Some questions of sanatorium treatment and rest of the citizens who were injured owing to the Chernobyl catastrophic crash

According to part one item 4 of Article 20, to Item "About the status and social protection of the citizens who were injured owing to the Chernobyl catastrophic crash" and to Item 26 of the Section VI "Final and transitional provisions" of the Budget code of Ukraine the Cabinet of Ministers of Ukraine decides 10 parts three of article 30 of the Law of Ukraine:

1. Approve the Procedure for provision of the annual monetary assistance for compensation of cost of permits to sanatorium institutions and organizations of rest, implementation of surcharges for the account of own means, payments of monetary compensation to the citizens who were injured owing to the Chernobyl catastrophic crash which is applied.

2. Bring in Item 13-2 - the Procedure for use of means of the government budget for accomplishment of the programs connected with social protection of the citizens who were injured owing to the Chernobyl catastrophic crash, the Cabinet of Ministers of Ukraine approved by the resolution of September 20, 2005 No. 936 (The Official Bulletin of Ukraine, 2005, No. 38, Art. 2372; 2007, No. 12, Art. 429; 2015, No. 7, Art. 157; 2016, No. 87, the Art. 2842), changes which are applied.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. This resolution becomes effective since January 1, 2017, except Item 24 of the Procedure approved by this resolution which becomes effective since January 1, 2018.

Procedure for provision of the annual monetary assistance for compensation of cost of permits to sanatorium institutions and organizations of rest, implementation of surcharges for the account of own means, payments of monetary compensation to the citizens who were injured owing to the Chernobyl catastrophic crash

1. This Procedure determines procedure for granting of the annual monetary assistance for compensation of cost of sanatorium permits or permits to rest (further - benefit) through non-cash transfer to sanatorium institutions and organizations of rest which have the license for implementation of economic activity on medical practice, implementation to the citizens who were injured owing to the Chernobyl catastrophic crash, surcharge for provision of additional services at the expense of own means in case of insufficiency of the amount of the monetary assistance, and also payment to the specified citizens of monetary compensation in the amount of average cost of the permit in Ukraine.

2. The priority direction of improvement of citizens' health, injured owing to the Chernobyl catastrophic crash, providing them with sanatorium permits or permits to rest is.

3. Free sanatorium permits or permits to rest (further permits) by provision of the monetary assistance provide the citizens who were injured owing to the Chernobyl catastrophic crash namely:

the citizens referred to category 1, victims owing to the Chernobyl catastrophic crash (further - the citizens referred to category 1);

children with disability whose disability is connected with the Chernobyl catastrophic crash (further - children with disability).

4. The term of stay in sanatorium organization and organization of rest constitutes:

for the citizens referred to category 1 - 18 days;

for the citizens referred to category 1, with diseases of nervous system (with effects of injuries and diseases of backbone and spinal cord) - up to 35 days;

for children with disability - from 21 days to two months.

The term of stay of children with disability in rest institution according to the permit to rest constitutes at least 14 days.

5. Providing the citizens referred to category 1, and children with disability with services on sanatorium treatment is carried out with observance of requirements of Item 2 of this Procedure within allocated funds in proportion to the number of such citizens staying on the registry for receipt of such treatment.

6. Free providing with permits the citizens referred to category 1, and children with disability is carried out by provision of the annual monetary assistance for compensation of cost of permits through non-cash transfer to sanatorium institutions and organizations of rest which have the license for implementation of economic activity on medical practice (further - organizations), for provision of services on sanatorium treatment or rest.

7. The citizens referred to category 1, and children with disability have the right of the free choice of institution of the corresponding profile, and also at the request of implementation of surcharge for provision of additional services at the expense of own means in case of insufficiency of the amount of the monetary assistance for compensation of cost of the permit in the chosen institution.

8. Accounting of the citizens referred to category 1, and children with disability who have the right to providing with permits by provision of the monetary assistance is carried out by structural divisions concerning social protection of the population of the district, district state administrations in Kiev, executive bodies city, district in the cities in case of education (except Kiev) councils (further - social security authorities of the population) at the place of residence of such citizens.

Information on the number of the citizens registered for providing with permits by provision of the monetary assistance and payment of monetary compensation next year is created by social security authorities of the population till October 15 of the current year.

The responsible person of social security authority of the population at the place of residence explains to the citizens referred to category 1, to parents of children with disability or to persons who replace them, procedure for providing with permits by provision of the monetary assistance.

9. For registration for providing with the permit by provision of the monetary assistance the citizen referred to category 1, one of the child's parents with disability or person who replaces them give:

1) for providing the citizen referred to category 1:

the statement for registration for receipt of the permit in the form approved by Minsotspolitiki;

the reference for receipt of the permit to sanatorium treatment in form 070/about;

the copy of the certificate of the citizen referred to category 1 (with the insert);

passport copy.
