About payment of the allowances connected with mobile and traveling nature of works at the companies in the organizations and organizations, irrespective of type of activity and patterns of ownership

Due to the changing payment terms of work and according to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 29.04.92 the No. 210 Ministry of Labour of the Republic of Uzbekistan decides:

1. Approve the Regulations on payment of the allowances connected with mobile and traveling nature of works at the companies approved with the Ministry of Finance of the Republic of Uzbekistan in the organizations and organizations, irrespective of type of activity and patterns of ownership.

2. Due to the acceptance of the specified Provision to the companies, the organizations and organizations to make changes to the departmental acts determining payment procedure and the size of allowances for mobile and traveling nature of works of workers in the territory of the Republic of Uzbekistan.

Regulations on payment of the allowances connected with mobile and traveling nature of works at the companies in the organizations and organizations irrespective of type of activity and patterns of ownership

1. The allowance for mobile kind of work is established to workers for the purpose of compensation of the heavy consumptions connected with movement of workers or isolation from the permanent residence in connection with business necessity (when daily return of workers to the permanent address cannot be provided).

2. The allowance for traveling nature of works is established:

- to the workers performing works on the objects located at considerable distance from the company location in connection with trips to time off from the location of the company (assembly point) to place of employment on object and back;

- to workers whose permanent job proceeds in transit or has traveling nature of works.

3. Feasibility of mobile and traveling nature of works is determined by the customer and the contractor in case of the conclusion of agreements.

The additional costs of the company connected using mobile and traveling nature of works join in estimates in case of determination of the price of works, services.

4. The allowance for mobile and traveling nature of works is paid to workers for actually worked time and if they are in employment relationships with the company.

5. The customer is granted the right of control of correctness of use of the funds allocated for payment of allowances for mobile and traveling nature of works. In case of non-compliance with conditions of this Provision the customer can demand change (recalculation) of the size of additional costs if other is not stipulated by the agreement.

6. Allowances for mobile and traveling nature of works are not assessed with tax and not considered in case of calculation of average earnings.

7. The allowance is paid to workers for calendar days of work on the remote objects (production sites of works) when under the terms of the message and to nature of the performed work they have no opportunity daily to return to the permanent address, and for the actual days of stay in transit from the location of the company (assembly point) to place of employment and back for mobile nature of works.

For days of stay the day tariff charge (salary) at the rate of the normal duration of the working day established at the company is in transit paid.

Days of stay in transit to place of employment and back do not join in regulation of working hours.

8. Payment of the allowance, stipulated in Item the 7th this provision, is made to the worker and for days of temporary disability out of the permanent address on which the sick leave note is issued.

9. The allowance is not paid for mobile nature of works:

- to workers for the time spent on leave and on sanatornokurortny treatment and for days of absence from work without reasonable excuse;

- to persons passing alternative service in the territory of the Republic of Uzbekistan;

- to the workers performing works as shift method.

10. In case of departure of the worker in business trip out of limits of the area of works payment of the allowance to it stops, and the expenses connected with business trip are paid according to the legislation on official journeys.

11. The allowance for mobile nature of works on all territory of the republic is estimated at the rate to 30% to the tariff charges, official pay rates (without coefficients and surcharges) established at the company. The specific size of the allowance for mobile nature of works is established according to the signed collective agreement (employment contract). The size of the allowance shall not exceed the minimum wage established in the territory of the republic per month.

When the allowance added to workers for mobile nature of works is lower than the size established in limiting this Item, the administration of the company has the right to increase at the expense of own means (without increase in contract price) the allowance size to limit.

12. For the purpose of expense recovery of workers whose permanent job proceeds in transit or has traveling nature, and also in case of office trains within the sites served by them, the allowance in the following sizes is paid:

a) in case of the traveling connected with performance of works in transit - percent 1,5, and to the workers serving passenger trains, pochtovobagazhny trains, dining-cars (cafe buffets) in passenger trains and mail vans - 3 percent of the monthly tariff charge or official pay rate per day;

b) to workers, if they are in traveling of 12 and more days in month - 20 percent of monthly official pay rate (tariff charge) and if less than 12 days a month - 1,5 of percent of monthly official pay rate (tariff charge) per day;

c) in cases when trips to time off from the company location (its division) or the assembly point to place of employment and back in day constitute at least 3 hours, the allowance for traveling nature is established at the rate to 20 percent of the monthly tariff charge (salary), and at least 2 hours - to 5 percent of the monthly tariff charge (salary). The specific size of the allowance is established according to the signed collective agreement (employment contract);

d) the allowance in 1,5 sizes and 3 interests for every day is paid from the moment of departure before return to the location of the company in which the worker works. At the same time time spent by workers in the train (except for the workers serving local trains), the constituting more than 12 hours, but less complete days, is considered as one days.

The specified allowance is paid to heads, specialists and employees of departments and linear economic organizations of the railroads in case of incomplete days when the trip proceeded more than 12 hours within two calendar days: in this case the allowance is charged in one days.

Payment of the allowance is made in proportion to the actual number of days of trips to place of employment and back.

The allowance size in all cases shall not exceed the minimum size of the salary established in the republic per month.
