Some questions of the Ministry of the defense and aerospace industry of the Republic of Kazakhstan

1. Form Committee on information security of the Ministry of the defense and aerospace industry of the Republic of Kazakhstan.

2. Approve enclosed:

1) Regulations on the Ministry of the defense and aerospace industry of the Republic of Kazakhstan (further - the Provision);

2) changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan.

3. Rename:

1) Space committee of the Ministry for Investments and Development of the Republic of Kazakhstan in Space committee of the Ministry of the defense and aerospace industry of the Republic of Kazakhstan;

2) Committee on the state material reserves of the Ministry of national economy of the Republic of Kazakhstan in Committee on the state material reserves of the Ministry of the defense and aerospace industry of the Republic of Kazakhstan.

4. Rename republican legal entities according to appendix 1 to this resolution.

5. Determine the Ministry of the defense and aerospace industry of the Republic of Kazakhstan authorized body by management of the corresponding industry (sphere) of public administration concerning the republican legal entities specified in item 4 of this resolution.

6. Deliver in trust management to the Ministry of the defense and aerospace industry of the Republic of Kazakhstan blocks of shares of joint-stock company "Kazakhstan Engineering.

7. To committee of state-owned property and privatization of the Ministry of Finance of the Republic of Kazakhstan and the Ministry of the defense and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

To transfer 1) to the Ministry of the defense and aerospace industry of the Republic of Kazakhstan and its departments of right of possession and use of the state blocks of shares (shares) of legal entities according to appendix 2 to this resolution;

2) together with the Ministries of Defence of the Republic of Kazakhstan, national economy of the Republic of Kazakhstan, on investments and development of the Republic of Kazakhstan, information and communications of the Republic of Kazakhstan to take other measures following from this resolution.

8. To the ministry of the defense and aerospace industry of the Republic of Kazakhstan together with joint-stock company "National welfare fund "Samruk-Kazyna" (in coordination) to take the necessary measures following from Item 6 of this resolution.

9. This resolution becomes effective from the date of its signing.

Regulations on the Ministry of the defense and aerospace industry of the Republic of Kazakhstan

1. General provisions

1. The ministry of the defense and aerospace industry of the Republic of Kazakhstan (further – the Ministry) is the state body of the Republic of Kazakhstan performing management in spheres of the defense, aerospace and electronic industry, ensuring information security in the sphere of informatization, mobilization preparation and mobilization, forming and development of the state material reserve, participation in carrying out single military and technical policy and military and technical cooperation, management in the field of forming, placement and accomplishment of the defensive order.

15. Tasks:

1) forming and realization of state policy in the field of the defense, aerospace and electronic industry, ensuring information security in the sphere of informatization, mobilization preparation and mobilization, forming and development of the state material reserve;

2) cross-industry coordination of state bodies in the field of activity carried to competence of the Ministry;

3) public administration and the state control in regulated spheres;

4) providing, within the competence, control of compliance with law of the Republic of Kazakhstan;

5) participation in carrying out single military and technical policy and military and technical cooperation, management in the field of forming, placement and accomplishment of the state defensive order;

6) forming and development of space industry of the Republic of Kazakhstan;

7) creation of conditions for market grouping of space technologies and services;

16. Functions of central office:

1) ensuring forming and realization of state policy in regulated spheres;

2) implementation of strategic, regulating, realizable and control and supervising functions;

3) development, coordination with authorized body in the sphere of permissions and notifications and acceptance of regulatory legal acts about approval of qualification requirements and the list of the documents confirming compliance to them in regulated spheres;

4) implementation of international cooperation in regulated spheres;

5) development and approval together with authorized body on entrepreneurship of checking sheets, criteria for evaluation of risk degree according to the Entrepreneurial code of the Republic of Kazakhstan;

6) development and approval according to the Entrepreneurial code of the Republic of Kazakhstan of semi-annual schedules of conducting checks;

7) implementation of counteraction to terrorism within the competence established by the legislation of the Republic of Kazakhstan;

8) development, coordination and approval within the competence of regulatory legal acts of regulated spheres;

9) implementation of cross-industry coordination in regulated spheres;

10) presentation in courts of claims according to the legislation of the Republic of Kazakhstan;
