2010 No. 1141 "About the list of positions, the periods of service (work) in which join in years of service of the public civil service for award of pension for long service of federal government civil servants" (The Russian Federation Code, 2010, No. 39, Art. 4926; 2011, No. 4, Art. 572; No. 21, Art. 2928), changes, having added with its Items 14.1 - 14.3 following of content:

"14.1. Positions of heads, specialists, and also the elective offices replaced on permanent (regular) basis, in the state bodies and local government bodies formed according to the Constitution of the Ukrainian SSR and (or) the Constitution of the Republic of Crimea, occupied during the period from January 1, 1992 to December 31, 1993 by the citizens of the Russian Federation who were constantly living as of March 18, 2014 in the territory of the Republic of Crimea or in the territory of Sevastopol.

14.2. The positions held according to the legislation existing in the territories of the Republic of Crimea and Sevastopol till February 21, 2014, the citizens of the Russian Federation specified in Item 14.1 of this list during the period from January 1, 1994 to March 17, 2014 including:

a) positions of deputies which were replaced on permanent (regular) basis;

b) positions on which ranks of government employees were appropriated;

c) positions of judges;

d) positions on which diplomatic ranks were appropriated;

e) positions on which class ranks of prosecutors were appropriated;

e) positions on which the military and special ranks were given;

g) positions in local government bodies on which ranks were appropriated.

14.3. Positions, the stipulated in Item 14.2 presents of the list taken by the citizens of the Russian Federation specified in Item 14.1 of this list during the period from March 18 to December 31, 2014 in the state bodies and local government bodies which were located in the territories of the Republic of Crimea and (or) Sevastopol.".
