About approval of the Procedure for performing obligatory preliminary and periodic medical examinations (medical examination) in healthcare institutions of the Ministry of Internal Affairs

In pursuance of the subitem 5 of Item 7 of the Section XI "Final and transitional provisions" of the Law of Ukraine "About National police", the subitem 52 of item 4 of the Regulations on the Ministry of Internal Affairs of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 28, 2015 No. 878, and for the purpose of reduction according to the legislation of Ukraine of regulatory legal acts of the Ministry of Internal Affairs I order:

1. Approve the Procedure for performing obligatory preliminary and periodic medical examinations (medical examination) in healthcare institutions of the Ministry of Internal Affairs which is applied.

2. Recognize the voided Instruction about the organization of performing preliminary and periodic medical examinations and medical examination in treatment-and-prophylactic institutions of the Ministry of Internal Affairs of Ukraine approved by the order of the Ministry of Internal Affairs of Ukraine of November 4, 2003 No. 1296, registered in the Ministry of Justice of Ukraine on May 13, 2004 for No. 598/9197.

3. To management of health care and rehabilitation of the Ministry of Internal Affairs (V. I. Box) provide submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

4. This order becomes effective from the date of its official publication.

Procedure for performing obligatory preliminary and periodic medical examinations (medical examination) in healthcare institutions of the Ministry of Internal Affairs

I. General provisions

1. This Procedure determines the organization in healthcare institutions of the Ministry of Internal Affairs obligatory preliminary (in case of employment) and periodic (during labor activity) medical examinations of the workers occupied on hard work, works with harmful and dangerous working conditions or such where there is need for professional selection and annual obligatory medical examination of persons aged till 21 year, the military personnel of National guard of Ukraine (further - NSU) (further - faces which are subject to preliminary and periodic medical examinations).

2. The terms applied in this Procedure are determined in the Laws of Ukraine "About labor protection" and "Bases of the legislation of Ukraine about health protection".

3. The previous and periodic medical examinations of persons which are subject to the specified types of medical examinations are carried out in the healthcare institutions of the Ministry of Internal Affairs having the license for medical practice on the corresponding specialties and underwent accreditation.

4. Preliminary and periodic medical examinations are performed according to Articles 14, 17 Laws of Ukraine "About labor protection", articles 10, of 31 Law of Ukraine of "Basis of the legislation of Ukraine about health protection", Articles 5, 26 Laws of Ukraine "About ensuring sanitary and epidemic wellbeing of the population", the resolution of the Cabinet of Ministers of Ukraine of November 6, 1997 No. 1238 "About obligatory routine narcological inspection and procedure for its carrying out" (further - the resolution of the Cabinet of Ministers of Ukraine No. 1238), of September 27, 2000 No. 1465 "About approval of procedure for carrying out obligatory preliminary and periodic psychiatric examinations and the list of medical psychiatric contraindications for accomplishment of separate types of activity (works, professions, service) which can constitute direct danger to person making these activities or people around" (further - the resolution of the Cabinet of Ministers of Ukraine No. 1465) and of May 23, 2001 No. 559 "About approval of the list of professions, productions and the organizations which employees are subject to obligatory routine medical examinations, procedure for carrying out these surveys and issue of personal medical books" (further the resolution of the Cabinet of Ministers of Ukraine No. 559).

5. The list of professions, productions and the organizations which employees are subject preliminary and to periodic medical examinations, frequency of these surveys, profession of the doctors participating in the overview, laboratory, functional and other researches, frequency of their carrying out are determined by the resolution of the Cabinet of Ministers of Ukraine No. 559, orders of the Ministry of Health of Ukraine of July 23, 2002 No. 280 "About the organization of performing obligatory routine medical examinations of workers of separate professions, productions and the organizations which activities are connected with servicing of the population and can lead to spread of infectious diseases", registered in the Ministry of Justice of Ukraine on August 8, 2002 at No. 639/6927 (further - the order of the Ministry of Health No. 280), of May 21, 2007 No. 246 "About approval of the Procedure for performing medical examinations of workers of certain categories", registered in the Ministry of Justice of Ukraine on July 23, 2007 on No. 846/14113 (further - the order of the Ministry of Health No. 246), and of May 17, 2008 No. 254 "About approval of the Instruction about frequency of x-ray inspections of bodies of chest cavity of certain categories of the population of Ukraine", registered in the Ministry of Justice of Ukraine on June 12, 2008 for No. 524/15215 (further - the order of the Ministry of Health No. 254).

II. Organization of carrying out preliminary and periodic medical examinations

1. In healthcare institutions of the Ministry of Internal Affairs the commission on carrying out preliminary and periodic medical examinations is created (further - medical commission). The structure of this commission and procedure for its work are determined by the order of the Ministry of Health No. 246.
