About approval of Licensed conditions of implementation of economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine

Approve Licensed conditions of implementation of economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine which are applied.

Licensed conditions of implementation of economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine

General provisions

1. These Licensed conditions establish the exhaustive list of the requirements obligatory for accomplishment by the licensee, and the exhaustive list of the documents enclosed to the application for receipt of the license for implementation of economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine (further - the license).

2. Action of these Licensed conditions extends to subjects of managing, irrespective of their form of business and pattern of ownership registered in the procedure established by the legislation and the water bioresources performing economic activity on industrial catch outside jurisdiction of Ukraine.

3. The terms used in these Licensed conditions are used in the value given in the Convention of the United Nations on maritime law of 1982, the Maritime Code of Ukraine, the Water code of Ukraine, the Laws of Ukraine "About licensing of types of economic activity" and "About fishery, industrial fishery and protection of water bioresources", other legal acts, international treaties of Ukraine.

4. Economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine is performed based on the license in the presence at the licensee of material and technical resources for implementation of economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine.

The licensee shall fulfill the requirements provided by these Licensed conditions, and the license applicant for its obtaining - to correspond to these Licensed conditions.

5. For receipt of the license license applicants submit to body of licensing the application for receipt of the license in form according to appendix 1 and documents according to the list determined by Item of 6 presents of Licensed conditions.

6. Are enclosed to the application for receipt of the license:

the documents provided by part three of article 11 of the Law of Ukraine "About licensing of types of economic activity";

the sheet about availability at the license applicant of material and technical resources for implementation of economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine in form according to appendix 2;

the list of documents, represented for receipt of the license, in duplicate (appendix 3).

7. For renewal of the license licensees submit to body of licensing the application for renewal of the license in form according to appendix 4 and the documents confirming availability of the bases for renewal of the license. The license granted to the licensee on paper is also enclosed to the application for renewal of the license.

Personnel requirements

8. The license applicant provides the conclusion of employment contracts with workers for position assignment as a part of crew of the vessel in quantity which corresponds to the established minimum structure of crew of the vessel.

Information on the number of the hired workers, qualification structure and nationality moves subjects of managing to body of licensing in form according to appendix 2.

Organizational requirements

9. The licensee shall:

store during license effective period documents which copies moved to body of licensing according to requirements of the Law of Ukraine "About licensing of types of economic activity";

store during license effective period documents (their copy) confirming accuracy of the data which were specified by the license applicant in documents which were filed to body of licensing according to requirements of the Law of Ukraine "About licensing of types of economic activity";

in case of the bases for renewal of the license tax within one month in body of licensing the statement for renewal of the license and the documents confirming availability of the bases for renewal of the license;

perform industrial catch of water bioresources only within the places of implementation of economic activity specified in the sheet about availability at the license applicant of material and technical resources for implementation of economic activity on industrial catch of water bioresources outside jurisdiction of Ukraine;

provide presence of the head of the licensee, his deputy or other authorized person during licensing by body in the procedure for test of observance by the licensee of requirements of these Licensed conditions established by the law;

provide submission of the reporting on amounts of the water bioresources withdrawn outside jurisdiction of Ukraine taking into account requirements of the legislation of the coastal states and international treaties of Ukraine;

in case of the planned or unplanned termination of economic activity (in connection with impossibility of use of material and technical resources, emergence of force majeur circumstances, etc.) in week time to report about it in writing to body of licensing and to resume fulfillment of requirements of these Licensed conditions after elimination of the specified circumstances.

Production requirements

10. The licensee shall:

perform depending on the location of fishery water object industrial catch of water bioresources in terms and fishing tools, technical and technology equipment which are determined in international treaties of Ukraine, taking into account the mode and rules of fishery on the corresponding water object;

provide compliance of fishing boats to safety requirements of navigation according to the legislation of Ukraine, including the international obligations of Ukraine;
