1. Approve the enclosed Rules of purchase of goods and services of the organizations performing functions on protection of the rights of the child.

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction of copies of this order for official publication in information system of law of Ad_let and periodic printing editions on the electronic medium with appendix of the paper copy certified by official stamp;

3) within five working days from the date of receipt of the registered this order the direction it the copy in printing and electronic type, the confirmed seal of the Ministry of Education and Science of the Republic of Kazakhstan and the witnessed digital signature of person, representative to sign this order, for entering into Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

4) placement of this order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service and international cooperation of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of Education and Science of the Republic of Kazakhstan Sukhanberdiyeva E. A.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of purchase of goods and services of the organizations performing functions on protection of the rights of the child

Chapter 1. General provisions

1. These rules of purchase of goods and services of the organizations performing functions on protection of the rights of the child (further - Rules) establish procedure for purchase of goods and services by the organizations performing functions on protection of the rights of the child according to Item 1 of article 30 of the Law of the Republic of Kazakhstan of August 8, 2002 "About the child's rights in the Republic of Kazakhstan".

1-1. Acquisition of rights by the organizations performing functions on protection of the rights of the child, the goods and services relating to spheres of natural monopolies is performed by method from one source by the direct conclusion of the agreement.

Acquisition of uniform goods, services if the annual amount of such uniform goods, services in value term does not exceed the hundredfold size of the monthly settlement indicator established for the corresponding financial year by the law on the republican budget is performed according to the procedure, specified in Items 51-54 of these rules.

2. Purchase of goods and services by the organizations performing functions on protection of the rights of the child is made at suppliers of goods and services, the being legal entities or physical persons specializing in rendering certain service or delivery of goods.

3. In Rules the following concepts are used:

1) the potential supplier - the physical person performing business activity, the legal entity (except for public institutions if other is not established for them by the laws of the Republic of Kazakhstan), temporary consolidation legal entities (consortium), the service provision agreements applying for the conclusion or contracts of delivery of goods and having material, financial and the manpower sufficient for obligation fulfillment according to the service provision agreement or deliveries of goods;

2) the Internet - resource - the electronic information resource displayed in text, graphical, audiovisual or other type, placed on the hardware and software, having the unique network address and (or) domain name and functioning on the Internet;

3) the contest committee - the collegiate organ created by the organizer of tender for carrying out tender;

4) the tender documentation - documentation submitted to the potential supplier for preparation of the bid which contains requirements to the bid, conditions and procedure for carrying out tender;

5) the procedure of the organization and carrying out tender - complex of the interconnected, consecutive actions performed by the organizer of tender, the relevant commission according to these rules for the purpose of the conclusion with the potential supplier of the service provision agreement or delivery of goods;

6) the organizer of tender (customer) - the organization performing functions on protection of the rights of the child, performing social support, rendering social, medico-social, social and pedagogical, psychology and pedagogical, legal services and financial support, social resettlement of the children needing special social services, employment of such children of working-age on reaching them;

7) criteria of the choice of the supplier of service - signs based on which assessment of opportunities and conditions on rendering service by the potential supplier is made;

8) financial year - the period of time which is beginning on January 1 and coming to an end on December 31 calendar year;

9) the supplier - the physical person performing business activity or the legal entity who signed the service provision agreement or deliveries of goods;

10) the expert - the physical person having special and (or) technical knowledge, experience and qualification in the field of the held competition, the confirmable relevant documents (diplomas, certificates, certificates and other documents), attracted by the organizer of tender to participation in development of the specification to the tender documentation at the choice of the service provider and goods of the organizations performing functions on protection of the rights of the child and (or) preparation of the expert opinion concerning compliance of proposals of potential suppliers to the specification of acquired goods and services;

11) criteria of the choice of the supplier of goods - signs based on which assessment of opportunities and delivery conditions of goods the potential supplier is made;

12) purchase of goods and services - acquisition by the customer of goods and services according to the procedure, established by these rules;

13) the agreement - the civil service provision agreement or deliveries of goods concluded between the customer and the supplier.

Chapter 2. Procedure for purchase of goods and services of the organizations performing functions on protection of the rights of the child
