ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

About questions of the organization of the public civil service and municipal service

(as amended on 22-04-2021)

For the purpose of increase in efficiency of the public civil service and municipal service, ensuring succession, stability and independence of professional office activity of citizens of the Kyrgyz Republic in state bodies and local government bodies, according to the Law of the Kyrgyz Republic "About the public civil service and municipal service", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" decides:

1. Approve:

- Regulations on procedure for carrying out tender and office promotion on the public civil service and municipal service of the Kyrgyz Republic according to appendix 1;

- Standard qualification requirements to groups of managerial positions of the public civil service and municipal service according to appendix 2;

- The standard job description of the government civil servant and local government officer of the Kyrgyz Republic according to appendix 3;

- Regulations on procedure for forming and functioning of the National reserve of personnel of the public civil service and municipal service of the Kyrgyz Republic according to appendix 4;

- Regulations on procedure for forming and functioning of internal reserve of personnel of state body and local government body according to appendix 5;

- Regulations on procedure for carrying out rotation of the government civil servants and local government officers of the Kyrgyz Republic according to appendix 6;

- Regulations on procedure for conducting testing of candidates for replacement of vacant managerial state positions and managerial municipal positions according to appendix 7;

- Procedure for maintaining the personal record of the government civil servant and local government officer of the Kyrgyz Republic according to appendix 8.

2. Assign obligations on coordination and methodical ensuring implementation of this resolution to authorized state body for the public civil service and municipal service.

3. Recognize invalid:

- The order of the Government of the Kyrgyz Republic "About questions of passing of public service of the Kyrgyz Republic" of November 29, 2011 No. 741;

- The order of the Government of the Kyrgyz Republic "About entering of amendments and changes into the Order of the Government of the Kyrgyz Republic "About questions of passing of public service of the Kyrgyz Republic" of November 29, 2011 No. 741" of June 11, 2012 No. 392;

- paragraphs the third or fifth Item 1 of the Order of the Government of the Kyrgyz Republic "About measures for enhancement of wages system of the government and local government officers of the Kyrgyz Republic for 2013-2020" of June 28, 2013 No. 383;

- The order of the Government of the Kyrgyz Republic "About entering of amendments into the Order of the Government of the Kyrgyz Republic "About questions of passing of public service of the Kyrgyz Republic" of November 29, 2011 No. 741" of July 2, 2014 No. 366;

- The order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic "About questions of passing of public service of the Kyrgyz Republic" of November 29, 2011 No. 741" of July 31, 2014 No. 428;

- paragraphs the eleventh or sixteenth Item 1 of the Order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of September 19, 2014 No. 540;

- The order of the Government of the Kyrgyz Republic "About modification of the Order of the Government of the Kyrgyz Republic "About questions of passing of public service of the Kyrgyz Republic" of November 29, 2011 No. 741" of February 12, 2015 No. 51.

4. To impose control of execution of this Resolution on department of public administration and personnel work of Government office of the Kyrgyz Republic.

5. This Resolution becomes effective after seven working days from the date of official publication.

Appendix 1

Regulations on procedure for carrying out tender and office promotion on the public civil service and municipal service of the Kyrgyz Republic

1. General provisions

1. This Regulations on procedure for carrying out tender and office promotion (further - the Provision) determine conditions and procedure for carrying out tender and the procedure of office promotion in case of replacement of vacant managerial position of the public civil service and municipal service of the Kyrgyz Republic by the public civil service and municipal service of the Kyrgyz Republic.

2. The vacant managerial state, municipal position is not replaced with the government civil, local government officer (further - the employee) established post in state body, local government body. Replacement of vacant managerial state, municipal position of the public civil service and municipal service of the Kyrgyz Republic is carried out according to the procedure:

- office promotion by results of assessment of activities of the employee;

- carrying out tender according to this Provision;

- according to the procedure of rotation, stipulated in Item the 68th this provision.

3. State bodies and local government bodies on the basis of the Standard qualification requirements to managerial positions (further - Standard qualification requirements) approved by the Government of the Kyrgyz Republic are developed and approve in coordination with authorized state body on the public civil service and municipal service (further - authorized state body) qualification requirements to the managerial state positions and managerial municipal positions provided by their staff list.

4. Qualification requirements to managerial state and managerial municipal positions join requirements, the stipulated in Clause 14 Laws of the Kyrgyz Republic "About the public civil service and municipal service".

5. Coordination of work of state bodies, local government bodies on candidate screen on the public civil service and municipal service, rendering the methodical and advisory help is performed by authorized state body.

2. Tender and contest committee

6. Revenues to the public civil service and municipal service are performed on competitive basis (further - tender).

Tender provides constitutional right of citizens of the Kyrgyz Republic on equal access to the public civil service and municipal service according to their capabilities and professional training.

7. The purposes of carrying out tender - identification of the most prepared applicants according to imposed qualification requirements for replacement of managerial positions of the public civil service and municipal service, including education, work experience, professional and general knowledge, business qualities, and also motivations of candidates.

Competition is held and if only one candidate applies for replacement of managerial position.

8. The participant of tender on replacement of vacant managerial state position and managerial municipal position is the person who submitted the application for participation in tender and allowed to participation in the tender according to the procedure established by this Provision.

9. For carrying out tender on replacement of vacant managerial state position and managerial municipal position with the decision of the head of state body, local government body the contest committee is created.

10. Structure and structure of the contest committee of state body:

- the chairman of the contest committee - the secretary of state or the acting as the secretary of state (chief of staff) of state body. In case of need, if the position of the secretary of state (chief of staff) is vacant or the secretary of state (chief of staff) is in official journey, is absent for health reasons (supported by the relevant documents), is on vacation (labor, on pregnancy and childbirth, on child care, non-paid) or is suspended from post, on carrying out tender the government civil servant of state body - one of members of the commission determined by the head of state body is temporarily appointed to replacement of vacant managerial state position the commission chairman.

Members of the contest committee:

- the commission chairman on ethics of state body;

- the representative for the prevention of corruption in state body;

- representatives of institutes of civil society of the corresponding industry orientation and veterans of industry (in coordination);

- heads (specialists) of service of personnel management and legal service;

- heads (specialists) of other structural divisions of state body;

- the representative of authorized state body (in coordination).

The secretary of the contest committee is appointed the head of state body from among members of the contest committee.

The contest committee the government employees holding managerial state positions are included. Replacement of the absent members of the commission is not allowed.

In subordinated or territorial subdivision of state body the contest committee which structure affirms the head of subordinated or territorial subdivision of state body in coordination with the secretary of state (chief of staff) of state body can be created.

The government employee - one of members of the contest committee determined by the head of subordinated or territorial subdivision of state body in coordination with the secretary of state (chief of staff) of state body is appointed the chairman of the contest committee of subordinated or territorial subdivision of state body.

On carrying out tender the government employee of state body - one of members of the commission determined by the chairman of the Constitutional chamber of the Supreme Court of the Kyrgyz Republic is appointed to replacement of vacant managerial state position in the Constitutional chamber of the Supreme Court of the Kyrgyz Republic the commission chairman.

11. Structure and structure of the contest committee of local government body:

- the chairman - the chief of staff of city administration, the chief of staff (the responsible secretary) of the city kenesh, the chief of staff of district city administration of republican value, the responsible secretary ayyl to okmot, the deputy of the ayylny kenesh determined by the corresponding ayylny kenesh in case of competitive selection of the responsible secretary of the ayylny kenesh, in ayylny aimags with population from 6001 persons above. In case of need, if positions of the chief of staff of city administration, the chief of staff of the city kenesh (the responsible secretary), the chief of staff of district city administration of republican value, the responsible secretary ayyl to okmot are vacant, or persons holding the specified positions are in official journey, are absent for health reasons (supported by the relevant documents), are suspended from posts or are on vacation (labor, on pregnancy and childbirth, on child care, non-paid), on carrying out tender the local government officer of local government body - one of members of the commission determined by the head of local government body is appointed to replacement of vacant managerial municipal position the commission chairman.

When carrying out tender to position of the chief of staff of city administration the chairman is the vice-mayor (including the first).

When carrying out tender to position of the responsible secretary ayyl to okmot the chairman is the deputy head ayyl to okmot, and in case of absence - the representative of local public administration.

Members of the commission:

- the paragraph the fourth Item 11 ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 08.06.2017 No. 358

- the representative of authorized state body (in separate local government bodies according to the decision of authorized state body);

- the representative of the plenipotentiary of the Government of the Kyrgyz Republic in the respective area, when carrying out tender in the cities of regional value;

- the representative of local public administration, when carrying out tender in the cities of district value and ayylny aimags;

- representatives of service of personnel management or the authorized person concerning personnel management, and also representatives of other structures of local government body;

- representatives of civil society (in coordination).

The secretary of the contest committee is appointed the head of local government body from among members of the contest committee.

In the cities of district value, ayylny aimags with population from 6001 persons the joint contest committee of city administration and the city kenesh, ayyl okmota and the ayylny kenesh, respectively is created above. When carrying out tender for vacancies of the office of city administration commission chairman is the chief of staff of the city hall, when carrying out tender for vacancies of the device of the city kenesh the representative of the city kenesh presides.

In the cities of republican value the head of local government body has the right to form in subordinated or territorial subdivisions of local government bodies the corresponding contest committees for the organization and carrying out tender on vacant managerial positions of municipal service.

In these cases the deputy manager of subordinated or territorial subdivision of local government body is appointed the chairman of the contest committee, and in case of absence in the staff list of the deputy - one of the staff of this division.

Quantitative and members of the contest committee of subordinated or territorial subdivision, procedure for its work affirm the head of local government body in coordination with the relevant territorial subdivision of authorized state body.

Organizational support of carrying out competitive selection to position of the responsible secretary of the ayylny kenesh in ayylny aimags with population from 6001 persons is assigned to the device above corresponding ayyl to okmot.

Replacement of the absent members of the commission is not allowed.

12. For conducting check of special professional knowledge in specialized types of activity experts can be attracted by the contest committee. Conclusions of experts have advisory nature and are drawn up by the protocol.

13. When carrying out tender the contest committee:

- determines terms of carrying out tender and regulations of work;

- determines questions for interview stage;

- considers the documents filed by participants of tender and makes the decision on the admission to testing;

- the paragraph the fifth ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 06.12.2018 No. 568;

- conducts interview with participants of tender;

- makes the decision on the recommendation of the selected candidate for appointment to vacant position;

- makes the decision on the recommendation of certain candidates for transfer for internal reserve of personnel of state body or local government body.

14. Service of personnel management or the authorized person concerning personnel management:

- performs documents acceptance from the citizens applying for replacement of vacant managerial position;
