1. Approve the enclosed Rules of compensation of damage caused to the employee or the employee of diplomatic service or members of his family during stay abroad in case of execution of the service duties by it or activities, related.

2. This resolution becomes effective from the date of signing.

Rules of compensation of damage caused to the employee or the employee of diplomatic service or members of his family during stay abroad in case of execution of the service duties by it or activities, related

1. General provisions

1. These rules determine conditions and establish procedure for compensation of damage caused to the employee or the employee of diplomatic service or members of his family during stay abroad in case of execution of the service duties by it or activities, related.

2. The damage in these rules is understood as the harm done to life and health of the employee or employee of diplomatic service or members of his family, caused as a result of the armed or civil conflicts, acts of terrorism, emergency situations, illegal actions of the third parties (further - physical damage).

3. The loss is indemnified for the account of the means of reserve of the Government of the Republic of Kazakhstan provided annually in the republican budget for the corresponding financial year.

2. Procedure for hearing of cases about compensation of damage

4. When causing the damage which is subject to compensation according to these rules, the employee or the employee of diplomatic service files the written application about compensation of the caused damage to the Minister of Foreign Affairs of the Republic of Kazakhstan (further - the Minister).

5. The application for compensation of damage is submitted according to the requirements established by Chapter 3 of these rules.

In case of discrepancy to the requirements specified in Chapter 3 of these rules, the application for compensation of damage is returned to the applicant without consideration.

6. In case of impossibility of the personal address of the employee or the employee of diplomatic service the full age member of his family files petition for compensation of damage to the Minister.

7. Based on the statement in the procedure established by the legislation the Ministry develops the draft of the order of the Government of the Republic of Kazakhstan providing assignment for compensation of damage.

8. Compensation of damage is performed in the sizes determined by article 25 of the Law of the Republic of Kazakhstan "About diplomatic service of the Republic of Kazakhstan".

3. Requirements imposed to the statement for compensation of damage

9. The place, time, the reasons and other circumstances of damnification of life and to health, the name and legal address of bodies of the state of stay to which it is reported about the event or about the reasons owing to which the accident it was not reported is specified in the statement.

10. Are applied to the statement for damnification of life and health:

the documents establishing damnification of life and to health (medical certificates, other supporting documents);

act or other document on the place, time, reason and other circumstances of damnification of life and to health of the employee or employee of diplomatic service or member of his family.

4. Final provisions

11. In case of disagreement of the employee or the employee of diplomatic service or the member of his family with the made decision, he has the right to appeal it judicially.
