According to the Resolution of Jogorku Kenesh of the Kyrgyz Republic "About structure of the Government of the Kyrgyz Republic" of April 13, 2016 No. 439-VI, articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve:

- Regulations on the Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic according to appendix 1;

- the scheme of management of the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic according to appendix 2.

2. Determine that the Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic is legal successor of the Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic.

3. Form:

- Department of quarantine of plants of the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic with transfer from the State inspectorate for veterinary and phytosanitary safety under the Government of the Kyrgyz Republic:

functions of phytosanitary quarantine control of plants;

31 established posts, with the corresponding budget financing (in all respects expenses) and material and technical resources.

4. Approve:

- Regulations on Department of quarantine of plants of the Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic according to appendix 3;

- Regulations on Department of chemicalixation and protection of plants of the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic according to appendix 4.

5. Reorganize:

- The state center for testing of grades and genetic resources of plants of the Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic, Republican state seed inspection of the Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic and the Center of examination of grain of the Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic by merge in Department on examination of crops of the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic;

9. Bring in the order of the Government of the Kyrgyz Republic "About the extreme number of staff of the ministries, administrative departments and other state bodies of the Kyrgyz Republic" of August 22, 2011 No. 473 the following changes:

in appendix 1 to the above-named resolution:

in Item 6 of figure "369" and "176" to replace with figures "367" and "174" respectively;

- in Item 7 of figure "5337", "82", "5070" and "185" to replace with figures "5396", "94", "5049" and "253" respectively;

- in Item 20 of figure "2256" and "2055" to replace with figures "2230" and "2029" respectively;

- in Item 34 of figure "1232" and "865" to replace with figures "1201" and "834" respectively.

10. Bring in the Order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of May 7, 2013 No. 256 the following changes and amendment:

in Regulations on the State inspectorate for veterinary and phytosanitary safety under the Government of the Kyrgyz Republic approved by the above-stated resolution:

- in Item 5 of the word "the populations, protection of plant and animal life" shall be replaced with words "people, animals and plants";

- state Item 6 in the following edition:

"6. Tasks of State inspection are:

- the prevention, identification and suppression of violations of the legislation of the Kyrgyz Republic by physical persons and legal entities in the field of veterinary science, requirements to safety of products established by technical regulations and also products which are subject veterinary and to phytosanitary quarantine control and the veterinary medicines which are in circulation in the territory of the Kyrgyz Republic;

- prevention and suppression of abuses of regulations of obligatory confirmation of conformity of products;

- consumer protection of subsupervising products;

- protection of the territory of the Kyrgyz Republic from drift and/or distribution in its territory of infectious diseases of animals.";

- in the subitem 1 of Item 7:

in the paragraph the second to exclude the words "and plants";

in paragraph seven of the word "and to phytosanitary" to exclude;

paragraphs the eighth, the sixteenth, seventeenth and eighteenth to recognize invalid;

add with the paragraph the nineteenth the following content:

"-supervision of observance of the quarantine phytosanitary modes and program implementation on localization and liquidation of quarantine harmful organisms in the established quarantine phytosanitary zones.";

- in paragraphs the second and seventh the subitem 2 of Item 7 of the word "and phytosanitary", "and to phytosanitary" respectively to exclude;

12. Bring in the Order of the Government of the Kyrgyz Republic "About approval of the Register of the allowing documents issued by executive bodies and their structural divisions" of February 25, 2004 to No. 103 the following changes and amendment:

in the Register of the allowing documents issued by executive bodies and their structural divisions, approved by the above-stated Resolution:

- in the Section "Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic":

in the name of the word "Ministry of Agriculture and Land Reclamation" shall be replaced with words "The Ministry of Agriculture, the food industry and melioration";

to state the name of the subsection "Department of Chemicalixation, Protection and Quarantine" in the following edition:

add with subsection of the following content:

13. Bring in Resolution of the Government of the Kyrgyz Republic "About approval of Provisional regulations for licensing of production and turnover of ethyl alcohol, production and turnover (storage for the purpose of production or realization, wholesale and retail sale) alcoholic products" of May 27, 2015 No. 327 the following change:

- in Provisional regulations for the licensing of production and turnover of ethyl alcohol, production and turnover (storage for the purpose of production or realization, wholesale and retail sale) alcoholic products approved by the above-stated Resolution:

state Item 2 in the following edition:

"2. Licensor is: Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic.".

14. Bring in Resolution of the Government of the Kyrgyz Republic "About questions of the Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic" of February 20, 2012 No. 140 the following changes:

- declare Item 1 invalid;

- in all text of the word "Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic" in different cases shall be replaced with words "The Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic" in the corresponding cases;

- in Item 3:

in paragraph one the word of "sanitary" to exclude;

third to declare the paragraph invalid;

- the fifth item 4 to declare the paragraph invalid.

15. To the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic:

- together with the Ministry of Economics of the Kyrgyz Republic, the State inspectorate for veterinary and phytosanitary safety under the Government of the Kyrgyz Republic and the State Tax Administration under the Government of the Kyrgyz Republic:

in week time to form the interdepartmental commissions for reception-transmission in accordance with the established procedure of budget financing and material equipment;

in a month to bring the decisions into accord with this Resolution;

take the necessary measures following from this Resolution;

- in a month to submit for approval of the Government of the Kyrgyz Republic of regulations on subordinated divisions of the Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic;

- hold the relevant activities connected with reorganization;

- in three-months time to approve transfer acts of the reorganized organizations specified in Item 5 of this resolution;

- the paragraph the ninth Item 15 ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 04.07.2017 No. 420

- resolve issues of employment of workers and transfer of financial material values according to the legislation of the Kyrgyz Republic.

16. To the Ministry of Finance of the Kyrgyz Republic, the Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic, the Ministry of Economics of the Kyrgyz Republic, State inspectorate for veterinary and phytosanitary safety under the Government of the Kyrgyz Republic, the State Tax Administration under the Government to the Kyrgyz Republic in accordance with the established procedure to make changes to estimate appointments of 2016 within the approved amount of financing.

17. Recognize invalid:

- item 4 of the Order of the Government of the Kyrgyz Republic "About development of breeding livestock production in the Kyrgyz Republic" of March 18, 2013 No. 138;

- Item 3 of the Order of the Government of the Kyrgyz Republic "About further support of breeding livestock production of the Kyrgyz Republic" of April 11, 2014 No. 211;

- the paragraph the forty fifth Item 2 of the Order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic "About questions of the Ministry of Agriculture and Land Reclamation of the Kyrgyz Republic of February 20, 2012 No. 140" of June 19, 2015 No. 381;

- Item 2 of the Order of the Government of the Kyrgyz Republic "About approval of the Charter of the state company "Kara-Balta Spirtovy Plant" of August 3, 2015 No. 556;

- item 4 of the Order of the Government of the Kyrgyz Republic "About reorganization of the state company "State Breeding Plant of Strelnikova" of December 31, 2015 No. 895.

18. This Resolution becomes effective after seven days from the date of official publication.

19. To impose control of execution of this Resolution on the relevant departments of Government office of the Kyrgyz Republic supervising the relevant state bodies of the executive authority.

Appendix 1

Regulations on the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic

1. General provisions

1. The Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic (further - the Ministry) is the authorized state body of the executive authority performing state policy in the field of agro-industrial complex including livestock production, fish breeding (aquacultures), crop production, quarantine of plants, land reclamation, land, water resources, irrigational and meliorative infrastructures, food and processing industry.

2. The ministry in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic, and also the conventional principles and rules of international law, international treaties which became effective in the procedure established by the law which participant is the Kyrgyz Republic, and also this Provision.

3. The ministry performs the activities in interaction with executive bodies, local government bodies, public associations, scientific and other organizations, the companies, organizations.

4. The ministry is legal entity, has seal with the image of the State Emblem of the Kyrgyz Republic and the name in the state and official languages, and also accounts in system of Treasury. The ministry enters the civil relations from own name, has the right to act as the party of the civil relations on behalf of the state within the legislation of the Kyrgyz Republic.

2. Purpose of the Ministry

5. The purpose of the Ministry is ensuring food security, development of agricultural production and the food industry.

3. Tasks of the Ministry

6. Tasks of the Ministry are:

- development and realization of single state policy in the field of agricultural industry, food and processing industry, fishery, and also in the field of ensuring veterinary and sanitary, phytosanitary safety and safe handling of pesticides and agrochemicals, veterinary medicines;

- ensuring internal requirements of the state for agricultural products and increase in the export potential of the country in the field of agricultural production;

- determination of the priority directions and the strategy of development for progressive innovative technologies in the field of agricultural production, assistance to implementation in practice of production of achievements of science and technology;

- planning of interstate distribution of the water resources which are created in the territory of the Kyrgyz Republic, and in accordance with the established procedure regulation of the interstate water relations together with state bodies of the republic;

- the paragraph of the sixth ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 30.07.2019 No. 383;

the paragraph of the seventh ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 30.07.2019 No. 382;

- carrying out state policy in the field of ensuring effective and rational management and use of lands of the State fund of agricultural holdings and pasturable grounds;

- the paragraph the ninth ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 01.11.2019 No. 594.

4. Functions of the Ministry

7. The ministry performs the following functions:

1) Functions of industry policy:

- develops and realizes the regulatory legal acts and programs which are within the competence of the Ministry, determines the priority directions of scientific research in the field of agricultural industry;

- develops and realizes policy in the field of agricultural industry, food and processing industry, rational and effective use of land, water resources;

- providing the state order on accomplishment research and production, research and development works in the priority directions of agrarian science;

- carries out the systematic analysis of economic condition of agricultural industry, food and processing industry, export import of agricultural products and on its basis determines strategic direction of their development;

- determines the priority directions of development of industries of agricultural industry, land use, pastbishchepolzovaniye, food, processing industry, regulation of the agricultural markets, attracts internal and external investments;

- develops and implements system of the state support of development of the priority directions in production;

- determines, estimates and manages in accordance with the established procedure veterinary and sanitary and phytosanitary risks;

- develops and implements together with subjects of entrepreneurship of the restructuring program of the companies of food and processing industry of agro-industrial complex and the separate companies;

- develops perspective, short-term economic forecast indicators of production of agricultural products, food and processing industry;

- prepares and realizes investing programs and projects on the questions which are within the competence of the Ministry within the procedures and rules accepted in the international practice;

- performs measures for development of seed-growing industry, implementation of new highly productive and high-quality grades and hybrids of crops, will organize production of their seeds and landing material;

- performs measures for development of breeding livestock production, implementation of effective methods of maintaining livestock production;

- develops strategy of fight against diseases of animals and plants, carries out their analysis and the forecast;

- will organize work of development of fisheries;

- carries out the analysis and vegetable samples;

- develops recommendations about program implementation and legislations of the Kyrgyz Republic in the field of management of use of pastures;

- develops measures for development of organic agricultural production and creation of organic aimags in regions;

- determines state standards and evaluation methods of monitoring of condition and quality of pastures;

- carries out efficiency analysis of actions of technical regulations and makes offers on modification and amendments in them, informs producers concerning the accepted changes;

- develops and realizes policy of preparation, retraining and advanced training of personnel for rural, fishery and processing industry;

- develops programs and forecasts for reproduction and protection of fish inventories;

- develops the mechanism of rendering consulting and information services, applied training and its financing;

- develops and realizes policy on creation of agricultural services and the machine and tractor stations (MTS);

- analyzes the state of affairs in the field of production of each industry and develops suggestions for improvement of work and to its development;

- develops offers on functioning of food and recycling industry, including by the companies, for short-term outlook and, if necessary, makes offers on their improvement;

- develops measures for improvement of foreign trade activity, development and stimulation of the export potential of agricultural products;

- performs activities in the field of agrarian scientific and innovative and consulting ensuring development of agricultural industry, the food industry and melioration;

- participates in development and deployment of technical regulations in the field of mechanization of agricultural industry and helps production organization of agricultural mechanical engineering;

- participates in development and preparation of drafts of international treaties on the questions which are within the competence of the Ministry;

- holds events for legal promotion according to the supervised industry;

2) regulation Functions:

- makes offers on establishment of quarantine, prevents distribution and will organize liquidation of quarantine and regulated not quarantine harmful organisms of plants together with local public administrations;

- performs production testing, carries out state registration of pesticides and agrochemicals, keeps the State catalog of the pesticides and agrochemicals allowed for use in the territory of the Kyrgyz Republic;

- performs state regulation of the relations in the field of drug circulation of veterinary appointment and keeps the state register;

- issues in the procedure established by the legislation of the Kyrgyz Republic the corresponding permissions to the right of import to the territory of the republic of seed and landing material, grades and hybrids of the crops allowed to use;

- performs licensing of the types of activity which are within the competence of the Ministry, carries out monitoring and control over the implementation of licensed conditions and rules;

3) Functions of coordination, control and monitoring:

- performs the common directorship and coordination of the state companies which are under authority of the Ministry;

- coordinates activities of investing programs in the field of rural, fishery, food and processing industry, performs monitoring of their realization for taking measures to increase in efficiency of use;

- performs the state testing of grades and hybrids of crops for the purpose of determination of their economic usefulness, keeps the State register of the grades and hybrids allowed to use in the territory of the Kyrgyz Republic;

- performs monitoring and carries out forecasting of emergence and distribution of quarantine and regulated not quarantine harmful organisms;

- coordinates scientific and innovative activities in the field of agriculture, veterinary science, livestock production and pastures, performs implementation of achievements of agrarian science in agricultural production;

- performs monitoring and the analysis of emergence of infectious diseases of animals;

- coordinates and exercises the state control of selection and breeding work and cultivation of all types of farm animals, carries out approbation;

- studies condition of source of raw materials of reservoirs, conducts work on reconstruction of fish fauna of reservoirs in cooperation with National academy of Sciences of the Kyrgyz Republic, the ministries and departments, exercises ikhtiopatologichesky control of sanitary and epizootic condition of reservoirs;

- performs measures for fight against diseases of fishes, protection and reproduction of fish inventories, development of infrastructure;

- carries out monitoring of activities of laboratories of the companies of food and processing industry, giving methodical help in enhancement of their activities;

- coordinates activities of the state companies, joint stock companies, corporations and societies occupied in the field of conversion of agricultural products and production of food, creates the general explanatory note about results of their functioning;

- coordinates realization of state policy in the field of complex development of food and processing industry, development and creation of the new industries;

- performs cross-industry and interregional coordination of activities of state bodies for forming of state policy in the field of food and processing industry;

- coordinates development and implementation of measures, improving structure of food and processing industry;

- coordinates the technical assistance arriving on development of the food industry together with other state bodies;

- exercises in accordance with the established procedure control over the implementation of technical and economic indicators and the established target indicators in the food industry in interaction with state bodies;

- holds consultations and information exchange with the national organizations of the countries - trading partners of the Kyrgyz Republic, participates in development of protocols on mutual recognition of quarantine phytosanitary measures, free zones, places and sites of production;

- provides interaction of state bodies when carrying out programs for localization and/or liquidation of quarantine harmful organisms;

- exercises phytosanitary quarantine control behind the imported quarantine products on the phytosanitary control posts equipped at check points on Frontier of the Kyrgyz Republic in places of customs clearance of loads, terminal points of their appointment and other places according to management system phytosanitary risk;

- carries out monitoring of efficiency of provision of consulting and information services;

- promotes attraction of external and internal investments for creation new, upgrade and modernization of the existing companies of food and processing industry, improvement of quality of the made products according to requirements of technical regulations of the countries of the Eurasian Economic Union, World Trade Organization and the European Union;

- helps and renders consulting services in creation and development of agricultural cooperatives, cooperatives of the trade and purchasing organizations, the wholesale markets for trade in products of agricultural industry;

- carries out monitoring of work of the mashinotraktorny park, analyzes results of implementation of state programs on strategic development of industry;

- promotes investment attraction in scientific research, to implementation of their results in practice;

4) Functions on provision of services:

- provides consulting and information services to producers and processors of agricultural products, and also industry associations and their associations;

- develops, publishes and extends evident consulting and training materials on development of agro-industrial complex, provides training of heads and specialists of farms;

- performs measures for ensuring protection of interests of domestic producers in the field of agricultural industry, food and processing industry;

- provides business entities with information of rather market prices of production resources and agricultural products, including information on opportunities of commodity export and services;

- according to the Law of the Kyrgyz Republic "About legal protection of selection achievements" carries out testing of new grades for compliance to criteria of protectability for ensuring protection of the rights of selectors and takes out the conclusion;

- carries out laboratory expertize of plants, soils, crop production products on pollution by dangerous chemical elements and their connections;

- develops recommendations about deepening of conversion by subjects of recycling industry of domestic raw material resources, step-by-step import substitution of products through attraction of innovative technologies, the progressive equipment, taking into account opportunities of the organization of technological (economic) clusters;

- grants certificates on assignment of the status of breeding economy to business entities, keeps the catalog of lines, types and breeds of animal all types;

- establishes quarantine phytosanitary condition of quarantine products for the purpose of export, including all types of phytosanitary analyses and examinations, performs issue of the conclusion / phytosanitary documentation on quarantine phytosanitary condition of quarantine products;

- conducts examination of farmlands, plantings, the companies and the territories adjoining to them which activities are connected with products of plant origin, on identification of quarantine objects, with sampling and conducting laboratory examinations according to requests of physical persons and legal entities;

- carries out disinfecting of quarantine products, vehicles, preventive phytosanitary disinfecting of storage facilities according to regulations and rules of providing quarantine of plants and issue of the document confirming disinfecting according to requests of physical persons and legal entities;

- carries out the analysis of the soil and vegetable samples;;

5) support Functions:

- performs cooperation and coordination of activities with other state bodies, the international donor organizations, international financial institutions, the partner countries, including within integration associations, investors for the purpose of implementation of investing programs and projects in the field of agricultural industry, and also conducts monitoring of their accomplishment;

- renders assistance to local public administrations and local government bodies in the ensuring target and effective use of land grounds of agricultural purpose and lands suitable for needs of agricultural industry;

- promotes implementation of effective evidence-based systems of crop rotations and technologies of processing of the soil;

- performs actions for preserving genetic resources of plants and animals;

- holds events in the field of mechanization, power supply and implementation of the new equipment on the basis of the state testing;

- renders assistance to development of leasing and creation of technical services and machine and tractor stations for servicing of rural producers;

- promotes development of chastnopredprinimatelsky activities for rendering veterinary services and the competition in the field of veterinary servicing;

- promotes creation of industry associations and coordination of their activities;

- provides open information access about the national legal system and the legislation of importing countries of quarantine products in the field of quarantine of plants, borders of quarantine phytosanitary zones and the modes, the operating import restrictions and export of quarantine products, the state services in the field of quarantine of plants, state programs on localization and liquidation of harmful organisms and other information;

- prepares and makes offers in the state bodies pursuing scientific and technical policy on determination of the priority directions in the field of agricultural science taking into account specifics of development of national economy;

- promotes development of the state scientific and technical programs and projects, research works at industry, cross-industry, interregional, national, interstate level in the field of agricultural industry;

- conducts scientific research, will organize implementation of their achievements in practice of farmer, cooperative farms and renders them necessary advisory services;

- propagandizes and advertizes achievements of agrarian science through mass media;

- will organize holding research and production conferences, seminars, symposiums, meetings with practical display of scientific achievements;

- participates in project development of technological instructions, provisions, regulations and rules on production of foodstuff.

5. Rights of the Ministry

8. The ministry for the purpose of implementation of functions in the established field of activity has the right:

- request and obtain in accordance with the established procedure information relating to field of activity of the Ministry from state bodies, local government bodies and other physical persons and legal entities;

- provide directory and other services within the legislation of the Kyrgyz Republic;

- adopt departmental acts;

- visit breeding and seed-growing farms, processing enterprises, water management and fishery objects, and also the organizations and the companies which activities are connected with use of pesticides, to perform check of use of agrochemical, biological and veterinary medicines;

- create coordinating and advisory bodies (councils, the commissions, groups), including interdepartmental, in the field of activities of the Ministry;

- participate in work of the international institutes, commissions, expert groups, special working groups on the questions entering competence of the Ministry including at the interdepartmental and intergovernmental levels;

- represent the interests of the Kyrgyz Republic on the questions carried to competence of the Ministry in the interstate (regional) organizations;

- in accordance with the established procedure to raise funds of the international organizations and organizations, grants of the donor countries, investments for implementation of state policy in the field of the activities referred to competence of the Ministry;

- attract to development of state programs, concepts and other projects of representatives of the ministries, state committees, administrative departments of the Kyrgyz Republic, National academy of Sciences of the Kyrgyz Republic, research and other organizations, experts for development of offers on the directions concerning field of activity of the Ministry;

- hear reports of heads of the state agro-industrial, fishery, agricultural enterprises, organizations and organizations, subordinated divisions, sales offices of investment projects on results of activities;

- establish in accordance with the established procedure printing mass media for the publication of regulatory legal acts, official announcements, materials on the questions carried to competence of the Ministry;

- be member of other state, interstate, and also public structures created according to the procedure, the established legislation;

- establish in accordance with the established procedure departmental awards for rewarding with them of workers of agricultural industry;

- attract to study of the questions carried to field of activity of the Ministry, scientific, project and other organizations;

- consider cases on administrative offenses according to legislations of the Kyrgyz Republic;

- perform other rights according to the legislation of the Kyrgyz Republic.

6. Organization of work of the Ministry

9. The ministry is headed by the Minister of Agriculture, the food industry and melioration of the Kyrgyz Republic (further - the minister) appointed to position and dismissed according to the procedure, stipulated by the legislation the Kyrgyz Republic.

10. In the Ministry positions of the secretary of state and deputy ministers are provided.

11. Procedure for appointment, dismissal, function and power of the secretary of state are determined by the legislation on the public civil service.

12. Deputy ministers are appointed to position and dismissed by the Prime Minister of the Kyrgyz Republic on representation of the minister, submit directly to the minister and will organize activities of the Ministry within the obligations assigned to them.

13. Minister:

- performs the common directorship of activities of the Ministry and bears the personal responsibility for accomplishment of the tasks assigned to the Ministry;

- represents the Ministry in the relations with state bodies, the companies, organizations and the organizations of the Kyrgyz Republic, conducts negotiations within the powers, in accordance with the established procedure signs documents on interaction and cooperation on the questions carried to competence of the Ministry;

- performs management of Civil protection in the Ministry and is the chief of Service of protection of animals and plants, and also the chief of Water protective service of Civil protection of the Kyrgyz Republic on position;

- represents to the Prime Minister of the Kyrgyz Republic of the candidate for position assignment of deputy ministers, heads of subordinated divisions of the Ministry and applies to them measures of encouragement and authority punishment according to the Law of the Kyrgyz Republic "About the public civil service and municipal service";

- distributes obligations between deputy ministers;

- approves structure of central office, territorial authorities and subordinated divisions of system of the Ministry;

- approves regulations on structural divisions of central office, territorial subdivisions of the Ministry;

- approves regulations on board of the Ministry;

- on representation of the secretary of state appoints to position and dismisses employees of central office, territorial subdivisions, deputy managers of subordinated divisions of the Ministry, applies to them measures of encouragement and authority punishment according to the Law of the Kyrgyz Republic "About the public civil service and municipal service";

- issues the orders which are subject to obligatory execution by workers of system of the Ministry;

- signs the collective agreement with representative body of employees of the Ministry;

- in the limits determined by the legislation disposes of means and manages property of the Ministry, concludes bargains according to the legislation of the Kyrgyz Republic;

- signs bilateral and multi-lateral international agreements for and on behalf of the Government of the Kyrgyz Republic;

- performs at the request of the Government of the Kyrgyz Republic other functions within the powers;

- in accordance with the established procedure develops and submits the budget statement of the Ministry for approval;

- approves expense budget of central office, subordinated and territorial subdivisions and controls their accomplishment;

- establishes allowances to official pay rates of employees of the Ministry;

- represents in accordance with the established procedure employees of the Ministry and subordinated divisions, and also other physical persons and legal entities performing activities in the established sphere to rewarding with the state awards of the Kyrgyz Republic;

- appropriates, deprives and lowers in class ranks of government employees on representation of the secretary of state, according to the legislation;

- gives instructions to subordinated divisions and controls their execution;

- approves the staff list within the approved structure, number, the salary fund of subordinated divisions;

- cancels the decisions of the Ministry contradicting the legislation of the Kyrgyz Republic, divisions subordinated to the Ministry if other procedure for cancellation of decisions is not established by the legislation of the Kyrgyz Republic;

- establishes powers of officials of system of the Ministry of the decision them the operational, organizational, personnel, financial, production and economic and other issues carried to competence of the Ministry;

- approves functional (official) obligations of heads and employees of central office and territorial subdivisions.

14. The secretary of state and deputy ministers independently make decisions on the questions carried by the minister to their maintaining will organize work on the supervised areas of work.

The secretary of state prepares ideas of appointment, movement, rotation and dismissal of the government civil servants of the Ministry holding managerial state civil positions.

15. In the Ministry the board in number of 9 people as a part of the minister (chairman), the representative of Government office of the Kyrgyz Republic, the secretary of state, deputy ministers, members of the Public supervisory board and other employees of agro-industrial complex is formed. The minister, the secretary of state, deputy ministers are part of board on position.

16. For the purpose of public monitoring of activities of the Ministry the Public council representing the advisory and supervisory body functioning on a voluntary basis is created.

17. In the Ministry the commission on ethics of government employees is effective.

19. Internal audit of central office, subordinated divisions, organizations and organizations of the Ministry is performed by service of internal audit according to the legislation of the Kyrgyz Republic.

20. Financing of maintenance costs of central office, subordinated and territorial subdivisions of the Ministry is performed at the expense of the means provided in the government budget, the special means and other means which are not prohibited by the legislation of the Kyrgyz Republic.

1. General provisions

1. The department of quarantine of plants of the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic (further - Department) is the subordinated division of the Ministry of Agriculture, the food industry and melioration of the Kyrgyz Republic (further - the Ministry) performing activities for protection of the territory of the Kyrgyz Republic from delivery (drift) and/or distribution of quarantine harmful organisms.

2. The department in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, presidential decrees of the Kyrgyz Republic, resolutions and orders of the Government of the Kyrgyz Republic, other regulatory legal acts conventional by the principles and rules of international law, international treaties which became effective in the procedure established by the law which participant is the Kyrgyz Republic, orders and orders of the Ministry, and also this Provision.

3. The department performs the activities in interaction with other subordinated divisions of the Ministry, the ministries, the state committees, administrative departments, other executive bodies of the Kyrgyz Republic, local public administrations and local government bodies, the international, public organizations.

The department in the activities is accountable to the Ministry.

3. Tasks of Department

8. Tasks of Department are:

- forming and systematic updating of system of quarantine phytosanitary measures;

- prevention of penetration on the territory of the Kyrgyz Republic and/or distribution in the territory of the Kyrgyz Republic of quarantine harmful organisms;

- prevention of damage from distribution of quarantine harmful organisms;

- ensuring accomplishment of the obligations of the Kyrgyz Republic assumed within which came in the procedure established by the law into force of international treaties in the field of quarantine which participant is the Kyrgyz Republic.

4. Functions of Department

9. The department performs the following functions:

- participates:

in development of regulatory legal acts in the field of quarantine of plants;

in methodical providing quarantine phytosanitary procedures and actions;

in development of state programs on localization and liquidation of quarantine harmful organisms;

- carries out the analysis of phytosanitary risk of harmful organisms for the purpose of establishment of their status and quarantine phytosanitary requirements to quarantine products and objects;

- gives the import permit to the Kyrgyz Republic, and also on transit across its territory of loads of plants, vegetable products and other quarantine materials;

- refuses import, requires performing disinfecting, return or destruction of batches of the quarantine products which are not conforming to quarantine phytosanitary requirements;

- in coordination with the Ministry enters temporary quarantine phytosanitary measures on separate types or groups of types of quarantine products according to the international treaties which came in the procedure established by the law into force which participant is the Kyrgyz Republic and the acts constituting the right of the Eurasian Economic Union in the field of quarantine of plants;

- performs quarantine phytosanitary inspection of production sites of the seed and landing material imported on the territory of the Kyrgyz Republic, based on the State register of grades and hybrids of the plants allowed to use in the territory of the Kyrgyz Republic;

- determines borders of quarantine phytosanitary zones and the quarantine modes in them and brings submissions to the relevant state bodies for their approval;

- issues (refuses issue) phytosanitary, reexport phytosanitary and quarantine certificates;

- provides interaction of state bodies of the executive authority when carrying out programs for localization and/or liquidation of quarantine harmful organisms;

- performs quarantine phytosanitary monitoring and the forecast of emergence and/or distribution in the territory of the Kyrgyz Republic of quarantine harmful organisms for the purpose of updating of quarantine phytosanitary measures;

- conducts the annual quarantine phytosanitary examinations of lands of agricultural and other purpose, storage locations and conversion, utilization, Items of import of quarantine products and the territories adjoining to them, border zones planned according to management system phytosanitary risk for the purpose of timely identification of quarantine objects, establishment, refining of borders of quarantine phytosanitary zones;

- conducts quarantine phytosanitary examinations of quarantinable objects in case of receipt of information from state bodies, research establishments and other sources about presence at them of quarantine harmful organism;

- performs, within the signed international treaties and mutual arrangements with the national organizations for quarantine of plants of the foreign states, quarantine phytosanitary inspection of the territories of the parties, including border zones;

5. Rights of Department

10. Officials of Department have the right:

- visit quarantinable objects for carrying out control quarantine phytosanitary inspections;

- detain quarantine freight, in case of identification when carrying out examination of the organism similar in morphological features to quarantine harmful organism, symptoms of diseases of plants, signs of damage by quarantine harmful organism, before receipt of results of laboratory examination and performing disinfecting;

- require performing disinfecting, return or destruction of plants and quarantine products in cases of identification of quarantine harmful organisms;

- receive in accordance with the established procedure from bodies of the state statistics, customs and other state bodies of the Kyrgyz Republic statistical data and information on import to the territory, export from the territory of the Kyrgyz Republic and transit of quarantine freights;

- create in accordance with the established procedure the interdepartmental working groups of number of experts and specialists in development of regulatory legal acts, actions for localization and liquidation of quarantine harmful organisms and realization of other tasks in the field of quarantine of plants;

- make offers in local public administrations and local government bodies on consideration of questions of providing quarantine of plants;

- raise in accordance with the established procedure funds of the international organizations and organizations, grants of donors for implementation of the tasks;

- conduct procurement of goods, works and services according to the legislation of the Kyrgyz Republic;

- hold seminars and conferences;

- attract in coordination with state bodies and local government bodies, the organizations, research institutions of specialists to conducting independent examinations;

- on duty to wear uniform of the established sample according to the procedure, established by the legislation of the Kyrgyz Republic in the field of wearing uniform;

6. Organization of activities of Department

11. The department is headed by the director appointed to position and dismissed by the Prime Minister of the Kyrgyz Republic on representation of the Minister of Agriculture, the food industry and melioration of the Kyrgyz Republic.

12. In Department it is provided positions of the deputy directors appointed to position and dismissed by the Minister of Agriculture, the food industry and melioration of the Kyrgyz Republic according to the legislation of the Kyrgyz Republic.

13. In the absence of the director fulfillment of duties of the department director is assigned to one of deputy directors.

14. Organizational and administrative documents of Department affirm the order of the director according to the legislation of the Kyrgyz Republic.

14-1. The officials exercising the state phytosanitary quarantine control are officials who have the number seals issued in accordance with the established procedure by the department director.

15. Department director:

- performs the common directorship of activities of Department and bears the personal responsibility for accomplishment of the assigned tasks;

- represents Department in the relations with state bodies, the companies, organizations and the organizations of the Kyrgyz Republic and foreign states, conducts negotiations within the powers, in accordance with the established procedure signs documents on interaction and cooperation on the questions carried to competence of Department;

- issues the orders which are subject to obligatory execution by employees of Department;

- approves provisions of territorial subdivisions and functional obligations of staff of Department;

- gives instructions to the staff of Department and controls their execution;

The main sources of financing of activities of Department are:

9. Reorganization and liquidation

21. Reorganization and liquidation of Department, procedure for distribution of property in case of liquidation or reorganization are performed according to the civil legislation of the Kyrgyz Republic.
