Procedure for the direction on retraining and payments of grants to persons registered in employment service during professional training, advanced training and retraining

1. According to the Law of the Republic of Uzbekistan "About employment of the population" the state guarantees to the citizens who lost work, for the first time looking for it and also persons interested to renew labor activity after long break free training of new profession, advanced training in the specialized centers of education system and Public service of employment or other educational institutions with payment of grant and inclusion of this period in general continuous working life.

2. Professional training, advanced training and retraining of persons registered in Public service of employment in quality of persons who are looking for work can be performed in cases if:

it is impossible to pick up suitable work because of absence at the unemployed of necessary professional qualification;

it is necessary to change qualification due to the lack of the work answering to the professional skills which are available for the unemployed;

the capability to performance of work by former profession is lost. Professional training, advanced training and retraining of citizens are performed in the directions of Public service of employment in educational institutions at the expense of the means provided on these purposes in Fonda of employment assistance (Article 25).

The unemployed who showed voluntary willingness on acquisition of new profession submit the application for voluntary desire to change profession (specialty).

3. To the persons who addressed and registered on employment exchange as looking for work and needing retraining, advanced training, the district (city) employment exchange issues the direction in the city (regional) center for preparation and advanced training of personnel, professional orientation and retraining of the released and idle men, or in other educational institution with which there is provisional agreement (contracts) for retraining of directed.

4. Persons which arrived to training center to training shall submit the following documents:

the direction for study, the passport, the service record, the document certifying profession (specialty) and qualification (the direction is applied).

On completion of training of person represent to employment exchange the return back according to the enclosed form (the form is applied).

The employment exchange which directed the unemployed to retraining transfers money in accordance with the established procedure into the settlement account of training center or other educational institution according to the agreement on training cost.

Money on transportation expenses and daily allowance is paid personally to the unemployed directed by employment exchange to retraining.

5. The grant is paid to listeners by monthly training center (institution) where training is provided.

Funds for grant are monthly transferred by employment exchange according to its size for each trainee of the unemployed.

The sizes of grants are established personally to each unemployed according to the Law "About Employment of the Population" (Article 28).

To persons who lost work and earnings (labor earnings), except persons listed in Article 27 of the Employment act of the population, registered in Public service of employment, having minor children and other dependents, during professional training, advanced training or retraining the grant in the amount of at least 75 interests (not having dependents - 50 percent) their average monthly salary still to place of employment is paid, but it is not lower than minimum wage, the Republic of Uzbekistan established by the legislation, and not above the average salary which developed in the republic.

For example: If trained (listener) in the place of former work received the salary on average of 800 rub a month, then the grant to it will be established in the amount of 600 rub (75%) for the available children and other dependents, but not having them - 550 rub (50% make 400 rub, minimum wage - 550 rub).

According to Article 28 of item 2:

To persons dismissed for violation of labor discipline, and also long time not working, for the first time looking for work and needing professional training, advanced training and retraining, the grant is appointed at a rate of not less than the unemployment benefit provided for this category of the population and it is not higher than minimum wage, established in the Republic of Uzbekistan.

6. For the workers released from the companies from organizations, the organizations in connection with their liquidation, reorganization, reducing the number (states) registered in Public service of employment within ten days and undergoing professional training or advanced training with separation from production on new place of employment for the entire period of training the average salary on the previous work remains. In case of calculation of taxable basis of the companies, organizations, organizations it decreases by the amount of the funds allocated for professional training, advanced trainings or retraining of workers.

In cases when for employment of the released worker preliminary advanced training or retraining are required, and the company, organization, the organizations did not give it such opportunity, advanced training or retraining is made at the expense of the company, organization, the organization on the conditions stated above in this Item (Art. 27 of the item 2).

Public service of employment can compensate fully or partially to the companies, organizations, the organizations of costs for the organization of training of the employed persons released from other companies from organizations, the organizations (Art. 27 of the item 3).

The total compensation of costs of funds for training of specified persons can be performed only in year of commissioning of the newly created and organized companies, the organizations which do not have funds for training.

The partial compensation (no more than 50%) can be provided for the companies, the organizations which reached the limit of funds for training by the time of acceptance of workers.

7. To the persons which did not arrive to study, who are not attending class, not in time or disturbing labor discipline and the public peace, heads of training center (educational institution) with the assistance of the representative of body of the Employment service resolve issue of further continuation of training.

8. If the trainee did not pass the qualification examinations (offsettings) provided by the training program because of weak knowledge, skills, with him additional classes are given and qualification examinations (offsettings) without payment of grant are held.

9. After the successful end of training and receipt of the corresponding certificate the graduate of training center shall be in the employment exchange which directed it which will render him assistance in employment by the new profession (specialty) received by it.

10. Persons recognized as the unemployed after completion of professional training and retraining with separation from production, have the right to unemployment benefit at a rate of not less than the Republic of Uzbekistan of minimum wage established by the legislation.
