About approval of regulations of the state services in the sphere of medical activities

According to the subitem 2) Articles 10, Item 2 of article 16 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", PRIKAZYVAYU:

1. Approve regulations of the state services:

1) "Issue of the certificate of the specialist for the admission to clinical practice" according to appendix 1 to this order;

2) "Issue of the certificate on assignment of qualification category to specialists with medical education" according to appendix 2 to this order;

3) "Accreditation of the medical organizations for the purpose of recognition of compliance of their activities to accreditation standards" according to appendix 3 to this order;

4) "Licensing for import to the territory of the Republic of Kazakhstan and (or) export from the territory of the Republic of Kazakhstan of bodies (part of bodies) and (or) tissues of the person, blood and its components" according to appendix 4 to this order;

5) "Issue of the conclusion (the allowing document) for import to the territory of the Republic of Kazakhstan and export from the territory of the Republic of Kazakhstan of haematopoietic stem cells, marrow in case of their movement for the purpose of performing unrelated transplantation, and also samples of cages, fabrics, biological liquids and secrets, including the waste products of the person, physiological and pathological allocations, dabs, scrapes, washouts intended for the diagnostic purposes or received in the course of carrying out biomedical researches" according to appendix 5 to this order;

6) Determination of compliance (discrepancy) of the potential supplier of services of the guaranteed amount of free medical care and/or compulsory social medical insurance to qualifying standards for inclusion in the database of the subjects of health care applying for rendering medical services within the guaranteed amount of free medical care and in system of compulsory social medical insurance" according to appendix 6 to this order;

7) "Issue of permission to performing clinical trials of medical technologies" according to appendix 7 to this order;

8) "The admission of foreign specialists to clinical practice, except for persons invited to implementation of professional medical activity in National holding in the field of health care and its affiliated organizations and also Nazarbaev Universitete or his medical organizations, the medical organizations of Administration of the President of the Republic of Kazakhstan" according to appendix 8 to this order;

9) "Accreditation of the subject of the health care performing assessment of professional readiness and confirmation of conformity of qualification of specialists in the field of health care" according to appendix 9 to this order.

2. To provide to committee of control of medical and pharmaceutical activities of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of regulatory legal acts of the Republic of Kazakhstan of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. Recognize invalid:

1) order of the deputy. Regulations of the state service "Issue of the Certificate of the Specialist for the Admission to Clinical Practice"

Chapter 1. General provisions

1. The state service "Issue of the Certificate of the Specialist for the Admission to Clinical Practice" (further - the state service) appears territorial subdivisions of Committee of protection of public health of the Ministry of Health of the Republic of Kazakhstan (further - the service provider), according to the Standard of the state service "Issue of the Certificate of the Specialist for the Admission to Clinical Practice" approved by the order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 No. 294 (it is registered in the Register of state registration of regulatory legal acts at No. 11356) (further - the Standard).

Documents acceptance and issue of result of rendering the state service are performed through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the portal).

Chapter 2. The description of operations procedure of structural divisions (workers) of the service provider in the course of rendering the state service

4. The basis for the procedure (action) for rendering the state service is receipt of uslugopoluchatel by the service provider of the statement, with application of documents, stipulated in Item 9 Standards.

5. Contents of each procedure (action) which is part of process of rendering the state service, duration of its accomplishment:

1) the employee of office of the service provider carries out document registration of uslugopoluchatel and submits management. The management imposes the resolution to the head of department, completion date - 1 (one) working day;

2) the executive in charge checks the submitted documents for completeness. In case of incomplete document package, draws up the motivated answer about refusal in rendering the state service and brings to the head of department for review, completion date - 1 (one) working day;

The executive in charge in case of complete document package considers 3) on compliance to requirements, stipulated in Item 9 Standards. In case of detection of discrepancy, draws up the motivated answer about refusal in issue of the certificate and brings to the head of department for review, completion date - 2 (two) working days;

4) the executive in charge in case of compliance/discrepancy of the submitted documents brings result of rendering the state service on the portal and directs to signing to the head of department and management of the service provider. The management signs result of rendering the state service, completion date - 1 (one) working day.

2) resolution of management of the service provider to the head of department of the service provider;

3) resolution of the head of department to the executive in charge;

4) determination of completeness and compliance of the submitted documents, in case of discrepancy the direction of the motivated answer about refusal of consideration of the application;

5) registration of result of rendering the state service;

6) introduction of result of rendering the state service to the head;

7) signing of result of rendering the state service.

Chapter 3. The description of order of interaction of structural divisions (workers) of the service provider in the course of rendering the state service

7. The list of workers of the service provider who participate in process of rendering the state service:

1) employee of office of the service provider;

2) head of the service provider;

3) head of department;

4) executive in charge.

8. The description of the sequence of procedures (actions) between structural divisions (workers) with indication of duration of each procedure (action):

1) registration of a statement on rendering the state service and determination of the contractor, completion date - 1 (one) working day;

2) check of completeness and compliance of the submitted documents, in case of discrepancy the direction of the motivated answer about refusal of consideration of the application, completion date - 2 (two) working days;

3) execution of the certificate or motivated answer, completion date - 1 (one) working day;
