About the State sanitary inspection

(as amended on 11-12-2014)

This Law governs the public relations on ensuring sanitary and epidemic wellbeing and radiation safety of the population, affirms human right on the favorable environment and other related rights and guarantees of their realization.

The state sanitary inspection is activities of sanitary and epidemiologic service for the prevention, identification and suppression of violations of the sanitary legislation.

Section I. General provisions

Article 1. Legislation of the Republic of Uzbekistan on the state sanitary inspection

The legislation of the Republic of Uzbekistan on sanitary inspection consists of this Law and published by state governing bodies within their powers of legal acts.

Article 2. Basic principles of ensuring sanitary and epidemic wellbeing of the population

The basic principles of ensuring sanitary and epidemic wellbeing of the population are:

guarantee of human right for preservation and promotion of health on the basis of realization of complex of the legislative, sanitary and anti-epidemic and organizational actions directed to improvement of the environment, improvement of food, working conditions, life, rest, education, training;

priority of precautionary activities for prevention of adverse effect on health of the population of factors of the environment during the planning, placement, design, construction and commissioning of economic objects, processing equipment and devices, automobiles;

increase in sanitary and cultural level of the population;

holding sanitary and anti-epidemic actions as obligatory part of productive and social activity;

compensation by the companies, organizations, organizations, associations irrespective of patterns of ownership, individuals of the damage caused to health of the population and the environment as a result of non-compliance with sanitary standards, hygienic standard rates and not holding sanitary and anti-epidemic actions;

implementation of the state sanitary inspection behind respect for sanitary standards, rules and holding sanitary and hygienic actions.

Article 3. Sanitary standards, rules and hygienic standard rates

Sanitary standards, rules and hygienic standard rates are developed by research and other organizations, affirm the Chief state health officer of the Republic of Uzbekistan and are subject to publication in three-months time after their approval.

Section II. Human right on the favorable environment and guarantees of its providing

Article 4. Human right on the favorable environment

Each person has the right to the favorable environment.

Article 5. Right to be informed about the state of health of the population and the environment

Each person has the right to reliable information about incidence, epidemic and radiation situation, state of environment and their influence on human health, and also about results of the carried-out hygienic and other special examinations.

Article 6. The right to compensation of the damage caused to health of the person

Each person has the right to compensation of the damage caused to health by impact of harmful chemical, physical, biological and other factors of the environment, and also poor-quality products of food, consumer goods and other products of the industry.

Section III. Requirements for ensuring sanitary and epidemic wellbeing, radiation safety of the population and obligation for their accomplishment

Article 7. Obligations of state bodies, companies, organizations, organizations, associations and individuals on providing the sanitary and epidemiologic equipment of the population

State bodies, the companies, organizations, the organizations, associations irrespective of patterns of ownership and individuals shall:

respect the sanitary standards approved in accordance with the established procedure, rules and hygienic standard rates;

represent to bodies, organizations, the officials exercising the state sanitary inspection, the reliable and complete information about the happened accidents, sanitary and epidemic, radiation situation.

Article 8. Obligations of developers of the specifications and technical documentation

State bodies, the companies, organizations, the organizations, associations irrespective of patterns of ownership and the individuals developing the specifications and technical documentation shall respect the sanitary standards, rules and hygienic standard rates aimed at providing health protection, sanitary and epidemic wellbeing of the population.

The specified bodies, the companies, organizations, associations and individuals before implementation of the new chemical and biological substances, sources of ionizing radiation and devices containing these sources, perfumery and cosmetic products, materials, engineering procedures, the equipment and other consumer goods shall develop reasonable offers to standard rates on ensuring sanitary and epidemic safety of the population, control methods of their observance, methods of neutralization of harmful products and waste and to submit them for approval to the Chief state health officer of the Republic of Uzbekistan.

Article 9. Obligation of observance of health requirements during the designing, construction and commissioning of objects

Heads of the companies, organizations, organizations, associations irrespective of patterns of ownership and individuals during the designing, construction, reconstruction of objects, modernization of the companies and input them in operation shall respect sanitary standards, rules and hygienic standard rates.

Article 10. Requirements to content of the territories, constructions, buildings, operation of the equipment and vehicles

The companies, organizations, the organizations, associations irrespective of patterns of ownership and individuals shall provide operation of processing and other equipment, content of the territory, constructions, production and sanitary and household rooms and workplaces, premises, buildings of child care, treatment-and-prophylactic, educational, cultural, sports and other facilities, and also vehicles in compliance with sanitary standards, rules and hygienic standard rates.
