Based on part 1) Articles 11, Item c) parts (1) Articles 27, Item and) and b) Article 51 and article 52 of the Law on National Bank of Moldova No. 548/1995 (repeated publication: Monitorul Oficial al Republicii Moldova, 2015 No. 297-300, of the Art. 544), with subsequent changes, parts (10) Article 43 and based on article 67 of the Law on currency control No. 62/2008 (Monitorul Oficial al Republicii Moldova, 2008, No. 127-130, the Art. 496), with subsequent changes, the Executive committee of National Bank of Moldova DECIDES:

1. Approve the Instruction about procedure for submission of reports to National Bank of Moldova by exchange currency cashes and hotels according to appendix to this resolution.

2. Submission of the first reports according to the instruction specified in Item 1 of this resolution is performed as follows:

a) reports according to provisions of appendices No. 1 and No. 2 to the mentioned instruction shall be provided for reporting day on December 12, 2016;

b) reports according to provisions of appendices No. 3 and No. 4 to the mentioned instruction shall be provided for month under report December, 2016.

3. This resolution becomes effective on December 10, 2016.

Chapter I. General provisions

1. In this instruction the concepts determined by the Law on currency control No. 62/2008 are used (pereopublikovan in Monitorul Oficial al Republicii Moldova, 2016, Art. No. 423-429, 859), with subsequent changes.

2. This instruction regulates procedure for creation and representation to National Bank of Moldova by exchange currency cashes and hotels of the following reports:

a) the report on buying rates and selling rates of the principal foreign currencies established by exchange currency cash, provided in appendix No. 1;

b) the report on buying rates of the principal foreign currencies established by hotel, provided in appendix No. 2;

c) the report on the exchange currency transactions performed by exchange currency cash, provided in appendix No. 3;

d) the report on the exchange currency transactions performed by hotel, provided in appendix No. 4.

3. The reports specified in Item 2 (further – reports), are constituted by exchange currency cashes and hotels according to the forms and procedure for their creation provided in appendices No. 1 – No. 4 and are represented to National Bank of Moldova for the purpose of the analysis of situation in the foreign exchange market of the Republic of Moldova, and also supervision of activities of the specified organizations for currency exchange.

4. If in the report the code of national currency / foreign currencies be specified, their digital codes according to the international standard ISO 4217 "Codes for representation of currencies and funds" are specified.

Chapter II. Terms of submission of reports

5. Exchange currency cashes and hotels lasting working day of up to 12 hours constitute and submit in National Bank of Moldova the reports specified in subitems and) and b) Item 2, daily (except for non-working days) as follows:

1) the first report for reporting day (which reflects the buying rates and sales established by exchange currency cash for the beginning of the working day in case of hotel - buying rates) - no later than 10:00 reporting day;

2) the second report for reporting day (which reflects change during the working day of buying rates and sale by exchange currency cash, in case of hotel - buying rates):

a) no later than 16:00 reporting day - if the exchange currency cash or hotel changed the mentioned courses till 16:00 reporting day, or

b) within 30 minutes since the moment (hour and minutes) when buying rates and sales become applicable – if the exchange currency cash or hotel changed the mentioned courses after 16:00 reporting day.

6. Exchange currency cashes and hotels lasting working day constitute more than 12 hours and submit in National Bank of Moldova the reports specified in subitems and) and b) Item 2, daily (except for non-working days) as follows:

1) the first report for reporting day (which reflects the buying rates and selling rates established by exchange currency cash for the beginning of the working day in case of hotel - buying rates) - no later than 10:00 reporting day;

2) the second report for reporting day (which reflects change during the working day of buying rates and sale by exchange currency cash, in case of hotel - buying rates):

a) no later than 16:00 reporting day - if the exchange currency cash or hotel changed the mentioned courses till 16:00 reporting day, or

b) within 30 minutes since the moment (hour and minutes) when buying rates and sales become applicable – if the exchange currency cash or hotel performed the first change of the mentioned rates after 16:00 reporting day;

3) the third report for reporting day (which reflects the second change during the working day of buying rates and sale by exchange currency cash, in case of hotel - buying rates) – within 30 minutes since the moment (hour and minutes) when buying rates and sales become applicable – if the exchange currency cash or hotel performed the second change of the mentioned rates.

7. If reporting day is short working day, the reports specified in Item and) the subitem 2 of Item 5 and in Item and) the subitem 2 Items 6, are represented no later than 15:00 this reporting day.
