About the measures directed to settlement of debt of the heatsupplying and heatgenerating organizations and the companies of centralized water supply and water disposal

This Law determines complex of the organizational and economic measures aimed at providing steady functioning of the heatsupplying and heatgenerating organizations and the companies of centralized water supply and water disposal.

Section I General provisions

Article 1. Determination of terms

1. In this Law the following basic concepts are used:

settlement - calculations for debt repayment, the procedures of settlement of debt which are carried out at the expense of the government budget by participants;

the agreement on the organization of settlement - the agreement which is signed by participants of the procedure of settlement of debt for debt repayment and is the basis for carrying out settlement according to this Law;

debt which is subject to settlement according to this Law (further - debt) (such accounts payable, in particular, joins debt on which the judgment on collection is made or the voluntary settlement is approved):

accounts payable of the heatsupplying and heatgenerating organizations before the supplier of natural gas, suppliers of other energy carriers, operators of gas-distribution systems, the operator of gas-transport system and person who performed functions of the operator of gas-transport system till December 31, 2019 inclusive for the consumed natural gas and other energy carriers used for production of heat and electrical energy (including according to purchase and sale agreements of natural gas for own needs which was used only for production of heat and electrical energy), provision of services on centralized heating and centralized supply of hot water, delivery services of heat energy and supply of hot water (including in case of replacement of the party in the obligation and/or in case of legal succession), and also services in its distribution and transportation;

accounts payable of the heatsupplying and heatgenerating organizations before limited liability company "the Gas-supplying company "Naftogaz Trading", limited liability company "the Gas-supplying company "Naftogaz of Ukraine", subject of managing which performs functions of the supplier of "the last hope", for the consumed natural gas since June 1, 2021 on the last number of the sixth month after month in which the warlike situation will be stopped or cancelled, and also for services in its distribution and transportation;

accounts payable of the heatsupplying organizations before the heatgenerating organizations for the heat energy received for its subsequent delivery to consumers and/or provision of the corresponding utilities (including debt to NAK Naftogaz Ukrainy which the right to claim is acquired by replacement of the creditor in the obligation);

accounts payable before the supplier of electrical energy, the electrosupplier, the operator of system of distribution (as the legal successor regarding the rights and obligations according to delivery agreements of electrical energy and about use of electrical energy) the companies of centralized water supply and water disposal for the electrical energy consumed for production and provision of services on centralized supply of cold water and drainage system (with use of intra house systems), services of centralized water supply and centralized water disposal;

accounts payable for services in distribution/transfer of electrical energy of the companies of centralized water supply and water disposal before operators of systems of distribution or operators of system of transfer (in case of accession of electroinstallations of the consumer to networks of the operator of system of transfer);

accounts payable for services of centralized water supply and centralized water disposal of the heatsupplying and heatgenerating organizations, and also accounts payable of the companies of centralized water supply and water disposal for the drinking water acquired for the purpose of its further realization to consumers and/or in case of sewage treatment by other companies of centralized water supply and drainage system;
