About approval of the Regulations on licensing of activities for implementation of wholesale trade

1. Approve Regulations on licensing of activities for implementation of wholesale trade according to appendix.

2. Determine that:

the allowing certificates on the right of implementation of wholesale trade granted to business entities before entry into force of this resolution are effective before the expiration of their effective period;

the existing allowing certificates on the right of implementation of wholesale trade can be renewed in the license for implementation of wholesale trade without collection of the additional charges based on the submitted application of business entity and the allowing certificate on the right of implementation of wholesale trade. The term of renewal shall not exceed two working days;

after effective period of allowing certificates on the right of implementation of wholesale trade business entities obtain licenses for implementation of wholesale trade in accordance with the established procedure.

3. To provide to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, cities and areas till January 1, 2006 the organization of works on production of forms and issue of licenses for implementation of wholesale trade.

4. Provide to business entities whose effective periods of allowing certificates on the right of implementation of wholesale trade expired after September 21, 2005, the right of implementation of wholesale trade without license during the period from September 21 to January 1, 2006 without application of responsibility measures to them, stipulated by the legislation for occupation activities without license.

5. To impose control of execution of this resolution on the Deputy prime minister of the Republic of Uzbekistan Golyshev V. A.

Regulations on licensing of activities for implementation of wholesale trade

I. General provisions

1. This Provision determines procedure for licensing of activities for implementation of wholesale trade.

And also receipt of the license for implementation of wholesale trade is not required to the legal entities performing wholesale trade by separate types of goods based on other licenses according to the legislation by consumer goods on the open electronic tenderings of the commodity and raw exchanges.

2. Activities for implementation of wholesale trade are subject to licensing.

Wholesale trade realization of the purchased goods in non-cash form of calculations for their use is recognized commercial purposes or for own production and economic needs.

3. Only legal entities can be engaged in activities for implementation of wholesale trade.

4. On activities for implementation of wholesale trade standard (simple) licenses are granted.

5. Licensing of activities for implementation of wholesale trade is performed by khokimiyats of the cities (areas) in the place of state registration of the legal entity - the license applicant (further the licensing body).

6. For consideration by the licensing body of the statement of the license applicant collection in the amount of 50 percent of the basic settlement size established by the legislation is levied. The collection amount for consideration of documents for licensing is credited into the account of the licensing body.

7. For licensing the state fee in double size of the basic settlement size established by the legislation is collected. The amount of the state fee is credited in the republican budget.

8. The license for implementation of wholesale trade is granted for unrestricted term.

II. Licensed requirements and conditions

9. Licensed requirements and conditions on implementation of wholesale trade are:

compliance with law of the Republic of Uzbekistan, regulating activities for implementation of wholesale trade;

availability of certificates of conformity or data on certification of products at the manufacturing companies or their copy in case of sales of goods which are subject to obligatory certification.

III. Documents necessary for receipt of the license

10. For receipt of the license the license applicant submits the following documents to the licensing body:

a) the statement for licensing with indication of the name and form of business of the legal entity, the place of its stay (postal address), the name of organization of bank and the room of the settlement account in bank, the licensed type of activity;

b) copy of the certificate on state registration of the legal entity;

c) Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 03.05.2018 No. 323

d) the document confirming payment of collection for consideration by the licensing body of the statement for licensing.

11. The requirement from the license applicant of submission of the documents and other data which are not provided by this Provision is not allowed.

12. Documents are brought by the license applicant to the licensing body directly or through means of mail service with the notification on their obtaining.

13. The documents submitted for receipt of the license are accepted by the responsible person of the licensing body for the inventory which copy goes (is handed) to the license applicant with mark about date of documents acceptance.

IV. Consideration of the application and decision making about issue or about refusal in licensing

14. The term of consideration of documents and decision making about issue or about refusal in licensing for implementation of wholesale trade constitutes two working days from the date of receipt of the statement and all necessary documents for receipt of the license.

15. The licensing body notifies the license applicant on the made decision within one working day after adoption of the relevant decision.

The notification on decision making goes for licensing (is handed) to the license applicant in writing with indication of bank account details and payment due date of the state fee.

16. The license agreement is signed between the licensing body and the licensee and shall contain:

surname, name, middle name, post of persons which signed the agreement;

details of the parties;

the name of type of activity on which implementation the license is granted;
