About some measures for veterinary and sanitary certification when importing the products intended for feeding of animals

For the purpose of protection and ensuring welfare of animals by observance of the established requirements to the products intended for feeding of animals, and also reduction of the national legal system in compliance with the European legislation based on article 36 of the Law No. 221-XVI of October 19, 2007 on veterinary and sanitary activities (The official monitor of the Republic of Moldova, 2008, Art. No. 51-54, 153), with subsequent changes, and provisions of Decisions of the Commission No. 98/68/SE of September 10, 1998 by determination of the standard document provided by part (1) Article 9 of the Decision No. 95/53/SE of Council for setting standards of control in case of delivery in Community from the third countries of the products intended for feeding of animals (JO, 1998, L 261, DECIDES: p. 32-38), the Government

1. To the national agency on safety of foodstuff, the subordinated Government:

1) to develop technical requirements for the form of the veterinary sanitary certificate on import of the products intended for feeding of animals according to the provisions given in appendix to this Resolution;

2) to certify any change or deletion made in the veterinary sanitary certificate, otherwise it will be considered as invalid;

To issue 3) to the interested person on customs clearance station in case of entry into the country the veterinary sanitary certificate for import of the products intended for feeding of animals:

a) having set thus customs regime on the products imported from the countries, the performing these products, concerning their type, origin and geographical appointment and, if necessary, to carry out physical control, having specified in the veterinary sanitary certificate type performed and its results;

b) after carrying out selective check on identification of their type, origin and geographical appointment and, if necessary, selective physical controls of products which are directly coming from the exporting country and intended for delivery to free circulation;

c) in case of exit from free zone or customs warehouse to the products intended for delivery to free circulation;

4) to check observance of veterinary health requirements by the official veterinarian on customs veterinary and sanitary control post;

Not to allow 5) together with Customs Service to delivery to free circulation of the products intended for feeding of animals if the batch of products is not followed by the veterinary sanitary certificate completed according to the provisions given in appendix to this Resolution and also did not undergo the control which is carried out by the official veterinary health officer of customs veterinary and sanitary control post.

2. To the official veterinary health officer of customs veterinary and sanitary control post:

1) to check filling of the veterinary sanitary certificate on import of the products intended for feeding of animals according to the instructions installed on reverse side of the form of the veterinary sanitary certificate on import of the products intended for feeding of animals;

2) to check identity of batch of forages for animals;

3) to carry out physical control of forages for animals;

4) to perform selection and sending tests to authorized laboratory for laboratory testing and to establish analysis type;

5) to make selection and to perform sending tests to authorized laboratory for carrying out the begun laboratory tests and to establish analysis type;

6) to keep the veterinary sanitary certificate and the copy of laboratory results at least 18 months by delivery of forages for animals on the market.

3. The veterinary sanitary certificate accompanying imported goods shall:

1) to consist of one leaf;

2) to specify type performed and its results;

3) to be filled in state language of the imported country or in English with the certified translation into official language of the importing country;

4) to be issued on each part and to accompany the corresponding batch before its delivery to the market if the batch is divided into several parts;

To represent 5) to the Agency together with the verified copy for check of compliance of results of laboratory tests;

6) on reverse side to have instructions about procedure for filling of headings of the veterinary sanitary certificate for import of the products intended for feeding of animals.

4. This Resolution becomes effective in 3 months from the date of publication in the Official monitor of the Republic of Moldova.

5. To impose control of execution of this Resolution on the National agency on safety of foodstuff.
