About approval of the Procedure for provision of information by the Public fiscal service of Ukraine on requests of bodies of the public executive service and private contractors

1. Approve the Procedure for provision of information by the Public fiscal service of Ukraine on requests of bodies of the public executive service and private contractors which is applied.

2. Determine the administrators of exchange of information providing and performing technical support of the procedure of giving of requests and receipt of answers, the state company "National Information Systems" and State fiscal service of Ukraine.

3. To the state company "National Information Systems" (Lurye S. S.) together with Department of the public executive service of the Ministry of Justice of Ukraine (Polishchuk D. V.) and the Public fiscal service of Ukraine (Nasirov R. M.) to continue exchange of information and in two-month time from the date of entry into force of this order to provide preparation and approval of protocols of exchange of information and proper execution of this order.

4. Declare invalid the order of the Ministry of Justice of Ukraine, the Ministry of the income and charges of Ukraine of February 5, 2014 No. 254/5/119 "About approval of the Procedure for provision of information by the Ministry of the income and charges of Ukraine on requests of bodies of the public executive service", registered in the Ministry of Justice of Ukraine on February 12, 2014 for No. 279/25056.

5. To department concerning justice and homeland security of the Ministry of Justice of Ukraine (Oleynik A. N.) submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

6. This order becomes effective along with enforcement of article 8 of the Law of Ukraine of June 2, 2016 No. 1404-VIII "About enforcement proceeding", but not earlier than day of its official publication.

7. To impose control of execution of this order on the deputy minister of justice concerning executive service Shklyar V. S. and the Deputy Minister of Finance of Ukraine Marchenko S. M.

Procedure for provision of information by the Public fiscal service of Ukraine on requests of bodies of the public executive service and private contractors

1. This Procedure No. 1404-VIII "About enforcement proceeding" is developed according to part five of article 18 of the Law of Ukraine of June 2, 2016.

2. This Procedure determines general rules of representation by bodies of the public executive service and private contractors of requests and provisions by the Public fiscal service of Ukraine of responses to such information requests about registration numbers of accounting cards of taxpayers - debtors - physical persons or series (in the presence) and passport numbers of debtors - physical persons who on the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and officially notified on it the relevant monitoring body and have mark in the passport, the available accounts at debtors - legal entities and/or physical persons entrepreneurs, and also the accounts opened by the debtor - the legal entity through the branches, representations and other separate divisions which is received by the Public fiscal service of Ukraine from banks and other financial institutions, and sources of receipt of the income of debtors - physical persons.

3. Information exchange is performed electronically by means of telecommunication communication with observance of requirements of the Laws of Ukraine "About electronic documents and electronic document management", "About electronic confidential services", "About information security in information and telecommunication systems", "About personal data protection".

4. The state company "National Information Systems" which is administrator of the automated system of enforcement proceeding (further - System) provides transfer to the Public fiscal service of Ukraine of the requests created by bodies of the public executive service and private contractors by means of System.

Requests shall contain information concerning bodies of the public executive service and private contractors, namely:

EGRPOU code of body of the public executive service or number of the certificate of the private contractor;

name of body of the public executive service or mark "private contractor";

surname, name, middle name (in the presence) contractor.

Requests are sent by private contractors, data on whom are entered in the Unified register of private contractors of Ukraine and on which at the time of giving of request, in the specified register there is no information on the termination or suspension of operations of the private contractor.

5. The public fiscal service of Ukraine provides transfer of replies to the requests of bodies of the public executive service and private contractors through the administrator of system - the state company "National Information Systems".

6. Maintaining registers of requests and replies to the requests is performed by the state company "National Information Systems" and the Public fiscal service of Ukraine.
