According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix No. 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of November 6, 2014 No. 200, the Board of the Eurasian economic commission solved:

Rules of information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the general register of owners of free warehouses";

Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the general register of owners of free warehouses";

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the general register of owners of free warehouses";

Procedure for accession to general process "Forming, maintaining and use of the general register of owners of free warehouses".

2. Determine that development of technical schemes of structures of the electronic documents and data provided by the Description approved by this Decision, and ensuring their placement in the register of structures of the electronic documents and data used in case of realization of information exchange in the integrated information system of foreign and mutual trade are performed by department of the Eurasian economic commission which competence includes coordination of works on creation and development of the integrated information system of the Eurasian Economic Union.

3. This Decision becomes effective after 90 calendar days from the date of its official publication.

Rules of information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the general register of owners of free warehouses"

I. General provisions

1. These rules are developed according to the following acts entering the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The decision of Board of the Eurasian economic commission of December 11, 2012 No. 271 "About forming of general registers of persons performing activities in the field of customs affairs, owners of free warehouses, residents (participants) free (special, special) economic zones";

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132"; 

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

II. Scope

2. These rules "Forming, maintaining and use of the general register of owners of free warehouses" (further – general process), including the description of the procedures performed within this general process are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process.

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"historical data" – information which is stored in the general register of owners of free warehouses from the moment of its forming and modification in which is not provided;

"the national register" – the register of owners of free warehouses which forming and maintaining are performed by customs authority of state member of the Union;

"condition of information object of general process" – property which characterizes information object at certain stage of its lifecycle and changes in case of accomplishment of transactions of general process.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

1. Purpose and tasks of general process

7. The purpose of general process is forming of the general register of owners of free warehouses and representation to participants of general process of information about legal entities of the general register of owners of free warehouses.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the Eurasian economic commission (further – the Commission) from authorized bodies of state members of the Union (further – state members) information on inclusion and exception of legal entities of the national register, suspension (renewal) of activities as the owner of free warehouse, and also about change of information about legal entities in the national register;

b) provide the automated forming of the general register of owners of free warehouses on the basis of information which arrived in the Commission and its publication on information portal of the Union;

c) provide submission of information about the legal entities included in the general register of owners of free warehouses through the integrated information system of foreign and mutual trade (further – the integrated system) for the purpose of use in information systems of authorized bodies of state members;

d) provide representation at the request of information systems of authorized bodies of state members with use of the services placed on information portal of the Union, the information about the legal entities included in the general register of owners of free warehouses.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of forming and maintaining the general register of owners of free warehouses;

b) procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of free warehouses;

c) procedures of representation to interested persons of information about the legal entities containing in the general register of owners of free warehouses.

11. In case of performing procedures of general process forming of the general register of owners of free warehouses based on the information about yuridicheky persons from the national registers received from authorized bodies of state members and also submission of information about the legal entities included in the general register of free warehouses, to authorized bodies of state members and interested persons is performed.

When forming the general register of owners of free warehouses procedures of inclusion and exception of information about legal entities of the general register of owners of free warehouses, and also changes of information about legal entities of the owners of free warehouses containing in the general register included in group of procedures of forming and maintaining the general register of owners of free warehouses are performed.

In case of representation to authorized bodies of state member of information about legal entities the following procedures of general process included in group of procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of free warehouses are performed:

receipt of information on date and time of updating of the general register of owners of free warehouses;

receipt of information about legal entities from the general register of owners of free warehouses;

receipt of information on the changes entered in the general register of owners of free warehouses.

In case of representation to interested persons of information about legal entities of the owners of free warehouses containing in the general register, the "Receipt of Information about Legal Entities from the General Register of Owners of Free Warehouses through Information Portal of the Union" procedure included in group of procedures of representation to interested persons of information about the legal entities containing in the general register of owners of free warehouses is performed.

12. The provided description of structure of general process is provided in the figure 1.

13. The procedure for performing procedures of general process, grouped according to the destination, including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language – Unified Modeling Language) and supplied with the text description.

4. Group of procedures of forming and maintaining the general register of owners of free warehouses

15. Performing procedures of forming and maintaining the general register of owners of free warehouses begins when obtaining by authorized body of state member of information on change (addition, exception) of the information about the legal entities containing in the national register.

When maintaining the national register in authorized body of state member uniqueness of registration document numbers about inclusion of information about legal entities in the national register according to requirements of the legislation of this state is provided.

In case of inclusion of information about legal entities in the national register the "Inclusion of Information about Legal Entities in the General Register of Owners of Free Warehouses" procedure is performed (P.CC.07.PRC.001).

In case of change of information about the legal entities in the national register declared in case of inclusion of legal entities in the general register of owners of free warehouses the "Change of Information about the Legal Entities Containing in the General Register of Owners of Free Warehouses" procedure is performed (P.CC.07.PRC.002).

In case of exception of information about legal entities of the national register the "Exception of Information about Legal Entities of the General Register of Owners of Free Warehouses" procedure is performed (P.CC.07.PRC.003).

If in the course of modification of the national register the registration document number, confirming inclusion of information about legal entities in the national register changes, that submission of information about legal entities is performed with use of 2 procedures: "Exception of information about legal entities of the general register of owners of free warehouses" (P.CC.07.PRC.003) and "Inclusion of information about legal entities in the general register of owners of free warehouses" (P.CC.07.PRC.001).

Submission of the specified data is performed in compliance sreglamenty information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the general register of owners of free warehouses", the approved Decision of Board of the Eurasian economic commission of November 1, 2016 No. 136 (further – Regulations of information exchange). 5. Group of procedures of representation of the states to authorized bodies

18. Procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of free warehouses are carried out in case of receipt of the corresponding request from information systems of authorized bodies of state members.

Within performing procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of free warehouses the following types of the requests arriving from information systems of authorized bodies of state members are processed:

request for submission of information on date and time of updating of the general register of owners of free warehouses;

request for submission of information about legal entities from the general register of owners of free warehouses;

request for submission of information on the changes entered in the general register of owners of free warehouses.

The request for submission of information on date and time of updating of the general register of owners of free warehouses is carried out by authorized body of state member for the purpose of assessment of need of synchronization of the information about the legal entities included in the general register of owners of free warehouses which is stored in information system of authorized body of state member with the information about legal entities which is containing in the general register of owners of free warehouses, stored in the Commission. When implementing request for submission of information on date and time of updating of the general register of owners of free warehouses the "Receipt of Information on Date and Time of Updating of the General Register of Owners of Free Warehouses" procedure is performed (P.CC.07.PRC.004).

The request for submission of information about legal entities from the general register of owners of free warehouses, is carried out for the purpose of obtaining by authorized body of state member of information about all legal entities included in the general register of owners of the free warehouses which are stored in the Commission. The information about legal entities containing in the general register of owners of free warehouses is requested or in full, taking into account historical data, or as of certain date and time. The request for submission of information about legal entities from the general register of owners of free warehouses is used in case of initial loading of information about legal entities in information system of upolnomomchenny body of state member. When implementing request for submission of information about legal entities from the general register of owners of free warehouses the "Receipt of Information about Legal Entities from the General Register of Owners of Free Warehouses" procedure is performed (P.CC.07.PRC.005).

In case of information request about the changes entered in the general register of owners of free warehouses the information about legal entities which was added to the general register of owners of free warehouses or to which changes since the moment specified in request until accomplishment of this request were made is represented. When implementing request for submission of information on the changes entered in the general register of owners of free warehouses the "Receipt of Information on the Changes Entered in the General Register of Owners of Free Warehouses" procedure is performed (P.CC.07.PRC.006).

19. The description of group of procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of free warehouses is provided in the figure 3.

6. Group of procedures of representation to interested persons of information about the legal entities containing in the general register of owners of free warehouses

21. Procedures of representation to interested persons of information about the legal entities containing in the general register of owners of free warehouses are carried out by means of use of information portal of the Union.

In case of submission of information about legal entities through information portal of the Union the web interface of this portal or services placed on this portal are used. When using the web interface, the user in window of the browser sets parameters of search and (or) unloading of information the about legal entities containing in the general register of owners of free warehouses, carries out work with information from the general register of owners of free warehouses provided in browser window.

When using the services placed on information portal of the Union, interaction is performed between information system of the interested person and information portal of the Union.

VI. Responsibility of participants of general process

25. Attraction to disciplinary responsibility for non-compliance with the requirements aimed at providing timeliness and completeness of transfer of the data participating in information exchange of officials and staff of the Commission is performed according to the Agreement on the Eurasian konomichesky union of May 29, 2014, other international treaties and acts constituting the right of the Union, and officials and the staff of authorized bodies of state members – according to the legislation of state members.
