About approval of Rules of provision of subsidies to the organizations of light industry on compensation of part of maintenance costs of the loans attracted in 2015 - 2019 on the projects implementation purpose on production growth in volumes, and recognition voided some acts of the Government of the Russian Federation
The government of the Russian Federation decides:
1. Approve the enclosed Rules of provision of subsidies to the organizations of light industry on compensation of part of maintenance costs of the loans attracted in 2015 - 2019 on the projects implementation purpose on production growth in volumes.
2. Recognize to invalid:
the order of the Government of the Russian Federation of August 27, 2015 No. 894 "About approval of Rules of subsidizing the organizations of light industry from the federal budget on compensation of part of maintenance costs of the loans obtained in the Russian credit institutions in 2012 - 2016 on the purposes of forming of the interseasonal reserves necessary for production of light industrial goods, within the subprogramme "Light industry and national art crafts" of the state program of the Russian Federation "Development of the industry and increase in its competitiveness" (The Russian Federation Code, 2015, No. 36, Art. 5035);
item 319 in the changes which are made to acts of the Government of the Russian Federation in connection with abolition of Federal Service for Financial and Budgetary Supervision, approved by the order of the Government of the Russian Federation of May 25, 2016 No. 464 "About introduction of amendments to some acts of the Government of the Russian Federation in connection with abolition of Federal Service for Financial and Budgetary Supervision" (The Russian Federation Code, 2016, No. 24, Art. 3525).

Rules of provision of subsidies to the organizations of light industry on compensation of part of maintenance costs of the loans attracted in 2015 - 2018 on the projects implementation purpose on production growth in volumes
1. These rules establish procedure, the purposes and conditions of provision of subsidies from the federal budget to the organizations of light industry (further - the organizations) on compensation of part of maintenance costs of the loans attracted in 2015 - 2018 on the projects implementation purpose on production growth in volumes (further - subsidies).
2. Subsidies are provided for the purpose of compensation of part of actually made and documentary confirmed costs incured by the organizations on interest payment on the credits obtained in the Russian credit institutions on the projects implementation purpose on growth in volumes of production of light industry (further - projects).
3. The subsidy is provided to the organizations which correspond on the first, preceding month in which the conclusion of the agreement on provision of subsidy, to the following requirements is planned:
a) the organization is not foreign legal entity, and also the Russian legal entity in whose authorized (share) capital share of participation of foreign legal entities whose place of registration is the state or the territory included in the list of the states and the territories which are providing preferential tax regime of the taxation and (or) not providing disclosure and provision of information approved by the Ministry of Finance of the Russian Federation when carrying out financial transactions (offshore zones) concerning such legal entities in total exceeds 50 percent;
b) the organization performs activities for production of light industry goods;
c) the organization has no unexecuted obligation on tax payment, charges, the insurance premiums, penalty fee, penalties, percent which are subject to payment in accordance with the legislation of the Russian Federation about taxes and fees;
d) the organization performs or plans to perform the project;
e) the income of the organization from realization of products of light industry made by it specified in the reference provided according to the subitem "v" of Item 7 of these rules constitutes at least 50 percent of all income of the organization specified in the declaration on the income tax which copy is submitted according to the subitem "d" of Item 7 of these rules;
e) the organization has no overdue debt on return to the federal budget of the subsidies, budget investments provided including according to other legal acts, and other arrears to the federal budget;
g) the organization is not in process of reorganization, liquidation, bankruptcy;
h) the organization does not receive means from the federal budget according to other regulatory legal acts on financial provision and (or) cost recovery on project implementation;
i) the state information system of the industry contains the information on the organization provided and provided according to the procedure, No. 1604 established by the order of the Government of the Russian Federation of December 21, 2017 "About provision by subjects of activities in the field of the industry, public authorities and local government bodies of information for inclusion in the state information system of the industry and placement of information of the state information system of the industry in open access on the Internet.
4. Subsidies are provided to the organizations which underwent competitive selection on compliance to the requirements established by Items 3, of 7 and 8 these rules.
5. Competition is held no more than 2 times a year, selection of the organizations on receipt of subsidy is made by the commission formed by the Ministry of Industry and Trade of the Russian Federation.
The Ministry of Industry and Trade of the Russian Federation makes the decision on carrying out competitive selection of the organizations on the right of receipt of subsidy within the budgetary appropriations provided by the Federal Law on the federal budget for the corresponding financial year and planning period and limits of the budget obligations finished in accordance with the established procedure to the Ministry of Industry and Trade of the Russian Federation as to the receiver of means of the federal budget, taking into account limits of the budget obligations necessary for completion of rendering the state support of projects according to the contracts for provision of subsidy signed earlier.
6. For the purpose of carrying out competitive selection the Ministry of Industry and Trade of the Russian Federation:
a) approves the list of the priority directions of light industry within which selection of projects will be performed;
b) makes the decision on carrying out competitive selection and posts on the official site the Ministries on the Internet the notice on carrying out competitive selection with indication of terms of carrying out selection and the tender documentation including:
requirements to execution of the application for participation in competitive selection;
procedure, place, start and end dates of submission due date of envelopes with applications for participation in competitive selection;
procedure for modification of the tender documentation;
place, procedure, date and time of opening of envelopes with applications for participation in selection;
technique of conducting examination of requests and selection of winners of competitive selection;
procedure for the conclusion of the agreement;
c) forms the commission on carrying out competitive selection of projects and approves regulations on it;
d) registers the applications for participation in competitive selection arriving in the Ministry with the enclosed documents in the special magazine No. 1, which shall be strung together, numbered and under seal the Ministries.
7. For participation in competitive selection the organization represents to the Ministry of Industry and Trade of the Russian Federation the application for participation in selection which is drawn up according to requirements of the tender documentation with appendix of the following documents (further - the request):
a) the extract from the Unified State Register of Legal Entities certified in accordance with the established procedure (in case of non-presentation of such document Ministry by the organization requests it independently);
b) the summary of the project with indication of the project implementation purpose (measurable project deliverable), the size of required subsidy, sales amount of light industrial goods for the current and previous financial years in cost and quantitative expressions and amount of financial provision of project implementation;
c) the certificate of organization activity and of the industrial output which is turned out by the organization current and previous financial years, in form according to appendix No. 2, signed by the head of the organization and under seal the organizations (in the presence);
d) copies of forms of federal statistical observation of P-1 "Data on production and shipment of goods and services" in the year preceding year of receipt of subsidies certified by the head and the chief accountant of the organization (in the presence) and the organizations under seal (in the presence);
e) the copy of the declaration on the income tax provided to tax authority in the year preceding year of receipt of subsidies;
e) the copy of the credit agreement with the repayment schedule of the credit and interest payment on it certified by the relevant credit institution;
g) the reference of tax authority confirming absence at the organization of unexecuted obligation for tax payment, charges, the insurance premiums, penalty fee, penalties, percent which are subject to payment in the federal budget in accordance with the legislation of the Russian Federation about taxes and fees, certified in accordance with the established procedure (in case of non-presentation of such document Ministry by the organization requests it independently);
h) the certificate of absence at the organization of overdue debt for return to the federal budget of subsidies, budget investments provided including according to other legal acts, and other arrears to the federal budget, signed by the head and the chief accountant of the organization (in the presence), under seal the organizations (in the presence);
i) ceased to be valid according to the Order of the Government of the Russian Federation of 23.08.2017 No. 995
j) the reference signed by the head and the chief accountant of the organization (in the presence) under seal the organizations (in the presence), confirmatory that the organization did not receive according to other regulatory legal acts of funds from the federal budget for financial provision and (or) cost recovery on project implementation;
k) the certificate that the organization is not foreign legal entity, and also the Russian legal entity in whose authorized (share) capital share of participation of foreign legal entities whose place of registration is the state or the territory included in the list of the states and the territories which are providing preferential tax regime of the taxation and (or) not providing disclosure and provision of information approved by the Ministry of Finance of the Russian Federation when carrying out financial transactions (offshore zones) concerning such legal entities in total exceeds 50 percent, signed by the head and the chief accountant of the organization (in the presence), under seal the organizations (in the presence);
l) the reference signed by the head of the organization (other authorized person) confirmatory that the organization fulfills requirements, stipulated in Item 5 Rules of provision by subjects of activities in the field of the industry, public authorities and local government bodies of information for inclusion in the state information system of the industry approved by the order of the Government of the Russian Federation of December 21, 2017 No. 1604 "About provision by subjects of activities in the field of the industry, public authorities and local government bodies of information for inclusion in the state information system of the industry and placement of information of the state information system of the industry in open access on the Internet.
8. The Ministry of Industry and Trade of the Russian Federation carries out expertize of requests and the enclosed documents for compliance to the requirements established by Items 3 and 7 of these rules and also to the following requirements:
a) the project shall provide growth of sales amounts of light industrial goods in the amount of at least 107 percent in relation to indicator of the year preceding year of receipt of subsidy in value term;
b) the project shall provide annual production of light industrial goods in the amount of, twice at least exceeding the size of required subsidy.
9. By results of examination of applications for participation in selection and the enclosed documents the Ministry of Industry and Trade of the Russian Federation makes the decision on compliance (discrepancy) of the organization to the requirements specified in Items 3, of 7 and 8 these rules, constitutes the rating of requests according to technique of conducting examination of requests and selection of winners of competitive selection and determines winners of tender.
Selection criteria are extent of growth of sales amounts of light industrial goods and ratio of annual production of light industrial goods and the size of required subsidy.
The Ministry of Industry and Trade of the Russian Federation posts the decision on the official site on the Internet within 2 days from the date of adoption of the specified decision.
10. The Ministry of Industry and Trade of the Russian Federation concludes with the organizations which underwent competitive selection, agreements on provision of subsidy for project deadline in the standard form approved by the Ministry of Finance of the Russian Federation (further - the agreement). The agreement contains including the consent of the organization to carrying out by the Ministry of Industry and Trade of the Russian Federation and bodies of the state financial control of obligatory checks of observance by the organization of procedure, the purposes and conditions of provision of subsidy which are provided by these rules.
11. Change of project deadline, and also modification of indicators (indicators) of effectiveness of project implementation specified in the agreement are allowed in the following cases:
a) introduction of trade and economic sanctions concerning the Russian legal and (or) physical persons exerting impact on project implementation;
b) change of the currency rates more than on 15 percent points within at least than 6 months preceding the address;
c) raw materials change in value in the world goods markets more than on 15 percent points within at least than 6 months preceding the address;
d) change of rates of natural monopolies for the indicator exceeding value of the rate of inflation, plus 1 percent point;
e) introduction by the Government of the Russian Federation of other measures limiting purchase of raw materials and the component parts which entailed change of project deadline, and also change of indicators (indicators) of effectiveness of project implementation specified in the agreement.
12. The organization has the right to address to the Ministry of Industry and Trade of the Russian Federation with the reasoned statement about introduction of amendments to the agreement no more once a year. The documents provided by subparagraphs "b" - "g" of Item 7 of these rules, and the report on project implementation as of day of submission of such statement are enclosed to the application for change of project deadline. In case of receipt of such statement the Ministry of Industry and Trade of the Russian Federation submits the project for de novo review according to the procedure, established by these rules. By results of de novo review of the project the Ministry of Industry and Trade of the Russian Federation makes the decision on possibility (impossibility) of change of project deadline, and also indicators (indicators) of effectiveness of project implementation specified in the agreement.
13. The Ministry of Industry and Trade of the Russian Federation signs agreements with the winner (winners) of tender the current financial year.
14. Subsidies on the credits obtained in currency of the Russian Federation are provided in the amount of 70 percent of cost amount of the organization on interest payment on the credit. At the same time the size of subsidy cannot exceed the size calculated proceeding from 70 percent of key interest rate of the Central bank of the Russian Federation operating on the date of interest payment on the credit, and the subsidy size on the credits obtained since January 1, 2017 - proceeding from 70 percent of the basic indicator calculated according to the order of the Government of the Russian Federation of July 20, 2016 N702 "About Use of Basic Indicators when Calculating Parameters of Subsidizing of Interest Rate at the expense of Means of the Federal Budget on the Credits, Bonded Loans and (or) Agreements of Leasing depending on Crediting Terms, and also Determination of Limit of Final Rate of Crediting in case of Which Exceeding Subsidizing of Interest Rate Is Not Performed".
Subsidies on the credits obtained in foreign currency are provided in the amount of 70 percent of cost amount of the organization on interest payment on the credit proceeding from the foreign exchange rate in relation to ruble established by the Central bank of the Russian Federation on the date of implementation of the specified costs. At the same time the size of subsidy cannot exceed the size calculated proceeding from rate on the credit obtained in foreign currency in the amount of 4 annual interest rates.
The size of the subsidies provided to one organization in the current financial year according to these rules cannot exceed 8 percent of the budgetary appropriations provided by the Federal Law on the federal budget for the corresponding financial year on the purpose, stipulated in Item 1 these rules.
15. Subsidies are not provided on compensation of the percent added and paid:
a) on overdue loan debt;
b) on the loans granted in case of lack of means on correspondent, settlement, current accounts (overdraft);
c) on the credits which effective period expired later than in year, prior year of receipt of subsidies;
d) on the credits on which rate exceeds the limit of final rate of crediting determined according to the order of the Government of the Russian Federation of July 20, 2016 No. 702 "About use of basic indicators when calculating parameters of subsidizing of interest rate at the expense of means of the federal budget by the credits, bonded loans and (or) agreements of leasing depending on crediting terms and also determination of limit of final rate of crediting in case of which exceeding subsidizing of interest rate is not performed".
16. For receipt of subsidy the organization represents to the Ministry of Industry and Trade of the Russian Federation not more often than once a month and no later than December 1 the statement for provision of subsidy with appendix of the following documents:
a) the statement according to the loan account of the organization confirming receipt of the credit, and also the documents confirming timely payment by the organization of the added interests on credit and its timely repayment certified by the relevant credit institution;
b) the certificate of target use of the credit in form according to appendix No. 3 with mark of the relevant credit institution confirming use of the credit for the purposes specified in Items 1 and 2 of these rules with application of copies of the payment documents certified by the head of the organization. At the same time use of the credit for the purposes corresponding specified in Items 1 and 2 of these rules implementation by the organization in case of production of the industrial output specified in the reference represented according to the subitem "v" of Item 7 of these rules, the following expenses is recognized:
acquisition of inventory items, including the raw materials, materials, consumable materials, component parts necessary for production, equipments of industrial equipment, tools, overalls;
fee on procesing of raw materials and production of finished goods;
c) calculation of the size of subsidy depending on currency in which the credit, in form according to appendix No. 4 or appendix No. 5 is obtained;
d) the reference signed by the head and the chief accountant of the organization (in the presence) under seal the organizations (in the presence), with indication of details of the organization, and also bank details of settlement accounts of the organization into which in case of adoption of the positive decision the subsidy will be transferred;
e) the reference signed by the head and the chief accountant (in the presence) of the organization under seal the organizations (in the presence), confirmatory that the organization did not receive subsidy for compensation of part of costs for interest payment on the same credit for the same period based on other regulatory legal acts.
17. Provision of subsidies is performed within the budgetary appropriations provided by summary budget list of the federal budget for the corresponding financial year, and limits of the budget obligations finished in accordance with the established procedure to the Ministry of Industry and Trade of the Russian Federation as to the receiver of funds of the federal budget for the purposes specified in Items 1 and 2 of these rules.
18. The Ministry of Industry and Trade of the Russian Federation registers on first come the statements for provision of subsidy specified in Item 16 of these rules, in the special magazine No. 2, which shall be strung together, numbered and under seal the Ministries.
19. The Ministry of Industry and Trade of the Russian Federation considers within 20 working days on first come the documents specified in Item 16 of these rules and checks completeness and reliability of the data containing in them.
In case of inadequate registration the statement for provision of subsidy is subject to return with motivated refusal (in writing) within 30 calendar days from the date of its receipt in the Ministry of Industry and Trade of the Russian Federation.
20. The decision on provision of subsidy is made by the Ministry of Industry and Trade of the Russian Federation after consideration of the documents provided for receipt of subsidy, but no later than December 20 of the current year, proceeding from the size of subsidy calculated according to appendix No. 4 or appendix No. 5 to these rules.
21. The Ministry of Industry and Trade of the Russian Federation makes the decision on refusal in provision of subsidy in the following cases:
a) discrepancy of the submitted documents to requirements, stipulated in Item 16 these rules, or non-presentation (representation not in full) the specified documents;
b) availability in the submitted documents of incomplete and (or) false information;
c) availability of the expenses which are not specified in the subitem "b" of Item 16 of these rules.
22. The Ministry of Industry and Trade of the Russian Federation within 10 calendar days from the date of decision making notifies in writing on the made decision the organization which submitted the application for provision of subsidy.
23. Transfer of subsidy is performed no later than 10 working days from the date of decision making about provision of subsidy in accordance with the established procedure for the settlement account of the organization opened in the Russian credit institution.
24. Criterion of effectiveness of provision of subsidy is the amount of self-produced shipped goods making at least 107 percent of amount of self-produced shipped goods for previous year in value term.
The specified criterion is calculated by formula:

25. The organization represents no later than April 15 of the year following accounting financial year, the report on achievement in reporting financial year of size of criterion of effectiveness of provision of subsidy in form according to appendix No. 6 with application of a copy of form of federal statistical observation of P-1 of "Data on production and the shipment of goods and services" certified by the head and the chief accountant of the organization (in the presence) and the organization under seal (in the presence) and also the copy of accounting records for the last accounting period.
26. Information on the sizes and terms of transfer of subsidies is considered by the Ministry of Industry and Trade of the Russian Federation when forming the forecast of cash payments from the federal budget necessary for creation in accordance with the established procedure of the cash plan of execution of the federal budget.
27. The Ministry of Industry and Trade of the Russian Federation performs forming and maintaining the register of receivers of subsidy with indication of the name of the project on which implementation the credit, the term of the credit agreement, loan interest rate and loan amount, and also the schedule of provision of subsidy was obtained.
28. The Ministry of Industry and Trade of the Russian Federation and authorized bodies of the state financial control carry out obligatory inspections of observance by the organization of the purposes, conditions and procedure for provision of subsidy.
29. In case of establishment by results of the inspections which are carried out by the Ministry of Industry and Trade of the Russian Federation and (or) authorized body of the state financial control, the facts of violation of the conditions determined by provision of subsidy, the organization shall return in the income of the federal budget the subsidy received in the corresponding reporting financial year in full:
a) based on the requirement of the Ministry of Industry and Trade of the Russian Federation - no later than the 10th working day from the date of obtaining by the organization of the specified requirement;
b) based on representation and (or) the instruction of authorized body of the state financial control - in the terms established according to the budget legislation of the Russian Federation.
30. In case of not achievement in reporting financial year of size of criterion of effectiveness of the provision of subsidy specified in Item 24 of these rules, the organization in the current financial year pays to the income of the federal budget penalties in the amount of, the No. calculated according to appendix 7, according to the procedure established by the budget legislation of the Russian Federation.
