ORDER OF THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN

of November 2, 2005 No. 1092

About some measures for implementation of the Law of the Republic of Kazakhstan "About public welfare payments to the families having children"

(as amended on 04-04-2014)

For the purpose of implementation of the Law of the Republic of Kazakhstan of June 28, 2005 "About public welfare payments to the families having children" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) Rules of appointment and payment of public welfare payments to the families having children;

2) Rules of calculation of comprehensive income of the family applying for receipt of child allowance;

3) the application form for purpose of benefit for the birth and (or) child care allowances before achievement of age by it one year;

4) the application form for purpose of child allowance up to eighteen years;

5) the application form for purpose of benefit bringing up the handicapped child.

2. To akims of areas, cities of Astana and Almaty:

1) in accordance with the established procedure to determine body, authorized to certify data on the size of personal subsidiary farm;

1-1) to provide free representation of application blanks to applicants for purpose of child allowance up to eighteen years which form is approved by this resolution, and also the data according to appendices 1, of 2, 3 to Rules of appointment and payment of public welfare payments to the families having children;

2) to bring earlier made decisions on precinct election commissions into accord with this resolution.

3. Recognize invalid:

1) the order of the Government of the Republic of Kazakhstan of February 25, 2003 No. 200 "About approval of Rules of payment of lump-sum public welfare payment in connection with the child's birth" (SAPP of the Republic of Kazakhstan, 2003, No. 9, the Art. 100);

2) the order of the Government of the Republic of Kazakhstan of December 2, 2003 No. 1225 "About modification and amendments in the order of the Government of the Republic of Kazakhstan of February 25, 2003 No. 200" (SAPP of the Republic of Kazakhstan, 2003, No. 46, the Art. 503).

4. This resolution becomes effective since January 1, 2006, except for the subitem 5) of Item 2, of Items 11, of 17, of 18 Rules of appointment and payment of public welfare payments to the families having children who are entered since July 1, 2006.

Rules of appointment and payment of public welfare payments to the families having children

These rules of appointment and payment of public welfare payments to the families having children (further - Rules), are developed according to the Law of the Republic of Kazakhstan of June 28, 2005 "About public welfare payments to the families having children" and determine procedure for appointment and payment of public welfare payments to the families having children.

1. General provisions

1. In these rules the following basic concepts are used:

1) public welfare payments to the families having children - money payments in type:

the lump-sum public welfare payment granted and paid in connection with the child's birth (further - benefit for the birth);

the monthly public welfare payment granted and paid on child care of age of one year on reaching it (further - attendance allowance);

the monthly public welfare payment granted and paid on children up to eighteen years (further - child allowance);

the monthly public welfare payment granted and paid to mother or the father, the adoptive father (adopter), the guardian (custodian) who is bringing up the handicapped child (handicapped children) (further - benefit bringing up the handicapped child);

2) authorized body to destination benefits for the birth, on leaving and bringing up the handicapped child (further - authorized body) territorial subdivisions of authorized state body;

3) authorized body to destination and allowance payment on children - local executive body of the city of republican value, the capital, area (city of regional value);

4) family - the group of people, the connected property and personal non-property rights and obligations following from scrap (matrimony), relationship, property, adoption (adoption) or other form of acceptance of children on education and designed to promote strengthening and development of the family relations;

5) comprehensive income of family - the total amount of income gained by family both in cash, and in natural form;

6) the average per capita income of family - the share of comprehensive income of family falling on each family member in month;

7) the applicant - person addressing on behalf of family for purpose of benefits;

8) the precinct election commission - the special commission created by the decision of akims of the corresponding administrative and territorial units for carrying out inspection of financial position of the families which addressed for receipt of the public assistance, and preparation of the conclusions;

9) authorized organization (further - the Center) - the republican state state company created according to the decision of the Government of the Republic of Kazakhstan;

10) authorized organization for issue of benefits - the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company;

11) branch of the Center - regional, the cities of Astana and Almaty branches of authorized organization;

12) department of the Center - city, district departments of authorized organization;

13) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

14) information system - the system intended for storage, processing, search, distribution, transfer and provision of information using the hardware and software;

15) the electronic document - the document in which information is provided in electronic and digital form and is certified by means of the digital signature;

16) the electronic statement - the statement, in electronic form, certified by the digital signature;

17) the electronic request - the data necessary for purpose of benefit for the birth, attendance allowances, benefits bringing up the handicapped child and the child allowance in electronic form certified by the digital signature of Service center of the population;

18) the first Section - the benefit amount which is not included in current demand of month of payment in connection with appointment, renewal, change and review of the size of benefit and with change of the residence of the applicant after forming of current demand;

19) the receiver of benefit for the birth, attendance allowances and (or) benefits bringing up the handicapped child (further - the receiver) - the applicant who is granted allowances for the birth, attendance allowances and (or) benefits bringing up the handicapped child;

20) the doubtful document (counterfeit) - the document made on samples of authentic documents, containing the false (false) information.

2. Procedure for the address, appointment and allowance payment to the birth, child care allowances

2. Persons having the right to their obtaining address for purpose of benefit for the birth, attendance allowances (further - benefits) in department of the Center or Service center of the population at the place of residence.

The attendance allowance is granted to persons who do not have the right to social payment to case of loss of the income in connection with child care of age of one year on reaching it from the State Social Insurance Fund.

Persons have the right to address for purpose of benefits through the web portal of "the electronic government".

3. Circulation periods behind purpose of benefits cannot exceed twelve months since the birth of the child.

4. The attendance allowance is granted since birth before achievement of one year by the child of age.

In family composition the children born, adopted (adopted), and also taken under guardianship (guardianship) are considered, except for children concerning whom parents are deprived of the parent rights or are limited in the parent rights, also in family composition summary children are considered if they are not considered in family of other parent.

The attendance allowance is granted to oralmans since the birth of the child, but not earlier than date of establishment of the status of the oralman.

5. Allowances are granted irrespective of the income of family of the child.

6. In case of the request of the applicant for purpose of benefits the specialist of department of the Center or Service center of the population performs request in information system of the Center for availability at the applicant of the fact of appointment, payment or filing of application on purpose of benefits.

In case of receipt of information from the Center, the confirmatory fact of appointment, payment or filing of application to benefits, department of the Center or Service center of the population notifies the applicant on refusal in reception of an application in form according to appendix 1 to these rules.

The notification is signed the EDS of the specialist of department of the Center or Service center of the population.

7. For purpose of benefits to the statement, the following documents of person having the right to purpose of benefit in the presence of individual identification number (further - IIN) on themselves are attached:

1) the identity document of the applicant (the identity certificate of the citizen of the Republic of Kazakhstan, the residence permit of the foreigner who is constantly living in the Republic of Kazakhstan) for review,

and also for oralmans - the certificate of the oralman;

2) the certificate (certificates) on the birth of child(children) or the statement from the birth record;

3) the certificate on the conclusion (termination) of scrap, in case of discrepancy of data of the applicant with data in the certificate of birth of the child;

4) the document confirming establishment of guardianship (guardianship) over the child or adoptions (adoption).

For the purpose of benefits submission of documents confirming the residence, data on bank account number in authorized organization for issue of benefits, the certificate of birth of child(children) or the statement from the birth record on the registration made in the territory of the Republic of Kazakhstan after August 13, 2007, the certificate on the conclusion (termination) of scrap on the registration made in the territory of the Republic of Kazakhstan after June 1, 2008, and also the document specified in the subitem 4) of this Item are not required in the presence of possibility of receipt of information, containing in them, from the state information systems according to appendix 2 to these rules.

The documents submitted in originals are scanned and electronic copies of documents make sure the EDS of the specialist of department of the Center or Service center of the population then return to the applicant.

8. Filing of application and necessary documents by the third parties for purpose of benefits is performed under notarially certified power of attorney of person having the right to the corresponding benefit.

Notarially certified power of attorney is scanned, makes sure the EDS of the specialist of department of the Center or Service center of the population then returns to the applicant.

9. After submission of the relevant documents by the applicant for purpose of benefits at its presence the specialist of department of the Center or Service center of the population creates request in information systems of state bodies and (or) organizations according to appendix 2 to these rules.

In case of representation by state bodies and (or) organizations of the electronic documents confirming required data, the department of the Center which performed request or Service center of the population issues to the applicant the detachable coupon with mark about adoption of documents.

In case of representation by state bodies and (or) organizations of the electronic documents confirming lack of required information about the applicant or discrepancies of data in information systems with the data provided by the applicant, the department of the Center which performed request or Service center of the population notifies the applicant on need of submission of originals of documents and the statement for consent for reduction in compliance of information about him in information systems of state bodies and (or) organizations.

10. In case of submission by the applicant of the original of documents and statements for consent the specialist of department of the Center or Service center of the population scans originals of documents, certifies their EDS and sends to state bodies and (or the organizations) for reduction in compliance of information about the physical person according to the procedure and the terms determined by the Government of the Republic of Kazakhstan.

If the applicant according to the procedure and the terms determined by the Government of the Republic of Kazakhstan did not submit the originals of documents specified in the notification, the department of the Center or Service center of the population notifies the applicant on refusal in reception of an application on purpose of benefits (with indication of the reason) in form according to appendix 1 to these rules.

11. The department of the Center or Service center of the population checks completeness of document package, the state bodies and (or) the organizations accepted at the applicant for purpose of the corresponding benefit, and also received from information systems, provides quality and compliance of electronic copies of documents to the originals provided by the applicant according to Item 7 of these rules.

12. The department of the Center in case of representation by the applicant of complete document package, registers the statement for purpose of the corresponding benefit in the magazine, in form according to appendix 3 to these rules.

13. The service center of the population within three working days from the date of adoption of the statement on purpose of benefit sends the electronic request, with the document package including electronic copies of the application of the documents submitted by the applicant in the original and also the data received from information systems of state bodies and (or) the organizations to department of the Center. The electronic request makes sure the EDS of the specialist of Service center of the population.

14. Within two working days from the date of receipt of the electronic request from Service center of the population the department of the Center checks the arrived document package. In case of identification of receipt of the incomplete list of documents, sends to Service center of the population the notification with indication of the missing document in form according to appendix 4 to these rules, and returns document package without consideration of the electronic request. The notification makes sure the EDS of the specialist of department of the Center.

The service center of the population within three working days from the date of receipt of the notification from department of the Center eliminates the revealed error and sends the electronic request to department of the Center with attachment of the documents including electronic copies of the application, the documents and data provided by the applicant in the original and also the electronic documents and data received from information systems of state bodies and (or) the organizations.

15. In case of the request of the applicant for purpose of benefits by means of the web portal of "the electronic government" the request in information systems of state bodies and (or) organizations for confirmation of the provided data and receipt of the necessary data provided in the application form according to appendix 5 to these rules is performed by the applicant.

16. In case of representation by state bodies and (or) organizations of the electronic documents confirming required data, the applicant who performed request by means of the web portal of "the electronic government" certifies the electronic statement of the EDS and sends to the automated information system of the Center.

17. The electronic application which arrived by means of the web portal of "the electronic government" submitted for purpose of benefits undergoes testing in the following parameters:

1) completeness of the provided data;

2) lack of the fact of appointment, payment, and also filing of application to purpose of benefits;

3) on achievement of the child concerning which the allowance, age of one year is granted;

4) compliance of address data of family members with data of the applicant.

In case of positive result of check on above to the specified parameters there is placement of the statement to magazine of the incoming messages intended for processing.

18. In case of acceptance of the Center by department of the electronic application directed by means of the web portal of "the electronic government", to the applicant the notification on adoption of the electronic statement according to appendix 6 to these rules goes. The notification makes sure the EDS of the specialist of department of the Center.

19. The department of the Center in day of registration of a statement assigns number to case in the magazine on form according to appendix 7 to these rules, and creates the electronic prototype of case of the applicant including:

electronic copies of the application and the documents submitted by the applicant in the original and also the data received from information systems of state bodies and (or) the organizations or

electronic copies of the application, the documents and data provided by the applicant in the original and sent to information system of state bodies and (or) organizations for reduction in compliance of information about the physical person according to the procedure and the terms determined by the Government of the Republic of Kazakhstan.

The electronic prototype of case for benefits is created within two working days from the date of registration of a statement in department of the Center and makes sure by means of the EDS.

The specialist of department of the Center creates the draft decision in forms according to appendix 8 to these rules, makes calculation of the size of benefits and certifies their EDS.

The draft decision represents the document in electronic and digital form of purpose (change, refusal in appointment) of benefit (further - the draft decision).

The head of department of the Center checks correctness of calculation of the size of benefits, execution of the draft decision, certifies its EDS then the electronic prototype of case is transferred by department of the Center to branch of the Center.

20. The branch of the Center within two working days from the date of receipt considers electronic prototype of case and the draft decision, checks correctness of calculation and execution of the draft decision then sends to authorized body. At the same time the draft decision makes sure the EDS of the specialist and the head of branch of the Center.

21. The authorized body considers the arrived electronic prototype of case with the draft decision, makes the decision on purpose (change, refusal in appointment) of benefits within three working days.

22. The decision represents the document in electronic and digital form of appointment (change, refusal in appointment) benefits certified by means of the EDS of the specialist, the chief of the department (department) and the head of authorized body (further - the decision). Number and date are appropriated to the decision in the automatic mode.

In the automatic mode within one working day from the date of decision making the notification on purpose of benefits in form according to appendix 9 to these rules goes to department of the Center or to Service center of the population or to private office of the applicant by means of the web portal of "the electronic government". The notification makes sure the EDS of the head of authorized body.

23. The specialist of authorized body registers the decision in the magazine of registration of decisions on purpose of benefits in form according to appendix 10 to these rules.

The authorized body sends electronic prototype of case with the decision to department of the Center.

24. If the authorized body in the provided electronic prototype of case reveals lack of the document (documents) necessary for decision making, the electronic prototype of case with the draft decision returns to department of the Center. The notification on need of dooformleniye of the document (documents) with indication of the reason in form according to appendix 11 to these rules goes to department of the Center or to Service center of the population which makes sure the EDS of authorized body.

The department of the Center and (or) Service center of the population within five working days notifies the applicant on need of representation within twenty five working days of the additional documents specified in the notification in form according to appendix 11 to these rules.

The department of the Center by provision by the applicant and (or) Service center of the population of additional documents prepares electronic prototype of case according to the procedure, provided by Items 19, of 20 these rules.

If within thirty working days from the date of receipt of electronic prototype of case in department of the Center documents are not completed, the authorized body passes the electronic decision on purpose of the corresponding benefit according to the available documents or on refusal in appointment.

If the authorized body in the provided electronic prototype of case and (or) in the draft decision reveals mistake, the electronic prototype of case with the draft decision with indication of return reason returns by means of electronic communication to department of the Center for elimination of mistakes.

25. The department of the Center from the date of receipt of the returned electronic prototype of case within five working days eliminates the revealed error, renews electronic prototype of case according to the procedure, provided by Items 19, of 20 these rules.

26. In case of decision making about refusal in purpose of benefit the authorized body specifies the refusal basis in the decision.
