About approval of Rules of the indemnification caused to workers by the mutilation, occupational disease or other damage of health connected with execution of labor obligations by them

In pursuance of the Law of the Republic of Uzbekistan "About labor protection" and resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of July 12, 2000 "About review and development of regulating documents on labor protection" the Cabinet of Ministers decides No. 267:

1. Approve Rules of the indemnification caused to workers by the mutilation, occupational disease or other damage of health connected with execution of labor obligations by them according to appendix No. 1.

2. Determine that the debt of the reorganized or liquidated agricultural cooperatives (shirkat), farmer and Dehkan farms on indemnification, caused to the worker by the mutilation, occupational disease either other damage of health or its death connected with execution of labor obligations before adoption of this resolution, is paid for the account of means of the off-budget Pension fund under the Ministry of Finance of the Republic of Uzbekistan in accordance with the established procedure.

3. Irrespective of patterns of ownership and modes of production to provide to the ministries, departments, business entities bringing these rules to the divisions and structures, and also their correct application.

4. Recognize invalid and make addition to some decisions of the Government of the Republic of Uzbekistan according to  appendix No. 2.

5. To impose control over the implementation of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov.

Rules of the indemnification caused to workers by the mutilation, occupational disease or other damage of health connected with execution of labor obligations by them

I. General provisions

1. The relation on indemnification caused to the worker by the mutilation, occupational disease either other damage of health or its death connected with execution of labor obligations by it are regulated by the laws of the Republic of Uzbekistan, other regulatory legal acts, and also these rules.

Action of these rules extends to the legal entities using wage labor located in the territory of the Republic of Uzbekistan irrespective of patterns of ownership and managing, Dehkan farms without formation of legal entity (daleerabotodatel), and also to the workers who were working or working according to employment contracts in the territory of the Republic of Uzbekistan and sustained labor injuries.

2. The employer bears liability for the harm done to health of the worker by labor mutilation both in the territory of employer, and beyond its limits, and also in travel time to place of employment or from work on the transport provided by the employer.

The employer shall compensate the harm done to the worker by the labor mutilation or other connected with execution of labor obligations, damage of health if does not prove that harm is done not through his fault.
