About approval of the Regulations on the Agency on intellectual property of the Republic of Uzbekistan

In pursuance of the resolution of the President of the Republic of Uzbekistan of October 20, 2016 "About measures for enhancement of activities of the Agency for intellectual property of the Republic of Uzbekistan" the Cabinet of Ministers decides No. PP-2637:

1. Approve new Regulations on the Agency on intellectual property of the Republic of Uzbekistan according to appendix.

2. Determine the main sources of financing of activities of the Agency for intellectual property of the Republic of Uzbekistan:

means of the Government budget of the Republic of Uzbekistan;

the extrabudgetary funds created in the procedure established by the legislation at the expense of patent fees, payment for registration of programs for electronic computers and databases, and also other sources which are not forbidden by the legislation.

3. Reorganize in accordance with the established procedure the State unitary enterprise "Intellekt Ekspert" under the Agency for intellectual property of the Republic of Uzbekistan by accession to Training center on retraining and advanced training of personnel in the sphere of intellectual property under the Agency on intellectual property of the Republic of Uzbekistan.

4. Declare invalid the resolution of the Cabinet of Ministers of June 8, 2011 No. 166 "About measures for the organization of activities of the Agency for intellectual property of the Republic of Uzbekistan" (the joint venture of the Republic of Uzbekistan, 2011, No. 6, the Art. 47).

5. To the agency on intellectual property of the Republic of Uzbekistan together with the Ministry of Justice and other interested ministries and departments in a month:

make offers on the changes and amendments in the legislation following from this resolution;

bring the departmental regulatory legal acts adopted by them into accord with this resolution.

6. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan A. N. Aripov.

Regulations on the Agency on intellectual property of the Republic of Uzbekistan

Chapter 1. General provisions

1. The agency on intellectual property of the Republic of Uzbekistan (further - the Agency) is the republican state body providing realization of single state policy in the field of intellectual property and in the activities is accountable to the Cabinet of Ministers of the Republic of Uzbekistan.

2. The agency in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, other acts of the legislation and this Provision.

Chapter 2. Main objectives and functions of the Agency

5. The main objectives of the Agency are:

ensuring realization of single state policy in the field of intellectual property, provision of legal protection to inventions, useful models, industrial designs, trademarks and other intellectual property items;

organization and conducting examination, registration and accounting of inventions, industrial designs, useful models, trademarks and other intellectual property items;

forming and maintaining the State patent fund and the database about officially the registered intellectual property items, ensuring their safety and availability to effective use of real production sector by business entities, scientific organizations, scientists and specialists;

implementation of modern information technologies in the sphere of intellectual property, rendering interactive state services to subjects of entrepreneurship and to the population by the principle "one window";

rendering consulting and practical assistance to the companies and organizations for ensuring legal protection of objects of national intellectual property abroad, and also expansion of international cooperation in the sphere of intellectual property;

implementation of retraining and advanced training of specialists in the sphere of intellectual property.

6. For accomplishment of the assigned tasks the Agency performs the following functions:

develops offers on enhancement of state policy and the legislation in the field of intellectual property and in accordance with the established procedure submits them for consideration in the Cabinet of Ministers of the Republic of Uzbekistan;

takes cognizance of requests for issue of security documents for inventions, useful models, industrial designs, selection achievements, trademarks, service marks, names of places of goods origin, the program for electronic computers (further - EVM), databases and topology of integrated chips;

performs state examination of inventions, useful models, industrial designs, trademarks, service marks, names of places of goods origin, establishes priority of the declared objects, carries out formal expertize of selection achievements, the computer programs, databases and topology of integrated chips;

performs state registration of inventions, useful models, industrial designs, registration of selection achievements, trademarks, service marks, names of places of goods origin, official registration of the computer programs, databases and registration of topology of integrated chips, issues security documents, keeps the corresponding registers and the List of well-known trademarks in the Republic of Uzbekistan;

makes decisions on issue or on refusal in issue of security documents for the invention, useful model, industrial design, the trademark, service mark, the name of places of goods origin, the computer program, the database and topology of integrated chips by results of check of compliance of the submitted applications to the established requirements;
