About approval of Rules of carrying out qualifications of independent assessment of qualification by assessment center in the form of professional examination

1. Approve the enclosed Rules of carrying out qualifications of independent assessment of qualification by assessment center in the form of professional examination.

2. To make to the Ministry of Labour and Social Protection of the Russian Federation explanations concerning application of Rules of carrying out the qualifications of independent assessment of qualification by assessment center in the form of professional examination approved by this resolution.

3. This resolution becomes effective since January 1, 2017.

Rules of carrying out qualifications of independent assessment of qualification by assessment center in the form of professional examination

1. These rules establish procedure for carrying out qualifications of independent assessment of qualification by assessment center in the form of professional examination.

2. The concepts used in these rules mean the following:

"estimative means for carrying out independent assessment of qualification" - complex of tasks, the evaluation criteria used by assessment centers of qualifications when holding professional examination;

"the register of data on carrying out independent assessment of qualification" - information resource for ensuring carrying out independent assessment of qualification;

"council on professional qualifications" - the governing body allocated according to the Federal Law "About Independent Assessment of Qualification" powers on the organization of carrying out independent assessment of qualification for certain type of professional activity;

"job seeker" - the worker or person applying for implementation of certain type of labor activity who addressed, including in the direction of the employer, to assessment center of qualifications for confirmation of the qualification according to the procedure, established by the Federal Law "About Independent Assessment of Qualification" and these rules;

"assessment center of qualifications" - the legal entity performing activities for carrying out independent assessment of qualification according to the Federal Law "About Independent Assessment of Qualification".

3. Professional examination is held by assessment center of qualifications for confirmation of conformity of qualification of the job seeker to the provisions of the professional standard or qualification requirements established by the Federal Laws and other regulatory legal acts of the Russian Federation.

4. For the purpose of informing citizens and the organizations on holding professional examination on the official sites of assessment center of qualifications and council on professional qualifications on the Internet and in the register of data on carrying out independent assessment of qualification the following data and documents are placed:

a) names of qualifications and the requirement to qualification, stipulated in Item 3 these rules, on compliance to which the assessment center of qualifications carries out independent assessment of qualification;

b) effective periods of certificates on qualification on the corresponding qualifications;

c) list of the documents necessary for passing of professional examination in the corresponding qualifications;

d) complex of the tasks which are part of estimative means for carrying out independent assessment of qualification;

e) postal addresses, e-mail addresses, addresses of the official sites of assessment center of qualifications and council on professional qualifications on the Internet;

e) addresses of venues of professional examination;

g) the application form of the job seeker about holding professional examination;

h) these rules.

5. Professional examination is held at the initiative of the job seeker at the expense of means of the job seeker, other physical and (or) legal entities or in the direction of the employer at the expense of means of the employer according to the procedure, established by the labor law.

6. Person at the expense of whose means professional examination is held (the job seeker, the employer, other physical and (or) legal entity) makes fee on holding professional examination based on the prisoner between it and assessment center of qualifications of the agreement on paid rendering services (further - the agreement).

7. For passing of professional examination the job seeker personally or through the legal representative represents to assessment center of qualifications on the paper or electronic medium the set of documents including (further - set of documents of the job seeker):

a) the statement for holding professional examination with indication of qualification on which it wants to take place professional examination at the same time in the statement is agreed by the job seeker to processing of its personal data containing in the statement, and also in the documents and materials attached to it;

b) passport copy or other identity document of the job seeker;

c) other documents necessary for passing by the job seeker of professional examination in the corresponding qualification, information on which contains in the register of data for carrying out independent assessment of qualification.

8. For the purpose of ensuring holding professional examination the assessment center of qualifications performs:

a) acceptance and registration of set of documents of the job seeker;

b) consideration and informing job seeker or legal representative on results of consideration of set of documents of the job seeker;

c) determination and coordination with the job seeker or legal representative of date, place and time of holding professional examination;

d) holding professional examination;

e) registration of results of holding professional examination;

e) registration and issue to the job seeker or legal representative of the certificate on qualification (in case of receipt of unsatisfactory assessment by the job seeker following the results of passing of professional examination registration and issue to the job seeker or legal representative of the conclusion about passing by the job seeker of the professional examination including recommendations for the job seeker).

9. The assessment center of qualifications within 10 calendar days after receipt of set of documents of the job seeker informs the job seeker or the legal representative by the method specified in the statement for holding professional examination, for results of consideration of the application and set of documents of the job seeker and approves with the job seeker or the legal representative date, the place and time of holding professional examination, and also informs the job seeker or the legal representative on procedures of holding professional examination.
