About order of interaction of the Ministry of Internal Affairs of the Russian Federation and Federal Security Service of the Russian Federation in case of implementation of international treaties of the Russian Federation on readmission

1. Approve the enclosed Rules of interaction of the Ministry of Internal Affairs of the Russian Federation and Federal Security Service of the Russian Federation in case of implementation of international treaties of the Russian Federation on readmission.

2. Declare invalid the order of the Government of the Russian Federation of July 13, 2012 No. 715 "About order of interaction of the Federal Migration Service and Federal Security Service of the Russian Federation in case of implementation of international treaties of the Russian Federation on readmission" (The Russian Federation Code, 2012, No. 30, the Art. 4280).

Rules of interaction of the Ministry of Internal Affairs of the Russian Federation and Federal Security Service of the Russian Federation in case of implementation of international treaties of the Russian Federation on readmission

1. These rules determine order of interaction of the Ministry of Internal Affairs of the Russian Federation and Federal Security Service of the Russian Federation:

a) in case of decision making about readmission by results of consideration of the petition (request) for readmission (acceptance) (further - the petition for readmission) sent to the Russian Federation by foreign state concerning the citizen of the Russian Federation including in case of decision making about readmission on expedited procedure by results of consideration of the petition (request) for readmission on expedited procedure (further - the petition for readmission on expedited procedure) sent to the Russian Federation by foreign state concerning the citizen of the Russian Federation;

b) by consideration of the petition for readmission sent to the Russian Federation by foreign state concerning the foreign citizen or the stateless person (further - the foreign citizen), and the petition for readmission on expedited procedure sent to the Russian Federation by foreign state concerning the foreign citizen and also in case of decision making about readmission by results of consideration of the petition for readmission or petitions for readmission on expedited procedure;

c) in case of decision making about transit by results of consideration of the petition (request) for transit (further - the petition for transit) sent to the Russian Federation by foreign state concerning the foreign citizen;

d) in case of the direction the Russian Federation to foreign state of the petition for readmission or petitions for transit concerning the foreign citizen, and also in case of decision making about readmission by results of consideration of the petition for readmission or petitions for transit.

2. The Ministry of Internal Affairs of the Russian Federation in case of decision making about readmission by results of consideration of the petition for readmission sent to the Russian Federation by foreign state concerning the citizen of the Russian Federation within 3 working days from the date of adoption of such decision sends to Federal Security Service of the Russian Federation the copy of the decision on readmission with appendix of the photo of the citizen of the Russian Federation concerning which the petition for readmission arrived.

3. The Ministry of Internal Affairs of the Russian Federation within 3 working days from the date of achievement of arrangements with foreign state on date, time and the check point through frontier of the Russian Federation (further respectively - the check point, frontier) at which acceptance of the citizen of the Russian Federation on which the decision on readmission is made will be performed, informs on it Federal Security Service of the Russian Federation.

If from the date of achievement of the specified arrangements with foreign state before day of acceptance of the specified citizen of the Russian Federation there were less than 3 working days, the Ministry of Internal Affairs of the Russian Federation within 24 hours from the moment of achievement of the specified arrangements informs Federal Security Service of the Russian Federation on date, time and the check point.

4. The territorial authority of the Ministry of Internal Affairs of the Russian Federation at the regional level participating in acceptance of the citizen of the Russian Federation specified in Item 3 of these rules, without delay after receipt of data on date time and the check point sends the specified information with application of a copy of the decision on readmission to the relevant boundary organ of the Federal Security Service (further - boundary body) for the organization according to the mode at the check point of pass of the employee of territorial authority of the Ministry of Internal Affairs of the Russian Federation at the regional level to this check point to the place of the expected omission through frontier of the specified citizen of the Russian Federation.

5. In case of decision making about readmission on expedited procedure by results of consideration of the petition for readmission on expedited procedure sent to the Russian Federation by foreign state concerning the citizen of the Russian Federation, the boundary body within 24 hours from the moment of adoption of such decision informs on it the relevant territorial authority of the Ministry of Internal Affairs of the Russian Federation at the regional level.

6. The Ministry of Internal Affairs of the Russian Federation within 24 hours from the moment of receipt of information on arrival in the Russian Federation of the citizen of the Russian Federation accepted according to the international treaty of the Russian Federation on readmission sends to Federal Security Service of the Russian Federation the telephone message about arrival of the specified citizen of the Russian Federation. Data on the direction of the telephone message are registered telephone messages.

The form of the magazine of telephone messages affirms the Ministry of Internal Affairs of the Russian Federation together with Federal Security Service of the Russian Federation.

7. The Ministry of Internal Affairs of the Russian Federation at least 1 time a month sends to Federal Security Service of the Russian Federation of the questionnaire of the citizens of the Russian Federation accepted according to the international treaty of the Russian Federation on readmission, filled with the specified citizens of the Russian Federation independently in case of their arrival or at their request the employee of territorial authority of the Ministry of Internal Affairs of the Russian Federation at the regional level.

The form of the questionnaire affirms the Ministry of Internal Affairs of the Russian Federation.

8. In case of receipt of the petition for readmission sent to the Russian Federation by foreign state concerning the foreign citizen, the Ministry of Internal Affairs of the Russian Federation within 5 working days from the date of receipt of such petition for readmission sends its copy to Federal Security Service of the Russian Federation.
