RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

of December 14, 2016 No. 978

Some questions of social protection of handicapped children and persons with disability

(as amended of the Resolution of the Cabinet of Ministers of Ukraine of 06.03.2019 No. 176)

Cabinet of Ministers of Ukraine decides:

1. Approve Standard regulations on the children's house boarding school which are applied.

2. Item 12 of the Regulations on the individual program of rehabilitation of the disabled person approved by the resolution of the Cabinet of Ministers of Ukraine of May 23, 2007 No. 757 (The Official Bulletin of Ukraine, 2007, No. 39, the Art. 1547), after the words "specialists of rehabilitation" to add with the words "and residential".

3. Recommend to local government bodies to be guided under the organization of activities of children's houses boarding schools by the Standard provision approved by this resolution.

4. To the ministries, other central executive bodies to bring in two-month time own regulatory legal acts into accord with this resolution.

5. This resolution becomes effective since April 1, 2017.

Standard regulations on the children's house boarding school

General questions

1. This Standard provision determines bases of functioning of children's houses boarding schools.

In this Standard provision the term "children's house boarding school" is understood as the stationary social medical institution intended for temporary (up to six months) or permanent (more than six months) stay or accommodation of children with disability aged from 4 up to 18 years (further - pupils) and persons with disability aged to 35 years (further - wards) with violations of physical, intellectual development and mental disturbances which for health reasons need foreign leaving, consumer services, medical care, educational services, complex of rehabilitation actions and according to the medical certificate have no contraindications for stay in the specified organization, irrespective of availability of persons obliged to contain them under the law.

2. The children's house boarding school (further - the house boarding school) will be formed, will be reorganized and liquidated according to the solution of local executive body or local government body (further - the founder).

3. In the activities the house boarding school is guided by the Constitution and the laws of Ukraine, the Convention on the rights of persons with disability, the Convention on the Rights of the Child, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, Minsotspolitiki's orders and other central executive bodies, other regulatory legal acts, and also the Regulations on the children's house boarding school developed in connection therewith by the Standard provision.

4. On the basis of this Standard provision of the house boarding schools develop the provisions which affirm founders in coordination with executive body concerning social protection of the population of the Autonomous Republic of Crimea, structural divisions concerning social protection of the population of the regional, Kiev and Sevastopol city state administrations (further structural divisions concerning social protection of the population) and after carrying out consultations with the public according to the legislation.

5. Houses boarding schools share on:

houses boarding schools (department) of the I profile (mixed on floor) for pupils with the easy intellectual backwardness and/or frustration of mentality which are followed by permanent physical violations of the musculoskeletal device for which independent movement is considerably complicated or it is impossible;

houses boarding schools (department) of the II profile (divided on floor) for the pupils with moderate intellectual backwardness and/or heavy frustration of mentality needing leaving, training and rehabilitation who can independently move and serve themselves;

and partially itself serve houses boarding schools (department) of III profile (divided on floor) for the pupils with heavy and deep intellectual backwardness and/or permanent frustration of mentality needing leaving, training and rehabilitation who can independently move;

houses boarding schools (department) of the IV profile (mixed on floor) for pupils with heavy and deep intellectual backwardness and/or steady chronic frustration of mentality which need palliative care, training and rehabilitation and for which independent movement is considerably complicated or it is impossible.

The founder can form the complex house boarding school with combination of two and more profiles specified in this Item.

6. In the house boarding school can be effective according to the standard provisions approved by Minsotspolitiki, the following departments:

youth department for wards;

departments (group) of day care;

departments (group) of five-day stationary leaving;

departments (group) of transit stay;

departments (group) of the supported accommodation;

departments (group) of palliative care.

Tasks and main activities of the house boarding school

7. The main objectives of the house boarding school are:

1) providing rights and interests, day employment, conditions for accommodation, social servicing, attraction to activity of territorial community, rehabilitation and delivery of health care by pupils/ward;

2) provision of such social services as stationary leaving, social resettlement, representation of interests, social psychological recovery, and also in case of need day care, palliative care, the supported accommodation, consultation, social prevention, crisis and emergency intervention;

3) carrying out complex of rehabilitation actions according to the individual plan of rehabilitation, and also planned preventive, sanitary and anti-epidemic and improving actions.

The individual plan of rehabilitation of the pupil/ward in the house boarding school is constituted in the form approved by Minsotspolitiki.

8. Pupils/wards of the house boarding school according to the established regulations are provided:

in living space with all household conveniences;

clothes, footwear, bed linen, soft and firm stock, personal hygiene means and tableware;

rational, at least quadruple food, including dietary, taking into account age and the state of health of pupils/wards within natural regulations of food. Periods between meals shall not exceed four hours, the last meal will be organized in 2 hours prior to dream.
