About approval of the Regulations on approval procedure of rates for regular international passenger air transportation
For the purpose of regulation of rates for regular passenger air transportation, based on the law on civil aviation, the Provision of Public administration of civil aviation approved by the Order of the Government of the Republic of Moldova N1057 of October 19 1998, and also considering provisions of the intergovernmental bilateral agreements concerning aviation services and documents of International Civil Aviation Organization dok.9587 "Policy and instructive material in the field of economic regulation of the international air transport" and dock. 9626 "Management on regulation of the international air transport", PRIKAZYVAYU:
1. Approve Regulations on approval procedure of rates for regular international passenger air transportation according to appendix to this order.
2. The operators performing regular commercial flights shall submit repeatedly for approval rates for the international passenger air transportation within one month from coming into force of this order.
3. To assign control of accomplishment of this order to economic management of public administration of civil aviation.
4. This order becomes effective from the date of its publication in "Monitorul Oficial al Republicii Moldova".

1. This Provision establishes approval procedure of rates for the international passenger air transportation.
Operators of the Republic of Moldova, irrespective of their form of business, the performing regular commercial flights, can apply only the rates approved by Public administration of civil aviation (further GAGA).
The specified rates affirm after issue of the permission to operate of air route for which approval of rate is requested.
2. Rates for the runs cargo (carriage of goods and mails) and unscheduled passenger flights are established by air carriers based on contracts with users of services.
3. Regulation of rates for the international passenger air transportation of GAGA is performed in the following purposes:
- provision of equal opportunities to national carriers for implementation of the international airborne transportations;
- providing national air carriers with fair and equal conditions in the conditions of the competition to foreign carriers;
- maintenance of the corresponding national purposes and tasks, and also encouragement of the international tourism and trade;
- encouragement of the loyal competition in the field of the international air transport by ensuring flexibility concerning use of rates;
- requirements satisfaction of users of the international air transport;
- ensuring accomplishment of the tariff provisions containing in bilateral intergovernmental agreements about aviation services, and ensuring control over the implementation of the approved applicable fares;
- preserving distinction between regular and irregular air transportation.
4. The determinations used in this provision make the following sense:
The operator - the physical person or legal entity which is engaged in operation of air vehicles or offering the services in this area;
Air carrier - any operator performing for a fee airborne transportations with use of the air vehicle;
Domestic flight - the flight which is carried out between two points in the territory of the Republic of Moldova without using intermediate landing in the territory of other state;
The international flight - the flight which is carried out between one point located in the territory of the Republic of Moldova and the points located in the territory of other state;
The passenger - person transported onboard the air vehicle based on the contract (air ticket) with air carrier;
Regular commercial passenger flights - flights corresponding to the following conditions:
a) aim at public conveyance for a fee;
b) are performed according to the established schedule;
c) are on sale to any person (directly or through intermediaries).
The permission to operate - the official document confirming capability and the right of his owner to provide services on certain route;
Rate - the price which is levied for public conveyance and baggage between two or more states, and:
a) any end-to-end rate or the amount which shall be levied for international delivery or sold as that, including the end-to-end rates constructed with use of other rates or additional rates for transportation the across the international or internal sites which are part of the international site;
b) the commission charges paid for ticket sales on public conveyance and their baggage;
c) conditions which regulate applicability of rate, or payment of commission charges.
Note: Tariff conditions and rules are rate constituent, the provisions reflecting procedure or range of services or the privileges provided for international delivery of passengers. Conditions of application of transit fares include such elements as seating capacity and/or weight of accompanied baggage which will be transported without additional fare, and possibility of change of route or run, implementation of stoppages in transit (stopover) on route, and also the right to return. Conditions which limit passenger fare are the exception, restriction or collection of the additional amounts for the right to change route or use of similar benefits; the requirement about payment for certain period of time before the travel; the requirement about the minimum residence time in destination, restrictions for route and/or consolidation of this rate with other rates.
5. Depending on class of the provided services connected with aviation services, rates are divided into the following main categories.
The minimum rate provides to the passenger the maximum flexibility concerning combination of rates, return, changes of the schedule and route, is normal economic second class fare.
Bonus rates (first class or business class) have higher cost, than normal economic rate, provide more full range of services and privileges onboard the air vehicle and at the airport.
6. Depending on routes, differentiate the following types of rates.
Rate in one direction (OW) which provides transportation from Item of the beginning of transportation in other Item.
Rate for trip "there and back (RT)", providing transportation from Item where transportation, back in the same Item begins.
The rate for trip along circular route provides transportation along the closed indirect route there and back.
Rate for trip on not locked route is the rate for trip along circular route with gap in route of airborne transportation either in the point of departure, or in destination.
