1. Approve:

1.1. Procedure for creation and giving of requests for public information which manager is the National commission performing state regulation in the sphere of power and utilities which is applied.

1.2. Form for giving of request for receipt of public information by physical persons which is applied.

1.3. Form for giving of request for receipt of public information by legal entities and associations of citizens without the status of the legal entity which is applied.

2. Post this resolution on the official site of the National commission performing state regulation in the sphere of power and utilities.

3. Recognize invalid the resolution of the National commission performing state regulation in the sphere of power of February 23, 2012 as No. 118 "About approval of the Procedure for creation and representation of requests for public information which manager is the National commission performing state regulation in the sphere of power, and form for giving of request for the receipt of public information" registered in the Ministry of Justice of Ukraine on March 12, 2012 on No. 384/20697 (with changes) and the resolution of the National commission performing state regulation in the sphere of utilities from 03 February, 2012 No. 13 "About approval of the Procedure for creation and representation of requests for public information which manager is the National commission performing state regulation in the sphere of utilities, and forms for giving of request for receipt of public information" registered in the Ministry of Justice of Ukraine on February 22, 2012 on No. 281/20594.

4. In accordance with the established procedure to provide to legal department submission of this resolution on state registration in the Ministry of Justice of Ukraine.

5. This resolution becomes effective from the date of its official publication.

Procedure for creation and giving of requests for public information which manager is the National commission performing state regulation in the sphere of power and utilities

I. General provisions

1.1. This Procedure is developed according to the Law of Ukraine "About access to public information" (further - the Law) for the purpose of creation of mechanisms of realization of the right of everyone to access to public information.

The right to access to public information is guaranteed by the maximum simplification of the procedure of giving of request for receipt of public information.

1.2. In this Procedure terms are used in the values given in the Law.

1.3. Manager of public information according to the Law is the National commission performing state regulation in the sphere of power and utilities (further - NKREKP).

1.4. Access to public information of NKREKP is provided by provision of information on requests for receipt of public information.

1.5. Physical, legal entities and associations of citizens without the status of the legal entity, except subjects of powers of authority are requesting public information according to the Law when implementing of the functions by them.

1.6. The relations in the sphere of addresses of citizens are governed by the Law of Ukraine "About addresses of citizens".

II. Creation and representation of requests for public information

2.1. Requesting has the right to make in NKREKP inquiry for receipt of public information irrespective of whether this information concerns it personally or not, without explanation of the reason of giving of request.

2.2. The request for receipt of public information can be individual or collective.

2.3. The request for receipt of public information is sent in NKREKP in oral or written form during personal acceptance or by sending by mail, to the telefax, through the NKREKP official website, by e-mail or by phone at choice of requesting.

2.4. The written request on receipt of public information is sent in any form.

2.5. The request for information shall contain:

surname, name, middle name (name) requesting, the postal address, the e-mail address, number of the means of communication if that is available;

the general description of information or type, the name, details or contents of the document concerning which the request is made if asking it it is known;

the signature and date on condition of submission of the written request.

2.6. For the purpose of simplification of the procedure of execution of the written request requesting can use the forms for giving of request for receipt of public information approved by NKREKP (further - forms of requests).
