About approval of the Regulations on the Commission on questions of consideration of materials about recognition by combatants in the Public fiscal service of Ukraine

According to article 6 of the Law of Ukraine "About the status of veterans of war, guarantees of their social protection", to the resolution of the Cabinet of Ministers of Ukraine of January 13, 1995 No. 16 "About application of Item 2 of article 6 of the Law of Ukraine "About the status of veterans of war, guarantees of their social protection" and to the Procedure for provision of participant status of fighting to persons who protected independence sovereignty and territorial integrity of Ukraine and were directly involved in anti-terrorist operation, ensuring its carrying out, to No. 413 approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 (with changes), I order:

1. Approve Regulations on the Commission on questions of consideration of materials about recognition by combatants in the Public fiscal service of Ukraine which are applied.

2. To department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Romaniuk Yu. P.) to provide in accordance with the established procedure:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

3. This order becomes effective from the date of its official publication.

4. To impose control of execution of this order on the Chairman of the Public fiscal service of Ukraine Nasirov R. M.

Regulations on the Commission on questions of consideration of materials about recognition by combatants in the Public fiscal service of Ukraine

I. General provisions

1. The commission on questions of consideration of materials about recognition by combatants in the Public fiscal service of Ukraine (further - the Commission) is created according to Item 5 of the Procedure for provision and deprivation of participant status of fighting to persons who protected independence, sovereignty and territorial integrity of Ukraine and were directly involved in anti-terrorist operation, ensuring its carrying out or in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 413 (with changes) (further - the Procedure).

2. The commission in the activities is guided by the Constitution of Ukraine, the laws of Ukraine, presidential decrees of Ukraine and acts of the Verkhovna Rada of Ukraine adopted according to the Constitution of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation and this Provision.

II. Main objectives and rights of the Commission

1. The commission is intended for decision making about provision (deprivation) of participant status of fighting, considerations and studying of the submitted applications and other materials which are the basis for provision of participant status of fighting to faces of the private and the commanding structure of divisions of operational providing anti-terrorist operation zones of the Public fiscal service Ukraine (GFS) which protected independence, sovereignty and territorial integrity of Ukraine and were directly involved in anti-terrorist operation, ensuring its carrying out, being directly in areas of anti-terrorist operation during its carrying out, in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation, being directly in areas and during implementation of the specified actions.

2. The commission has the right:

consider and study GFS provided by division managers of operational providing anti-terrorist operation zones (further divisions of ATO) certificates of direct participation of person in anti-terrorist operation, ensuring its carrying out and protection of independence, sovereignty and territorial integrity of Ukraine which form is established by appendix 1 to the Procedure, certificates of participation of person in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation which form is established by appendix 4 to the Procedure and other documents determined by the Procedure item 4 which are the basis for provision to citizens of participant status of fighting (further documents);

consider and study the addresses, documents and materials provided by faces of the private and the commanding structure of divisions of ATO, other staff of GFS which were directly involved in anti-terrorist operation in areas of its carrying out, ensuring its carrying out and protection of independence, sovereignty and territorial integrity of Ukraine or in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation, in case of non-presentation of the Commission of the documents necessary for provision of participant status of fighting, heads of such divisions;

in case of need to hear explanations of persons concerning which documents, and witnesses are submitted;

return documents to division managers of ATO for further completion;

refuse provision of participant status of fighting in case of lack of the bases;

make decisions on provision (deprivation) of participant status of fighting to faces of the private and the commanding structure of divisions of operational providing anti-terrorist operation zones of GFS.

3. The commission studies documents, in case of need hears explanations of persons concerning which they are provided, witnesses and in a month from the date of receipt of documents makes the decision on provision of participant status of fighting.

In case of absence in the documents submitted for consideration of the Commission, the bases for provision of participant status of fighting the Commission returns such documents for further completion.

4. In case of return by the Commission it is low-quality and incomplete the drawn-up materials the division manager of ATO finishes them and repeatedly sends the Commissions for consideration.
