About approval of the Regulations on the organization and functioning of the National agency of the public assistance, its structure and the extreme number of staff

1. Create the National agency of the public assistance – the administrative authority subordinated to the Ministry of Health, work and social protection.

2. Approve:

Regulations on the organization and functioning of the National agency of the public assistance according to appendix No. 1;

Structure of the National agency of the public assistance according to appendix No. 2;

The list of the public organizations managed by the National agency of the public assistance in which health cares, work and social protection is founder, according to appendix No. 3.

3. Establish the extreme number of staff of the National agency of the public assistance in quantity of 23 units including 2 units of technicians.

4. To perform expenses on the organization and functioning of the National agency of the public assistance for the account and within the assignments provided in the government budget and also from other sources, according to the current legislation, within the number of staff approved for the ministries and subordinated organizations.

5. In the Order of the Government No. 691 of November 17, 2009. "About approval of the Regulations on the organization and functioning of the Ministry of Health, work and social protection, structure and extreme number of its central office" (Official monitor of the Republic of Moldova, 2009, Art. No. 166-168, 769), with subsequent changes and amendments, to make the following changes and additions:

Regulations on the organization and functioning of the National agency of the public assistance

I. General provisions

1. The regulations on the organization and functioning of the National agency of the public assistance (further – the Provision) establish legal position, mission, the main functions, powers and common laws of the National agency of the public assistance (further – the Agency).

2. The agency is the administrative authority subordinated to the Ministry of Health, work and social protection, with the location in municipium of Chisinau.

3. The agency has the status of the legal entity of the public law, has treasurer accounts, the letterhead, seal with the image of the State Emblem and the name.

4. The agency has own web page.

5. The agency keeps the State register of personnel in social security system (personnel of the decentralized divisions subordinated to regional/local government boards, People's assembly of autonomous territorial education Gagauzia, with powers in the sphere of the public assistance, and personnel of services of the public assistance, except for support personnel) according to the Law No. 71-XVI of March 22, 2007 on registers.

6. The agency performs activities on the basis of the following principles:

1) universality of the right to the public assistance;

2) social solidarity;

3) access to the public assistance, with respect for equality of chances and without discrimination;

4) single approach to the legislation in the field of the public assistance;

5) confidentiality and personal data protection;

6) continuity of measures of the public assistance for beneficiaries;

7) transparency and accountability of the public;

8) cooperation and social partnership.

II. Mission, main functions, powers and common laws of the Agency

7. The mission of the Agency consists in improvement of quality of the public assistance provided to the population by means of realization of state policy in the field of the public assistance.

8. In the activities the Agency performs the following main functions:

1) development of methodological base for uniform application of the legislation in the field of the public assistance;

2) management of activities of public organizations in which the Ministry of Health, work and social protection is founder (further – organizations of the public assistance and rehabilitation/recovery), listed in appendix No. 3 to this resolution;

3) assistance to process of consolidation of professional potential of personnel in social security system;

4) management of financial resources for financing of programs of special purpose in the field of the public assistance and the minimum packet of social services.

9. The agency performs the following main powers:

1) for the purpose of development of methodological base for uniform application of the legislation in the field of the public assistance:

a) advises bodies of local public authority of the first and second levels, public and private suppliers of social services in questions of the public assistance;

b) studies and extends the best practices of the country, and also foreign in the field of the public assistance;

c) performs monitoring and assessment of implementation of fundamental standards of activities of territorial structures of the public assistance and constitutes reports on monitoring which submits to the Ministry of Health, work and social protection;

d) Gagauzia, with powers gives methodological support in area of the public assistance to the decentralized divisions subordinated to regional/local government boards, People's assembly of autonomous territorial education in the sphere of the public assistance (further – territorial structures of the public assistance);
