1. Approve the enclosed Rules on withdrawal and destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion.

2. To provide to committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules on withdrawal and destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion

Chapter 1. General provisions

1. These rules on withdrawal and destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion are developed according to the subitem 4) of Item 1 of article 7 of the Law of the Republic of Kazakhstan "About plant quarantine" and determine procedure for withdrawal and destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion for the purpose of prevention of import and distribution of quarantine objects in the territory of the Republic of Kazakhstan.

2. If the infected quarantine products cannot be returned to the supplier, and disinfecting or conversion do not guarantee elimination of quarantine objects and there is danger of their penetration and distribution, these products are liable to withdrawal and destruction.

3. In case the owner of quarantine products disappeared or refused the quarantine products infected with quarantine objects, the questions connected with the procedure of storage, export, or destruction of quarantine products are solved local executive bodies of the corresponding administrative and territorial unit within one working day.

Chapter 2. Procedure for withdrawal and destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion on phytosanitary inspection stations

4. Withdrawal of the infected quarantine products (including from mailings, hand luggage and baggage) on phytosanitary inspection stations is performed by the state plant quarantine inspector, with creation of the act of withdrawal of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion in form according to appendix 1 to these rules (further - the act of withdrawal No. 1).

5. The state plant quarantine inspector within three working days from the moment of signing of the act of withdrawal No. 1 sends it (with appendix of the conclusion of phytosanitary examination of the condition of quarantine products (in the presence) issued by public institution "Republican center of plant quarantine" of Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan (further - authorized organization)) to the permanent commission on destruction of the infected quarantine products created by the order of the head (commission chairman) of territorial subdivision of department of authorized body on plant quarantine (further - territorial subdivision), as a part of officials of territorial subdivision, bodies of state revenues and authorized body in the field of environmental protection (further - the Commission on phytosanitary inspection stations).

6. Based on the act of withdrawal No. 1 the Commission on phytosanitary inspection stations:

1) makes the decision on destruction of the infected quarantine products;

2) performs measures for isolation and ensuring safety of the infected quarantine products;

3) the procedure for its destruction informs the owner of the infected quarantine products;

4) is determined with involvement of representatives of local executive body by the place and method of destruction of the infected quarantine products.

7. For the purpose of prevention of distribution of quarantine objects and possible plunder of quarantine products their storage is carried out in the specially allotted places determined by the Commission on phytosanitary inspection stations in coordination with bodies of state revenues.

8. Destruction of the infected quarantine products is performed by the Commission on phytosanitary inspection stations in the presence of its owner, in cases of the these rules of the representative of local executive body specified in Item 3.

9. The fact of destruction of the infected quarantine products within this Chapter is drawn up by the act of destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion in form according to appendix 2 to these rules (further - the act of destruction).

The statement of destruction is drawn up in four copies: the first - for territorial subdivision, the second - for body of state revenues, third - for authorized body in the field of environmental protection, the fourth - for the owner of quarantine products.
