About approval of the Instruction about procedure for sealing in seaports of the ship locking devices intended for dumping of pollutants and waters which contain them
According to Article 3 of the Merchant Marine Code of Ukraine, Rules of protection of internal seawaters and territorial sea of Ukraine from pollution and contamination approved by the resolution of the Cabinet of Ministers of Ukraine of February 29, 1996 No. 269 (in edition of the resolution of the Cabinet of Ministers of Ukraine of March 29, 2002 to No. 431), to the subitem 28 of item 4 of the Regulations on the Ministry of infrastructure of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of June 30, 2015 No. 460, I order:
1. Approve the Instruction about procedure for sealing in seaports of the ship locking devices intended for dumping of pollutants and waters which contain them which is applied.
2. To provide to department of reforming and functioning of sea and river transport:
submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine;
promulgation of this order on the official site of the Ministry of infrastructure of Ukraine.
3. Declare invalid the order of the Ministry of transport of Ukraine of September 30, 2002 No. 695 "About approval of the Instruction about procedure for sealing in sea commercial and river ports of Ukraine of the ship locking devices intended for dumping of pollutants and waters which contain them", registered in the Ministry of Justice of Ukraine on October 14, 2002 for No. 826/7114.
4. This order becomes effective from the date of its official publication.
5. To impose control over the implementation of this order on the First Deputy Minister E.Kravtsov.

1. This Instruction is developed according to the Merchant Marine Code of Ukraine, Rules of protection of internal seawaters and territorial sea from pollution and contamination approved by the resolution of the Cabinet of Ministers of Ukraine of February 29, 1996 No. 269 (in edition of the resolution of the Cabinet of Ministers of Ukraine of March 29, 2002 No. 431), the Regulations on the captain of seaport and service of the captain of seaport approved by the order of the Ministry of infrastructure of Ukraine of March 27, 2013 No. 190, registered in the Ministry of Justice of Ukraine on April 18, 2013 for No. 632/23164.
2. Action of this Instruction extends to captains of seaports, service of the captain of seaports (further - Service), captains and crews of vessel which come into seaports of Ukraine.
1. Sealing of ship locking devices (valves, sluice valves, valves, clacks, cranes, hatches, etc.) (further - locking devices) is performed for the purpose of prevention of spontaneous dumping from courts of pollutants or waters which contain them which are prohibited to dumping according to the legislation and international treaties of Ukraine.
2. The locking devices which are specially intended for direct dumping overboard of the vessel of pollutants or waters which contain them are subject to sealing (such as oily bilge waters of engine and boiler rooms, the slime and other petroremaining balance, dirty and net ballast, drain waters washing waters from holds, garbage). The list of the ship locking devices intended for dumping of pollutants and waters which contain them which shall be sealed up, given in appendix 1 to this Instruction.
The list of devices of each vessel is determined by administration of the vessel taking into account type, assignment and design features of the vessel, its equipment and systems and it is specified in the relevant ship's papers.
3. The locking devices which are specially not intended for direct dumping overboard of the vessel of pollutants or waters which contain them are not subject to sealing (in particular, the oily bilge waters of engine and boiler rooms, dirty and net ballast, petroremaining balance, waste and economic and household waters intended for delivery on port inshore and floating reception facilities, for dumping overboard of the segregated ballast and sewage purified on ship installation which conforms to the requirements established by the International convention on pollution prevention from courts of 1973 with the changes made by the Protocol of 1978 to it that is confirmed by the appropriate international certificates about pollution prevention drain waters, for transfer of all types of liquids within the vessel, for acceptance on the vessel and issues from the vessel of fuel, oils).
4. The locks which are subject to sealing shall be completely closed for prevention of dumping through the sealed-up lock before sealing.
5. If the lock has remote (mechanical or other operation principle) drives, except the drive located on the device, then are sealed up also all its remote drives.
6. Sealing is performed so that after imposing of seal any manipulations with the device directed to its opening including by means of remote devices, led to violation of seal.
1. Sealing of locking devices is performed by the authorized person of Service during inspection of the vessel according to the Rules of control of courts for the purpose of navigation safety control approved by the order of the Ministry of transport of Ukraine of July 17, 2003 No. 545, No. 353/8952 registered in the Ministry of Justice of Ukraine on March 23, 2004. At the same time the authorized person of Service checks:
availability on the vessel of the list of the locking devices which are subject to sealing, the flag state which is documentary fixed according to requirements;
availability of entry in the logbook or other ship's papers about sealing of locking devices;
the actual sealing of locking devices in closed position and its reliability.
2. If during check shortcomings of sealing of locking devices are revealed, the authorized person of Service shall address the ship master or person replacing it with the requirement to immediately correct the revealed shortcomings then repeatedly to check sealing of locking devices.
