About the Advisory committee on functioning of the domestic markets

According to Items 7 and 44of the Regulations on the Eurasian economic commission (appendix №1 to the Agreement on the Eurasian Economic Union of May 29, 2014) and for the purpose of realization of provisions of article 28 of the Agreement on the Eurasian Economic Union of May 29, 2014 the Board of the Eurasian economic commission decided:

1. Create the Advisory committee on functioning of the domestic markets.

2. Approve the enclosed Regulations on the Advisory committee on functioning of the domestic markets.

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Regulations on the Advisory committee on functioning of the domestic markets

I. General provisions

1. The advisory committee on functioning of the domestic markets (further – Committee) is created under Board of the Eurasian economic commission (further respectively – Board, the Commission) according to Items 7 and 44of the Regulations on the Eurasian economic commission (appendix №1 to the Agreement on the Eurasian Economic Union of May 29, 2014).

The committee is consultative body of the Commission on questions of functioning of the domestic markets of goods, services, the capital and labor power within the Eurasian Economic Union (further respectively – the domestic markets, the Union).

2. The committee in the activities is guided by the Agreement on the Eurasian Economic Union of May 29, 2014, other international treaties and acts constituting the right of the Union, the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, and also this Provision.

II. Main objectives and functions of Committee

3. The main objectives of Committee are:

a) preparation for the Commission of recommendations and offers on functioning of the domestic markets;

b) carrying out consultations with representatives of state members of the Union (further – state members) concerning functioning of the domestic markets.

4. For realization of the tasks assigned to it the Committee performs the following functions:

a) prepares for special-purpose advisory committees and departments of the Commission of the offer on the following questions:

creation and enhancement of the mechanism of monitoring of functioning of the domestic markets;

harmonization of the legislation of state members and enhancement of law-enforcement practice of state members for the purpose of elimination of barriers, withdrawals and restrictions in the field of functioning of the domestic markets;

b) considers and creates offers on the research works planned to development in the field of functioning of the domestic markets;

c) prepares for the Commission of the recommendation about the following questions:

rendering assistance to state members in settlement before appeal to the court of the Union of the disputes within the Union connected with functioning of the domestic markets, and also availability of barriers to mutual access to the domestic markets, withdrawals and restrictions on movement of goods, services, the capital and labor power;

project development of international treaties within the Union and other acts of the bodies of the Union providing functioning of the domestic markets;

information exchange between the Commission and public authorities of state members concerning functioning of the domestic markets;

d) prepares recommendations about the questions entering competence of Committee;

e) performs cooperation with representatives of business communities, scientific and public organizations of state members, other independent experts concerning functioning of the domestic markets;

e) performs other functions within the competence.

III. Structure of Committee

5. The structure of Committee is created of authorized representatives of public authorities of state members.

6. According to the offer of state members of Committee representatives of business communities, scientific and public organizations of state members, other independent experts are included.

7. State members timely represent to the Commission of the offer on modification of structure of Committee.

8. The structure of Committee affirms the order of Board.

9. Presides over committee meetings and the member of Board to whose competence questions of functioning of the domestic markets are carried (further – the chairman of Committee) performs the common directorship of work of Committee.

10. Chairman of Committee:

a) directs activities of Committee and will organize work on accomplishment of the tasks assigned to Committee;

b) approves the agenda of committee meeting, determines date, time and the place of its carrying out;

c) conducts committee meetings;

d) approves protocols of committee meetings;

e) informs Board and Council of the Commission on results of consultations and recommendations and offers on functioning of the domestic markets developed by Committee;

e) approves regulations on working (expert) groups and their structures;

g) appoints the responsible secretary of Committee;

h) performs other functions within competence of Committee.

11. The director of the department of the Commission to whose competence questions on activities of Committee are carried is appointed the vice-chairman of Committee.

12. The vice-chairman of Committee performs functions of the chairman of Committee, stipulated in Item the 10th this provision, in case of absence of the chairman of Committee or on its order.

13. The responsible secretary of Committee is appointed the chairman of Committee from among officials or the staff of the Commission to whose competence questions on activities of Committee are carried.

14. Responsible secretary of Committee:

a) prepares the draft of the agenda of committee meeting according to proposals of the chairman of Committee and members of the committee and submits it for approval to the chairman of Committee;

b) exercises control of preparation and representation of materials for committee meeting;

c) prepares and sends to members of the committee the approved agenda of committee meeting and materials to it;

d) informs members of the committee on date, time and the venue of committee meeting;

e) takes the minutes of Committee and submits it for approval to the chairman of Committee;
