About approval of the Approval procedure like measuring instruments

For the purpose of implementation of the subitem 3 of Item 9 of the Protocol on carrying out coordinated policy in the field of ensuring unity of measurements (appendix № 10 to the Agreement on the Eurasian Economic Union of May 29, 2014) and according to Item 37 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 №98, Council of the Eurasian economic commission decided:
1. Approve the enclosed Approval procedure like measuring instruments.
2. Determine that the documents on approval like measuring instruments issued according to the legislation of state member of the Eurasian Economic Union before date of the introduction of this Decision in force concerning the measuring instruments made in the territories of state members of the Eurasian Economic Union are effective before date of the termination of term of their action.
3. This Decision becomes effective from the effective date the rules of mutual recognition of results of works on ensuring unity of measurements approved by the Eurasian economic commission, but not earlier than 30 calendar days from the date of official publication of this Decision.

2. For the purposes of this Procedure primary reference technique (method) of measurements is understood as technique (method) of measurements which is implemented with the highest accuracy in state member at the single legal entity on 1 set of the equipment, is applied to assessment of correctness of results of the measurements received with use of other techniques (methods) of measurements of the same sizes including reference, allows to receive results of measurements without their metrological traceability to units of sizes of the same sort and is approved as primary reference technique (method) applied in state member.
3. The measuring instruments applied in the field of state regulation of ensuring unity of measurements (legislative metrology) are subject to approval of type without fail.
Concerning the measuring instruments applied out of the sphere of state regulation of ensuring unity of measurements (legislative metrology), approval of type is carried out in voluntary procedure.
4. Approval of type is carried out by public authority in the field of ensuring unity of measurements, the representative (notified) on implementation of these activities according to the legislation of state member (further – authorized body), based on positive results of testing of measuring instruments.
5. Approval of type is carried out according to the statement of any state member registered according to the legislation in its territory of the legal entity or physical person as the individual entrepreneur, performing on its own behalf production or production and realization of measuring instruments and responsible for their compliance to metrological requirements, or the state member authorized by the manufacturer and registered according to the legislation in its territory of the legal entity or physical person as the individual entrepreneur, the measuring instruments performing based on the contract with the manufacturer on behalf of this manufacturer of action in case of release into the stream of commerce in the territories of state members (further – the applicant).
6. Testing for the purpose of approval of type (further – testing) are carried out by the organization (notified) according to the legislation of authorized state member on carrying out testing of measuring instruments (further – authorized organization).
Testing are carried out according to the procedure, established by the legislation of state members in the field of ensuring unity of measurements.
7. Testing are carried out in the amount provided by the program of testing developed by authorized organization and approved with the applicant (further – the program of testing) based on the statement of the applicant which contains:
a) full name of the applicant, the location (address) of the legal entity or surname, name, middle name (in the presence), the residence of the physical person registered as the individual entrepreneur;
b) name of measuring instrument;
c) appointment and scope of measuring instrument;
d) nature of production of measuring instruments;
e) data on the software (in the presence);
e) the declared metrological characteristics, including accuracy indicators, and also technical characteristics of measuring instruments determining features of design of such measuring instruments for the purpose of preserving metrological characteristics in use;
g) data on regulating documents of state members according to which production of measuring instruments is performed;
h) information on need of recognition of approval of type state members according to the rules of mutual recognition of results of works on ensuring unity of measurements approved by the Eurasian economic commission;
i) operational documents.
8. The program of testing contains the following data:
a) name of object of testing;
b) quantity of the samples of measuring instruments represented on testing;
