1. Approve the enclosed Federal regulations and rules of industrial safety "About approval of federal regulations and rules of industrial safety of "The safety rule in case of conducting mining operations and conversion of solid minerals".

2. Recognize invalid:

the resolution of the Federal inspectorate for mining and industry of Russia of September 9, 2002 No. 57 "About approval of single safety rules in case of development of mineral deposits by open method (PB 03-498-02)" (it is registered in the Ministry of Justice of the Russian Federation on November 21, 2002, registration No. 3938, "The bulletin of regulations of federal executive bodies", 23.12. 2002, No. 51, "The Russian newspaper", 25.01.2003, No. 15);

the resolution of the Federal inspectorate for mining and industry of Russia of May 13, 2003 No. 30 "About approval of single safety rules in case of development of ore, nonmetallic and loose mineral deposits by underground method (PB 03-553-03)" (it is registered in the Ministry of Justice of the Russian Federation on May 28, 2003, registration No. 4600, "The Russian newspaper" (special release), 21.06. 2003, No. 120/1);

Federal regulations and rules of industrial safety of "Safety rule in case of conducting mining operations and conversion of solid minerals"

I. Scope

1. These Federal regulations and rules of industrial safety of "The safety rule in case of conducting mining operations and conversion of solid minerals" (further - Rules) establish the requirements aimed at providing industrial safety, the prevention of accidents, cases of industrial traumatism on subjects to conducting mining operations and conversions of nonflammable, solid minerals.

2. 3. Rules establish requirements of industrial safety to organization activity, performing designing, construction, operation of objects on which mining operations for the purpose of production of solid minerals (including for the purpose of production of popular minerals and development of loose mineral deposits), works on conversion of minerals, and also the organizations which are engaged in production, installation, operation and repair of the technical devices used on objects of mining industry are conducted.

3.1. In each organization operating subjects to mining operations and conversion of minerals the local documents approved by the technical lead of the organization, establishing form and procedure for filling of magazines and books which maintaining is necessary according to requirements of these rules shall be developed. All employees of the organization given authority on filling of magazines and books and also for control of their maintaining, shall be informed under list of local documents.

4. The requirements to safe conducting mining operations and conversion of minerals established by Rules are obligatory for accomplishment by legal entities and physical persons, including individual entrepreneurs in the territory of the Russian Federation (further for the organization), irrespective of patterns of ownership.

5. Persons guilty of violation of the requirements established by Rules bear responsibility in accordance with the legislation of the Russian Federation.

II. General requirements to the organization of works

6. Objects on which mining operations, the conversion of minerals referred in accordance with the legislation of the Russian Federation to category of hazardous production facilities are conducted are subject to registration in the state register of hazardous production facilities.

7. The organizations operating objects on which mining operations and conversion of minerals are conducted when implementing the specific types of activity in the field of industrial safety which are subject to licensing in accordance with the legislation of the Russian Federation shall have the corresponding licenses.

8. The organizations operating objects on which mining operations and conversion of minerals are conducted in the cases established by the legislation of the Russian Federation shall develop declarations of industrial safety.

9. The organizations operating objects on which mining operations are conducted shall have the documents processed in accordance with the established procedure determining the specified borders of mountain branch (mountain branch). Conducting mining operations shall be performed in borders of mountain branch.

10. The organizations operating hazardous production facilities on which mining operations and conversion of minerals are conducted in the procedure established by the legislation of the Russian Federation shall:

organize and exercise production control over observance of requirements of industrial safety, develop regulations on production supervision. Responsibility for the organization of production supervision is born by the head of the organization operating hazardous production facility. Responsibility for implementation of production supervision is born by officials on whom responsibility for implementation of production supervision is conferred. In the cases of the organization established by the legislation of the Russian Federation, the conducting mining operations and works on conversion of minerals, shall develop management systems industrial safety;

sign agreements of obligatory civil liability insurance of the owner of dangerous object for damnification;

develop actions plans on localization and mitigation of consequences of accidents;

sign service agreements with professional rescue units (services), and in the cases established by the legislation of the Russian Federation, create own professional rescue units (services), auxiliary mine-rescue teams.

11. When conducting mining operations in avalanche and mudflow areas (sites) of the organization shall develop the Actions plans on antiavalanche (antimudstone) protection of objects containing the adequate measures of safety approved by the head of object.

12. Heads of objects (organizations) operating subjects to conducting mining operations and conversion of minerals shall organize development of actions for non-admission of accidents on hazardous production facility on the basis of danger assessment on each workplace and object in general. On each subject to conducting mining operations and conversions of minerals by the operating organization shall be created the conditions allowing workers of object and contract organizations in case of accident, to freely leave the site on which the possibility of harming their health is not excluded. Conditions (organizational, technical), delivery, allowing to perform operational, safe for health, injured or suddenly sick from the object territory to the place of rendering qualified medical care shall be created. Responsibility for creation of such conditions is born by the head of object (organization).

13. All accidents, accidents and incidents which took place on subjects to conducting mining operations and conversions of minerals are subject to registration, investigation and accounting according to the requirements established by the legislation of the Russian Federation. About each accident or acute disease the responsible person for work in change (the dispatcher, the operator) shall report the matter to management of the organization (object) and cause crew of emergency medical service. The workplace on which there was accident or accident if it does not threaten life and human health, shall be kept in steady-state condition before carrying out survey and adoption of the relevant decision by the commission on investigation appointed in the procedure established by the legislation of the Russian Federation. Responsibility for safety of the place on which there was accident or accident is born by the head of object.

Resumption of work after recovery from the accident shall be performed based on the written permission of the head of object in coordination with the commission chairman for technical investigation of accident.

14. On subjects to conducting mining operations and conversions of minerals the first-aid station equipped with means of communication shall be organized.

In the organizations with the number of the working less than 100 people medical attendance is allowed to be performed in the nearest medical institution. On each site, in workshops, workshops, and also on the transport equipment and in sanitary and household rooms availability of first-aid kits for first-aid treatment is obligatory.

15. The organizations operating objects on which mining operations and conversion of minerals are conducted shall perform surveying ensuring works, based on the corresponding license or sign agreements on surveying ensuring works with the organizations having the license.

16. The organizations operating objects on which mining operations, conversion of minerals are conducted shall have available the regulatory legal acts establishing requirements of industrial safety, these rules, instructions for safe production of all types of the performed works, production schedules, process charts (projects of works) on maintaining, technology, servicing and repair of the equipment and mechanisms and to provide their accomplishment.

17. In each organization operating hazardous production facilities on which mining operations and conversion of minerals are conducted the mode of operation of workers and officials in case of detection of explosive materials by them in excavations, the blown-up mountain weight or other places, unappropriated for storage of explosive materials, approved by the technical lead of the organization shall be determined.

18. By simultaneous mining open and underground by methods, and also in case of operation of underground drainage developments the joint actions for safety the underground and open mining operations working at subjects to maintaining approved by the technical lead of the organization shall be performed and to include:

approval of plans and schedules of conducting mining and explosive operations;

application of the delivery scheme of airing of underground objects;

check by representatives of professional rescue unit (service) of condition of the atmosphere in underground objects after mass explosions on subjects to open mining operations;

prevention of danger of break of water in underground excavations from subject to open mining operations;

availability at persons which are part of replaceable supervision, control facilities behind content in the atmosphere of poisonous products of explosion.

Control of accomplishment of the specified actions is exercised by technical leads and specialists of subjects to open and underground mining operations.

19. Conducting mining operations shall be performed according to:

scheme of development of mining operations (in the presence);

project documentation;

the annual plan of development of mining operations developed in accordance with the established procedure.

20. The project documentation of subjects to conducting mining operations and conversion of minerals is subject to examination in accordance with the legislation of the Russian Federation. The project documentation on preservation and liquidation, and also in the cases established by the legislation of the Russian Federation on modernization of subjects to conducting mining operations and conversion of minerals is subject to examination of industrial safety.

Variations from the project documentation are not allowed.

21. If in case of operation, capital repairs, preservation or liquidation of subject to conducting mining operations and conversions of the minerals referred to category of hazardous production facilities departure from requirements of these rules is required or they are not established by the project documentation, requirements to reasons for safety of hazardous production facility according to the legislation in the field of industrial safety are established.

22. For check new and enhancements of the existing systems of development of mineral deposits and their parameters (including when using deserted technology) the operating organization shall be carried out trial testing (further - OPI) according to the working project documentation developed taking into account the project on development of mineral deposits and the conclusion of the specialized project organization (institute). OPI shall be carried out according to developed reasons for safety of hazardous production facility, the program of carrying out testing approved by the technical lead of the organization and the development plan for mining operations. Persons responsible for carrying out OPI shall be appointed the technical lead of the organization.

22.1. The program of carrying out OPI shall contain:

actions for implementation of measures of industrial safety;

basis for carrying out testing;

scientific and technical assessment of the specialized organization (institute) about the offered testing;

the data characterizing object of testing;

purpose and tasks of testing;

information about the executives in charge and collaborators participating in testing;

conditions of carrying out testing;

procedure for the organization and carrying out testing;

actions for control of carrying out testing;

start date and terms of carrying out OPI;

procedure for processing and submission of information on carrying out testing.

The term of carrying out OPI shall not exceed 1 year.

Results of carrying out OPI shall be considered by the operating organization and are reflected in the act of the carrying out OPI containing information on the course of testing, the revealed problems and conclusions. The act of carrying out OPI is signed by persons responsible for carrying out OPI, and affirms the technical lead of the organization. Following the results of the carried-out OPI the operating organization shall make in the procedure established by the legislation of the Russian Federation corresponding changes to the project documentation.

23. Before commissioning of the constructed, reconstructed subjects to conducting mining operations and conversions of minerals their acceptance in case of which are checked is performed: compliance of the project documentation, readiness of the organization for operation of production facility and for actions for localization and liquidation of accident. Construction objects, reconstruction, modernization shall be accepted in operation according to the procedure, established by the legislation of the Russian Federation.

24. The project organizations shall exercise designer's service of accomplishment of project decisions.

25. On each production process in the organizations operating hazardous production facilities of conducting mining operations, mineral processings regulations of technology production processes according to the requirements containing in this Item shall be developed. Variations from requirements and parameters set by regulations of technology production processes are not allowed.

Regulations of technology production processes (further - RTPP) shall be developed on each production process determined by Rules and shall contain:

data on the made project decisions;

specifics and features of the organization of accomplishment of the basic and auxiliary production processes in each structural division of object;

requirements to method of operation and repair of the technical devices used in specific technology production process;

procedure and sequence of accomplishment of specific technology transactions (works);

actions for ensuring control of production processes, industrial and fire safety, non-admission and accident prevention, incidents, cases of injury rate and losses of explosive materials, the set ventilation mode.

RTPP shall affirm technical leads of the operating organizations.

RTPP "Driving of Vertical Excavations (Mine Trunks)" shall contain:

methods and measures for safe production of mining operations, fixture, transportation of mountain weight and non-admission of cases of collapses of its pieces;

features of conducting mining operations in specific mining-and-geological and mining conditions;

production stages of works on equipment, fixture and armirovka of trunks, to installation and dismantle of communications, driving and stationary equipment;

data on ensuring control with devices, automatic equipment, communication systems and alarm systems.

RTPP "Driving of Horizontal and Inclined Excavations" shall contain:

"having pinned up" methods and measures for safe production of mining operations, fixture, transportation of mountain weight, non-admission of cases of collapses of its pieces and education;

features of conducting mining operations in specific mining-and-geological and mining conditions;

measures for safe use of the mountain equipment for driving of excavations and renewal of mining operations after their stop more than for 3 days, and also in case of recovery of excavations in case of their return to the operation mode from the mode of wet or dry preservation.

RTPP "Conducting Clearing Works" shall contain:

methods and measures for safe production of clearing works, implementation of otboyka and release of ore from clearing space, to transportation, prevention of collapses of pieces of mountain weight and education "having pinned up";

features of conducting mining operations in specific mining-and-geological and mining conditions;

parameters of systems of development and methods of safe dredging of mineral;

procedure for the organization of clearing works.

RTPP "Operation of Mine Rises" shall contain:

actions for safe operation of lifting installations depending on their types and appointment, types of lifting vessels and trailing devices;

procedure and methods of control of technical condition of mine hoist engines and equipment;

procedure and measures for safe descent and raising of people, load, equipment, carrying out audit of lifting installation, inspection of lifting ropes and conditions of fixture of trunk.

RTPP "Airing of Excavations (Mine)" shall contain:

methods and parameters of airing taking into account specific conditions of the mine (according to the project documentation);

measures for the organization of airing and calculation of necessary amount of air, safe operation in the conditions of the gas mode (in the presence);

operating modes of the main ventilatory installations, fans of local airing and measure for their safe operation;

procedure for creation of ventilating plans;

procedure and frequency of sampling of air on content of harmful gases and dust content;

methods and procedure for control of the air circle, including distribution of all-mine stream on local excavations;

measures for recovery of the normal mode of airing and the admission of people after mass explosion.

RTPP "Operation and Repair of Technology Transport" shall contain:

measures for safe operation and repair of technology transport and equipment, procedure for control of their technical condition;

requirements to the workers allowed to management, repair and servicing of technology transport and the equipment;

procedure for use of systems of the alarm system, centralization and blocking in case of operation of technology transport and the equipment;

methods and procedure for transportation of workers, equipment and materials.

RTPP "Fire Protection of Excavations (Mine)" shall contain:

methods and procedure for fire extinguishing, use of the special devices and means intended for localization and liquidation of the fire including the list of such means and places of their location;

method of operation of systems of automatic fire extinguishing, fire alarm and systems of the individual notification;

procedure for control of safety and suitability of fire-proof means;

data on the equipment of fire-proof warehouses and cameras of emergency airsupply according to their organic equipment.

RTPP "Protection of the Mine against Flooding and Protection of Objects on Day Surface from Adverse Effect of Mining Operations" shall contain:

measures for protection of excavations against flooding, safe operation of mine water-removing installations, liquidations of possible rassoloproyavleniye and breaks of water in underground excavations;

methods and procedure for conducting observations of development of deformations on the land surface, and also conducting the works connected with liquidation and preservation of underground excavations.

RTPP "Conducting Stowage Works" shall contain:

type of stowage works, parameters of bookmark, data on the used materials and condition of stowage pipelines;

measures of safe conducting stowage works and procedure for control of their maintaining.

RTPP "Treatment of Explosive Materials of Industrial Function" shall contain:

measures for safe works with explosive materials (transportation, production, storage, conducting explosive works);

measures for safe operation of the used processing equipment (the charging and mixing equipment, transport for transportation of explosive materials, transport and charging machines) and their repair;

safety requirements to the device of underground warehouses of explosive materials, stationary underground Items of production of explosives;

requirements imposed to the personnel allowed to work with explosive materials;

accounting treatment and protection of explosive materials.

RTPP "Conducting Overburden and Mining Works" shall contain:

parameters of system of development and measure for safe conducting mining and drilling-and-blasting operations, works with explosive materials;

measures for the prevention and non-admission of formation of peaks, navisy (having pinned up);

methods and measures for safe use of the mountain equipment, transportation of mountain weight;

procedure for education and operation of dumps;

procedure of control of conducting mining operations.

RTPP "Pylegazopodavleniye and Airing of Pits, Radiation Safety" shall contain:

data on composition of the atmosphere of subject to conducting open mining operations;

procedure for the admission of workers on work locations after production of explosive works;

measures for fight against dust and gases, ensuring natural air exchange and airing;

measures for protection of workers against radiation and procedure of radiation control (in the presence of dangerous factors);

procedure and methods of artificial airing.

RTPP "Operation and Repair of Technology Transport" shall contain:

measures for safe operation and repair of technology transport and equipment, procedure for control of their technical condition;

requirements to the workers allowed to management, repair and servicing of technology transport and the equipment;

procedure for use of systems of the alarm system, centralization and blocking in case of operation of technology transport and the equipment;

methods and procedure for transportation of workers, equipment and materials.

RTPP "Protection against Flooding" shall contain:

measures for drainage and protection against flooding, including for safe operation of water-removing installations during the flood period;

methods and procedure for liquidation of chances of flooding;

procedure for control of water lowering wells, operability of water-removing installations, availability technical and appliances necessary for prevention of flooding or its liquidation;

procedure for safe operation of water-removing installations and wells of water lowering.

RTPP "Transportation, Crushing and Sorting of Mineral" shall contain:

measures for safe performance of works when transporting, crushing and sorting of mineral;

measures for safe operation and repair of processing equipment;

procedure for use of systems of the alarm system, centralization and blocking in case of operation of technology transport;

procedure and methods of control of technical condition of processing equipment.

RTPP "Mineral processing" shall contain:

measures for safe performance of works in case of mineral enrichment;

measures for safe operation and repair of processing equipment;

procedure for use of systems of the alarm system, centralization and blocking in case of operation of technology transport;

procedure and methods of control of technical condition of processing equipment.

RTPP "Storage, Preparation, Transportation and Use of Chemicals and Reagents" shall contain:

measures for safe production of pogruzo-unloading works, storage and transportation of reagents;

safety requirements to reservoirs (container), storage locations of reagents, ventilation, dust suppression, aspiration devices.

26. The organizations operating objects on which mining operations and conversion of minerals are conducted shall provide completeness of the staff of workers and the admission to work of persons meeting the conforming qualification requirements and not having medical contraindications.

27. In the cases of the organization established by the legislation of the Russian Federation, the operating objects on which mining operations and conversion of minerals are conducted shall provide preparation and certification of heads and specialists in the field of industrial safety.

28. Heads and specialists of the organizations performing activities for operation of subjects to conducting mining operations and conversion of minerals shall have the corresponding education.

29. And conversions of minerals shall be allowed by works on subjects to conducting mining operations to technical guidance persons having the higher or secondary vocational corresponding education.

Mining education in the mines, mines, the mines, pits, drags, dredges, cuts and objects of mining which are not connected with production needs to be had:

to heads, technical leads of the organizations (objects), heads of sites (workshops), specialists of engineering services and their deputies;

to chiefs of changes (sites), technical leads and dispatchers of change.

30. The workers performing works of the increased danger which list shall be established by the head of the organization at the beginning of the working day (change) shall have medical examination (survey) on condition of alcoholic and drug intoxication. At the end of the working day (change) medical examination (survey) is performed based on the decision of the head of object.

31. The workers conducting mining operations, works on conversion of minerals shall have the professional education corresponding to profile of the performed works, shall be trained in safe working methods, know signals of the emergency notification, rule of conduct in case of accidents, the locations of survival equipment and fire extinguishing and to be able to use them. Workers shall be guided by instructions for safe conducting engineering procedures, know methods of rendering the first (pre-medical) aid. In case of revenues to work, and also at least each 6 months workers shall undergo instructing in safe acceptances of performance of works and at least once a year - check of knowledge of instructions on professions. Results of check shall be drawn up by the protocol with the made record in the relevant magazine of instructing and personal card (book) of the worker.

32. Workers and specialists shall be provided and shall use the special clothes, special footwear, operational protective helmets, points and other individual protection equipment corresponding to their profession and working conditions according to the approved regulations. The persons which are not on the staff of subject to conducting mining operations, conversions of minerals, but having need for its visit shall be instructed on security measures and are provided with individual remedies.

33. The workers occupied at works which accomplishment provides combination of professions shall be trained in safe acceptances of work and are instructed by all types of the combined works.

Servicing of machines and mechanisms, management of which is connected with operational inclusion and shutdown of electroinstallations, shall be performed by the personnel having the corresponding qualification group on electrical safety granting the right to personnel according to the job specification (order) with entry in the operational magazine to make operational switchings of cable lines within the mountain equipment fastened behind it and its priklyuchatelny Item.

34. In case of change of kind of work, and also after the happened accidents, accidents or after assumption of gross violations of requirements of safe operation with workers of object unplanned instructing shall be carried out.

35. Works shall be carried out based on the job specification issued under list to the contractor (including constituted in electronic form), according to Regulations on elegant system which shall be developed in each organization and are approved by her head.

The job specification on performance of works is issued by the authorized officer. The regulations on elegant system shall contain procedure for issue (accomplishment, completion) of the job specification on change and form of the magazine (book) of issue of the job specification.
