About approval of the Instruction about procedure for carrying out tenders at the choice of contractors of actions of state programs

1. Approve the Instruction about procedure for carrying out tenders at the choice of contractors of actions of state programs it (is applied).

2. This resolution becomes effective after its official publication.

The instruction about procedure for carrying out tenders at the choice of contractors of actions of state programs

1. This Instruction determines procedure for carrying out tenders at the choice of contractors of actions of state programs, responsible customer (customer coordinator) of which is the Ministry of forestry (further - the state program) if other is not established by the legislation.

2. For the purposes of this Instruction terms and their determinations in the values established by Regulations on procedure for forming, financing, accomplishment and efficiency evaluation of implementation of state programs and also the following terms and their determinations are applied:

date of tender - date of commission session which agenda includes question of determination of the participant of the tender which won competition;

the contract for accomplishment of action - the contract for accomplishment of action of the state program signed between the customer of this state program and the contractor of action determined by this customer by results of tender;

the bid - the paper document, including the statement on participation in tender constituted according to requirements of this Instruction and submitted to the organizer of tender by the legal entity, the individual entrepreneur declaring the participation in tender as the potential contractor of action;

the notice on carrying out tender - the paper document constituted according to requirements of this Instruction and signed by the head of the organizer of tender or other representative it person whom the organizer of tender informs legal entities and individual entrepreneurs on carrying out tender, including repeated, by means of its placement on the official site;

the commission - the commission created by the organizer of tender for the carrying out tender and other purposes determined by this Instruction;

tender - method of the choice of the contractor following the results of which the participant who offered according to the decision of the commission the best terms for the conclusion of the contract for accomplishment of action in comparison with the conditions offered by other participants is recognized won;

the organizer of tender - the customer of the state program;

the official site - the website of the organizer of tender on the global computer Internet;

acceptance of the bid - registration by the organizer of the tender of the post envelope having mark "The bid according to the state program", which arrived to the organizer of tender, by putting down of the mark in it consisting of the abbreviated name of the organizer of tender and receipt date of post envelope to the organizer of tender;

the participant of tender - the legal entity, the individual entrepreneur who submitted to the organizer of tender the bid.

3. Selection of contractors of actions of the state program is performed by the organizer of tender by carrying out tender by it.

Subject of tender is the right to the conclusion of the contract for accomplishment of action.

Subjects of managing, except as specified, are allowed to participation in tender by the commission if:

their property it is seized;

they are in process of liquidation (the activities termination), concerning their court the decision on bankruptcy with liquidation (the activities termination) of the debtor is made, they are in process of reorganization (except for the legal entities reorganized by joining to them of other legal entities);

they are included in supplier list (contractors, contractors) who are temporarily not allowed to participation in procedures of public procurements;

they provided unreliable information about themselves.

4. For the announcement of tender by the organizer of tender the notice on carrying out tender according to requirements of this Instruction which it affirms before its placement on the official site is constituted.

The organizer of tender also has the right to inform on carrying out tender by placement of the notice on carrying out tender in printing mass media.

5. The notice on carrying out tender shall contain:

5.1. the information about the organizer of tender, including its full name, the location, the e-mail address and the official site, surname, own name, middle name (if that is available) the authorized person and number of its phone;

5.2. information on tender, including:

terms and procedure for carrying out tender;

tender subject;

about deposit (the size, procedure and terms of introduction, details of the current (settlement) bank account on which it shall be listed, procedure and terms of its return, other information on the decision of the organizer of tender) if necessary;

about cost recovery on the organization and carrying out tender (the size, procedure, terms, other information on the decision of the organizer of tender) if necessary;

date, time and place of opening of bids;

5.3. the name of the state program, the name of the subprogramme (if the state program has subprogrammes), the name of action of the state program;

5.4. information on conditions of accomplishment of action of the state program:

5.4.1. approximate terms of accomplishment, accomplishment stages (if necessary);

5.4.2. possibility of distribution of complete amount of accomplishment of action in parts for the purpose of submission of bids on any of such parts (if necessary);

5.4.3. results from accomplishment of action for the organizer of tender;

5.4.4. the approximate size of the means from appropriate source of financing provided to the contractor of action on accomplishment of action (further - financing of action);

5.4.5. other conditions on the decision of the organizer of tender (if necessary);

5.5. information on determination of the participant of the tender which won competition including:

5.5.1. the list of criteria of determination of the participant of the tender which won competition, and their description;
