ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of the Technical regulation concerning provision in the market of the equipment working under pressure

(as amended on 14-06-2023)

Based on part provisions (1) Article 18 and line item 22 appendices 3 to the Law No. 235 of December 1, 2011 on activities for accreditation and assessment of conformity (The official monitor of the Republic of Moldova, 2012, Art. No. 46-47, 136), with subsequent changes and amendments, the Law No. 420-XVI of December 22, 2006 on technical regulation (The official monitor of the Republic of Moldova, 2007, Art. No. 36-38, 141), with subsequent changes and amendments, and for the purpose of realization of provisions of the National plan of action for implementation of the Agreement on association the Republic of Moldova – the European Union for 2014-2016, approved by the Order of the Government No. 808 of October 7, 2014. (The official monitor of the Republic of Moldova, 2014, Art. No. 297-309, 851), with subsequent changes and amendments, DECIDES: the Government

1. Approve the Technical regulation concerning provision in the market of the equipment working under pressure it (is applied).

2. To the Ministry of Economy and Infrastructure within 6 months from the date of publication of this resolution to develop and approve the list of the harmonized standards to the Technical regulation concerning provision in the market of the equipment working under pressure

3. This resolution becomes effective the law on ratification after 24 months from the date of publication in the Official monitor of the Republic of Moldova, except for Items 94, of 96, of 105, of 130, of 135, of 136, of 159, 161 and 168 Technical regulations, the concerning provision in the market of the equipment working under pressure which will become effective from the date of entry into force of the Agreement on assessment of conformity and the acceptability of industrial output (ASAA) – the protocol to the Agreement on association between the Republic of Moldova, on the one hand, by both the European Union and European Atomic Energy Community and their state members, on the other hand.

4. Before the date of entry into force of the law on ratification of the Agreement on assessment of conformity and the acceptability of manufactured goods between the Republic of Moldova and the European Union:

1) are allowed provision in the market and commissioning of the equipment working under pressure and assembly units which are marked by marking of compliance of SM and are followed by the declaration of conformity according to the requirements provided in the Law No. 235 of December 1, 2011 on activities for accreditation and assessment of conformity;

2) the producer or his authorized representative with the location in the Republic of Moldova apply marking of compliance of SM, in case when assessment of conformity of the equipment working under pressure, and the assembly units intended for the national market is performed by acknowledged conformity assessment bodies by application of the procedures provided in Chapter VIII of the Technical regulation concerning provision in the market of the equipment working under pressure except the Module A;

3) it is forbidden in the conditions provided by the Technical regulation concerning provision in the market of the equipment working under pressure, drawing for the same equipment working under pressure, markings of compliance of SM and marking of SE;

4) requirements to notified conformity assessment bodies are applied also to the acknowledged conformity assessment bodies having similar legal status according to Law No. 235 provisions of December 1, 2011 on activities for accreditation and assessment of conformity. When holding procedures for assessment of conformity the acknowledged bodies performing assessment of conformity of the equipment working under pressure constitute the test certificate of standard sample;

5) the list including acknowledged conformity assessment bodies and their identification numbers is kept by the National center of accreditation MOLDAC and published on its official site.

5. To the Ministry of Economy and Infrastructure to recognize the bodies performing assessment of conformity of the equipment working under pressure and the assembly units intended for the national market according to the procedures provided in Chapter VIII of the Technical regulation concerning provision in the market of the equipment working under pressure. The procedure of notification is performed after the procedure of recognition established in Chapter IV-1 of the Law No. 235 of December 1, 2011 on activities for accreditation and assessment of conformity.

6. Obligations and liability of the producer, his authorized representative, the importer or the distributor, with location in the Republic of Moldova concerning the equipment working under pressure, and the assembly units provided in the market and put into operation under marking of compliance of SM correspond to those which are provided by this resolution for the equipment working under pressure and assembly units with marking of SE.

7. On the date of entry into force of this resolution to declare invalid the Order of the Government No. 262 of April 3, 2009. "About approval of the Technical regulation "The Equipment Working under Pressure" (The official monitor of the Republic of Moldova, 2009, Art. No. 75-77, 320).

8. To impose control over the implementation of this resolution on the Ministry of Economy and Infrastructure.

Chapter I General provisions

1. The technical regulation concerning provision in the market of the equipment working under pressure (further – the Technical regulation), establishes safety requirements to which it shall correspond when ensuring provision in the market and/or putting into operation to provide the high level of protection of public concerns, such as health and safety of people, protection of pets and property, guaranteeing the loyal competition in the market.

2. This Technical regulation extends to the equipment working under pressure and assembly units which in case of placement on the national market are new; namely the new equipment working under pressure, or the assembly units made by the producer founded in the European Union, or on the equipment working under pressure, or the assembly units new or former in the use, imported from the third country.
