1. Approve the Payment procedure of cash cover to families of the military personnel captured or hostages, and also interned in the neutral states or it is unknown absent which is applied.

2. To the Ministry of Defence, other central executive bodies performing management of the military forming created according to the laws and also to law enforcement agencies of special purpose, Administration of Public service of special communication and information security and Administration of the Public special service of transport in which positions are completed with the military personnel to perform recalculation of the amount of cash cover of the military personnel captured or hostages, and also interned in the neutral states or it is unknown absent, taking into account change of length of service and regulations of cash cover.

Payment procedure of cash cover to families of the military personnel captured or hostages, and also interned in the neutral states or it is unknown absent

1. This Procedure determines the payment mechanism of cash cover, including additional and other types of cash cover, to families of the military personnel of the Armed Forces formed according to the laws of other military forming and law enforcement agencies of special purpose, State special transservice and Gosspetssvyaz captured or hostages, and also interned in the neutral states or is unknown absent (further the military personnel).

2. In this Procedure it is necessary to understand the missing person in case of protection of the Fatherland of the serviceman concerning which more than 15 days there are no data on the place of its stay, except data on unauthorized leaving of military unit or the duty station as the term "it is unknown the absent serviceman".

3. For the military personnel payments in the amount of official pay rate for the last duty station, salary on military rank, length-of-service allowances, other monthly additional types of cash cover of permanent nature and other types of cash cover (further - cash cover) taking into account change of length of service and regulations of cash cover remain.

Cash cover is subject to indexation according to the law.

4. Payment of cash cover is performed from the date of taking of the military personnel in captivity or hostages, and also internments in the neutral states or losses without message, to members of families of the military personnel according to their statement addressed to the commander (the chief, the head) of military unit (organization, the organization).

Are enclosed to the application:

copies of pages of the passport of full age family members with data on surname, name, middle name and registration of the residence (stay);

the certificate of registration of the residence (stay) of family members (in case of lack of such information in the passport);

copy of the marriage certficate (in the presence);

copies of certificates of birth of children (in the presence);

the copy of the document certifying registration in the State register of physical persons taxpayers (for persons who on the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and reported about it to monitoring body and have mark in the passport, - the copy of the page of the passport with such mark).

5. The commander (the chief, the head) of military unit (organization, the organization) considers the submitted documents within 15 days and makes the decision on payment or refusal in payment of cash cover what it is reported to the applicant in writing about.

In the decision on refusal in payment of cash allowance the bases for such refusal are surely specified.

The commander (the chief, the head) of military unit (organization, the organization) makes the decision on refusal in payment in case:

the filing of application by persons which is not specified in Item 7 of this Procedure;

representations not in full the documents specified in item 4 of this Procedure;

filing of application with violation of the terms determined by paragraphs the sixth and seventh Item 6 of this Procedure;

examinations in the procedure for circumstances of voluntary surrender of the serviceman established by the legislation in captivity, unauthorized leaving of military unit (organization, the organization), duty stations or desertions.

Decision making about refusal in payment of cash allowance in connection with submission not in full of documents does not deprive of applicants of the right to address the commander (to the chief, the head) military unit (organization, the organization) repeatedly after elimination of the reasons which formed the basis for refusal in payment.

The decision on refusal in payment of cash cover can be appealed judicially.

6. Payment of cash cover is performed monthly based on orders of commanders (chiefs, heads) of military units (organizations, the organizations) to members of families:

the military personnel captured or hostages, interned in the neutral states - about day of their dismissal inclusive;

the military personnel, it is unknown absent, - about day of the introduction in legal force of the judgment about their recognition it is unknown absent or announcements the dead.

Payment of cash cover to members of families of the military personnel is performed before complete clarification of circumstances of taking of the military personnel in captivity or hostages, their internments or release, or their recognition in the procedure established by the law is unknown absent or died. In all cases payment of cash cover is performed no more than about day of exception of the serviceman of lists of staff of military unit (organization, the organization).

Payment of cash cover to members of families of the military personnel is performed in case the statement for its payment arrived in military unit (organization, the organization):

about day of release of the military personnel captured or hostages, interned in the neutral states;

within three years from the date of the introduction in legal force of the judgment about recognition of the military personnel it is unknown absent or announcements the dead, but not later than about day of the introduction in legal force of the judgment about cancellation of the decision on their recognition it is unknown absent or announcements the dead.
